We received our RFE in the mail yesterday, however we are not sure what the heck they are wanting from us.

The only thing we received was three sheets of paper; two blue ones giving case number and standard stuff and one white one requesting info. NOTHING else at all, We did NOT receive our petition back again. ( some of the points seem to be in regards to circled sections of the petition which we did not receive.

What should we do, we tried calling once today but the lady at CSC said she would need to look at it and call us back and she would take a week to call us back. (she was no help at all and sounded like she didn't have a clue what we were asking about)

Here is the copy of what was on the white piece of paper;

2. The International Marriage Broker Regulation Act of 2005, Pub. L. No. 109-162 0anuary S. 2006) (IMBRA) has established new requirements pertaining to Form I-129F, Petition for Alien Fiance (e). In light of the new amendment, USCIS is requesting you complete the following questions, sign, date, and resubmit to the address listed below.

3. Additionally, IMBRA imposes limitations on the number of petitions you may file or have approved without seeking a waiver of the application of those limitations. If you have filed two or more K-1 visa petitions at any time in die past or previously had a K-1 visa petition approved within two years prior to the filing of this petition, you must apply for a waiver. To apply for a waiver, you must attach a signed and dated request for the waiver, explaining why a waiver would be appropriate in your case, together with any evidence in support of your request. Examples of such evidence include, but are not limited to: a death certificate, police reports, news articles, or medical reports from a licensed medical professional, regarding the death of an alien approved for a prior K visa.

4. If you answered yes to question part A-11, " have you ever field for this or any other alien fiance' (e) or husband/wife before'? However, the petitioner omitted to include the names of the aliens he's applied for; as well as the place and date of filing of the petition/application. Please provide this missing information.

Damn. Now I am wondering if I put N/A somewhere where I should have put none. That really seems petty to me.

In any case, here are my suggestions.

First realize that you have received a form letter and everything may not apply to you. However, I think it is safe to bet at least one of the things on the list does apply to you. Since they did not include the copy of the petition, you need to look at your own copy and figure out what they are looking for.

  1. Make a copy of your I-129F.
  2. Review it carefully. If there are any fields where you entered N/A that could also have been answered with "None", write in "None".
  3. Make sure you have answered all the IMBRA related questions properly, also using "none" instead of "N/A" as appropriate.
  4. If A-11 was answered yes, provide the required names as indicated. If not, make sure you checked the no box.
  5. Prepare a cover letter explaining that you did not receive a copy of the petition with items circles as indicated in #1 nor did you did you receive a list of questions indicated in #2. Include a list of what changes you have made.
  6. Sign and date the cover letter and the copy of the modified I-129F.
  7. Send everything back. I think they give you a special address or an envelope or something. Use express mail.
  8. As soon as they have received your package call the RFE line every day.

You may find that the information that you provide will satisfy them. If not, they will send you another RFE that hopefully will be more complete than the last one. I know that sucks, but I think it will get things resolved as soon as possible. To wait around for a week for someone who may or may not call you back seems like a waste of time to me.

well, I looked at the instruction of I-129F. It said

Fill out the Form I-129F

1, Type or print legibly in black ink.

2, If extra space is needed to complete any item, attach a continuation sheet, indicate the item number, and date and sign each sheet.

3, Answe all questions fully and accurately. State that an item is not applicable with "N/A". If the answer is none, write "none".

My fiance wrote N/A to most of spaces, but put none to Question 13 about fiance's children because putting N/A does not make any sense.

I do not know if we get REF too. I hope not.

I have a question. My fiance (USC) sent our petition in the end of July, but he did not include my birth certificate. On the VJ, beneficiary's birth cetificate was not on the list, so he did not include.

I sent a copy of my passport and I-20 from my previous university in the US, but NO birth certificate. I sent it to him with English translation in July. Is it ok for us to send it if we get RFE? Simply says that we forgot to include? It was dated in July and I signed it orginally.

Our petition got approved without my hubby's birth certificate, it was only required at the Consulate interview in India. :yes:

If you get an RFE, you can certainly send in the birth certificate. If you don't get an RFE, just include it at the Consulate stage. :thumbs:

We had an RFE at the interview itself and I wanted to note it here. If you are using your home as an asset for the I-134, make sure you include the actual deed to your property. I included proof of ownership and proof of equity, but they needed to see the actual deed before they would issue the visa.

Forget roses and chocolates; when you've found someone who will do government paperwork for you - that's love!

Keep in mind that each service center is not the same and each adjudicator is not the same. Some look for and request things that others do not. In my case the adjudicator wanted my Birth Cerificate (long form and certified), however others are not this picky on the beneficiary. Some RFE's come in the form of a checklist where we received a form letter that was paragraphed with each and everything our adjudicator was requesting. Oddly enough and painstaking due to the added lenght of time, everything on our PARAGRAPHED RFE was already given to them in our initial package. All we did was resend what we had sent out initially. Crazy I know, but sadly it is what it is. However, now we are out of VSC and NVC. C had his medical over a week ago.....that went well. Now the most important part awaits...our interview.

April 24th 2007 NOA1

July 11th 2007 touched

August 10th 2007 RFE (paperwork they already had)

August 13thFED EX RFE INFO

August 14 VSC Received

August 21st touched

August 22nd touched

I have a question. I used to be an international student at American university. I graduated from my BA last september.

My fiance and I have been long distance since then due to visa process. Now, we sent our petition with my passport copies including all stamped pages, last three boarding passes, and I-20 copies from my university. I went back and forth from US to Japan for many times during my college years like visitng my families. And this september, he finally came to Japan to meet my family.

Well, I sent only the evidence that I have been to the US many times. He visited me after we sent our I-129f. I wonder if both of us have to sent our boading pass, passport copies etc. And I did not have tickets anymore. All I had was boading passes, but since I was not a tourist and I was being a F1 student for 4 years, the immigration should have my data already. I wonder if my USC fiance has to send his evidence additionally.

Please anyone give me advice. :unsure::unsure::unsure::help::help:

First of all, if you sent in evidence that you have been to USA many times, it should be enough (along with photos of both of you together too). Copies of your passport will also confirm your visits. They just want proof that you two have met, it is not required that he show proof that he has been to your country. However if asked (and for the Consulate interview), it would be great if you could provide the proof of him coming to visit you in Japan also.

Certainly they have proof of your visits to USA, but when you submit the immigration paperwork, they want us to submit the proof we have in a nice, neat packet. That's a lot easier than have the employees do extensive research on their own, for every case.

Second, this thread is specifically for people who have received RFEs (Request for additional Evidence) so not many people read it. If you have other questions, start a new topic so more people can see it and reply! :thumbs:

We got our RFE mail today.

I am twice married before. I sent the last divorce certificate, translated apostilled all.

Well, they asked for the first divorce certificate too. Is it possible? I mean, here in Europe we too marry once at a time and to married the second, i have to be divorced of the first. Good that i have that document handy! :thumbs:

When sending the petition envelop, don't forget to include ALL divorce certificates (if you are previously divorced)even if it is many years ago. Do not forget to translate them!

We got an RFE on the 31st of Oct. They were requesting a translated copy of my fiancee's birth certificate. Something we could have given them at the outset had we known they would decide they needed it.

Is your fiancee the petitioner or the beneficiary?
