AOS Denied because We Forgot one paperwork,

Entered the Us on a k1 visa in December 2012,

Got married 3 days later. Filled up AOS, got my fingerprints taken, got the interview. Everything went well.

One month ago we received a RFE because my wife ( who has her own business ) didn't pay herself last year hence she didn't meet the federal poverty income.

Katie's mom, who is a neurologist makes 220k year so we figured that she would sponsor us. Indeed we sent back the I 864 affidavit of support with Katie's last three year tax return hoping that her W2 would fully satisfy the uscis....

Well I just got a letter from the uscis saying that our case was denied because we forgot ..... :

KATIE'S MOM BIRTH CERTIFICATE !

Now I have to fill a I 290b.. I don't know if I should do it or just reapply for the whole I 485...

We are lost, just for a stupid human mistake, a technicality... Government sucks.

Should I hire a lawyer ?

Ps : but how does reapplying works ? Will my old application will jeopardize the new one ?

You can reapply again. The thing with RFEs is you only get one chance to make it right. They give you 2 tries, not more. Both of your tries were not correct, unfortunately.

Yes, proof of being a USC or LPR is required with a joint sponsor's I-864. Just file everything again and this time include the proof of citizenship for your joint sponsor. No lawyer needed.

Thanks everybody, I'm gonna refill everything. Just going to give a call to the uscis number.

I just let everybody know at work this morning that my I 485 got denied hence my EAD was revoked.

So basically I have to quit, until I got another EAD card through the new application, correct ?

Yes, you are no longer authorized to work. Next time why don't you put up your list of evidence on here so people can look over it for you. Best of luck.

Stevie b ,you are absolutely right. This is why I felt so bad quitting my job this morning for a technicality that could have been avoided by not oversighting the RFE. Now that I read the instructions it's pretty straightforward. In my defense and this will serve me as a lesson,

When I filled the RFE I was dealing with family problems back in France and I had a new banking job that I had to get ready for so I

End up being too cocky thinking that I could do it 'quickly'. I didn't think that RFE was one miss or hit things ! hence you can't mess it up !

Moral of the story, when you and your wife are too busy, DO NOT do it assuming they (uscis) would resend you a RFE if you make a mistake.

From now on, when I don't have time to do something right and read all the fine prints well I simply won't do it and pay a lawyer to do it for me !

I am gonna post on here further advancements in my case.

Thanks you everybody for the help and the constructive criticism.

It's the first time in my life I use a forum and I didn't know if people would actually care, well you do so thank you !

"Working without authorization" is not being made an issue of to spouses of US citizens at the AoS stage or at any point thereafter. There's no need to quit your current job; in fact it would be stupid.

Here's my thoughts to you: ask questions before jumping the gun, not afterward.

The OP has already made one mistake with his AoS, it's tremendously bad advice to have him compound it by working without authorisation too.

why does the government suck when you forgot to include something that was required in your package?
