Engagement Visa After Marriage

Alright so my american fiance is coming back to my country very soon and we want to get married with her right away. We are excited about it and don't want to postpone the marriage.

However after we have married for the us authorities to approve my green card will take no less than 1 year. People from the us embassy here told me that the k-1 visa will take approximately 6 months. So I am thinking is it possible to get married in my country and then apply for a k-1 visa so that we can get married there as well? This way we can move in together there quicker.

If you submit a K1 application after getting married you will lose your money and they will deny you because you are married and do not qualify for a K1 visa. If you marry you can apply for a CR1 visa and the process will take a bit over a year.

This will not be over quickly. You will not enjoy this.

No. K1 is for unmarried couples only (it doesn't matter where you marry, being legally married at all makes you ineligible).

You'll be chasing the CR-1 via the I-130.

* I-130/CR-1 visa by Direct Consular Filing in London
3rd May 2013 - Married in London

7th May 2013 - I-130 filed
4th June 2013 - NOA2 (approved)
16th July 2013 - Interview (approved)
30th July 2013 - POE San Francisco
29th August 2013 - 2 year green card arrived

* Naturalisation (Citizenship) via Phoenix Lockbox

* San Francisco Field Office:
1st May 2016 - N-400 window opened
20th August 2016 - N-400 filed

26th August 2016 - NOA1

12th January 2017 - Biometrics (again)
30th May 2017 - Interview (approved)

After we marry we wont need or want a K 1 visa which designed for you to marry later and inside the USA.

Married status allows the USC to petition for a C R 1 visa. That can be done the day after we marry. We then wait about 12 months to then enter the USA.

K1 is for single unmarried couples. If you marry, then there is no reason to file the K1. as others said, you would file the i130 CR1 visa for spouses.

or you wait and file the K1 and marry in the US or you marry in your country, and then she returns to the US and files for the i130 spousal visa.

married is married, the US recognizes marriages abroad. so you cannot marry and then say you are single. with the K1 your GF will have to send a letter of intent to marry.

You cant go by speed of approvals. Right now all service centers are focused on the I-130 and we are seeing new applications getting approved under 30 days. You may get lucky and get a fast approval which ever one you choose there's no guarantee of fast approval .

Decide which fits better for you K1 or Cr1.

You cant go by speed of approvals. Right now all service centers are focused on the I-130 and we are seeing new applications getting approved under 30 days. You may get lucky and get a fast approval which ever one you choose there's no guarantee of fast approval .

Can you elaborate on this matter please? What exactly is this speed of approvals? I am interested. The big problem for my fiance is that she is not allowed to stay for more than 90 days in my country and I am not allowed to visit her in the USA. We really want to solve this as soon as we can.

You have 2 options. Stay unmarried, file an i129f for a k1 then marry in the US. Or marry in your country now and file an i130 for a cr1 visa. Those are the only ways to solve your problem. Study the guides at the top of the page for more understanding. We have all had to go through the separation from our fiancé/spouse while our petitions and applications were pending, you will too. It is what it is.

K-1 is for fiance(e)s only. If you're married, that's a spouse, and requires and entirely different visa.

While we recognize you want everything to happen as fast as possible, so does everyone else. There are no shortcuts.

You can get engaged and file for a K-1.

You can get married and file for a CR-1.

Which you choose is up to you. Currently K-1s are processing reasonably fast, and CR-1s are taking over a year, however, CR-1s are starting to get pushed to other processing centers as there's a backlog, so we're going to start seeing faster approvals there. At this particular point, it's really a gamble and personal choice which one would be better.

November 14th, 2013: She's here!

December 12th, 2013: Picked up marriage license.

December 14th, 2013: Wedding

Huh? Getting approved in under 30 days?? Which petitions are those? Because I have seen no such approvals of I-130s lately. Are you sure you're not confusing them with I-129Fs? Just curious.
