Hi All,

I am a Natural born U.S. citizen who married a Vincentian with whom I have a daughter. Prior to meeting me, he was in the country illegally for 6 years. We decided that I would sponsor him, so that he can be here legally and better provide for his family. We filed the necessary paperwork through a retired immigration officer. His appointment date was set, however, it was not to be in the U.S. but in Barbados. He flew there, only to be told that he's missing a form (waiver form I-601) and was sent to his native home. We submitted the form with the explanation that I would go through hardship if it is decided that he will not be allowed to return to the U.S. Three months later i received a letter from immigration saying that we haven't proved extreme hardship but only normal hardship, and that I have until Feb. 3rd, 2013 to submit proof. Their idea of extreme hardship is a medical condition (me or my child), loss of employment, needing gov't assistance etc. None of whiich I am experiencing. naturally there is stress but they view that as normal under the cicumstances. Anyone with advice? Time is ticking, and we want to be a family again. Thank you all for any advice or services you can offer.

Hire a lawyer who specializes in waivers. A waiver is not DIY territory.

When your husband was in the US before, did he enter with inspection? I am confused why your helper person sent you on a path to interview abroad.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Waivers are not something average people undertake as they are complicated to get approved. There is another website that helps people called immigrate2us.net, you should go there and look up waivers.

This will not be over quickly. You will not enjoy this.

I'm confused, you say Vencentian, Barbados and Nigeria. Why did he interview in Barbados?

How did he enter the US?

Why would your retired immigration officer send you on this path?

This is NOT a do-it-yourself case, you have a denied waiver, you need a lawyer and quickly if you want to meet the Feb. 2013 deadline

I guess St Vincent citizens has no US Embassy so its citizens are routed to Barbados , just like those from Cayman is routed to Jamaica for interviews.

Most times immigration officers are clueless about the underline procedures, and most believe because they were immigration they know, not so. You

have to get an expert waiver lawyer to take this case to , Register at immigrate2US and , you will find competent attys there. You cannot prove just

regular hardship you have to show evidences. since he left financial problems like bills piling up, letters from creditors, argue that you cant move to his

country because of crimes, your daughters well-being. education,u not been able to work there, the medical system is not like the US and U have

strong ties in your community and country. prove Y U will suffer if he dont return, all this has to be proven. U need an atty ASAP

To prove extreme hardship is not about to proof a medical condition but to prove you will experience hardship living in a different place .You have to demonstrate the differences between his country and Usa.Explain to get a job in his country will be impossible cause you dont speak their language or that you degree is not recognized in his country.If you have bills or loans to pay show them if you have to leave you will be unable to pay these bills in the Usa.If you have kids show the difference between education in the Usa and his Country.If you have elderly parents tell them how hard will be apart of them and it will be almost impossible to keep visiting them in the Usa due financial situation, if they are sick get a letter from the doctor stating their ilness.Compare the criminality in your city and his city.Proof your ties with your community,church and friends.Tell them about your siblings,nieces and nephew and that you would like that your kids grow up with your relatives around like you grew up.

Thanks everyone for your input. The lawyer that I chose is dragging his feet and I'll go to the website recommended. As for the questions asked: St Vincent doesn't have an embassy so their natives go to Barbados for their interviews. Prior to marrying me, he was here illegally for about 6 years. I am currently getting letters written by teachers, psychologist and family members to explain how my children have been affected and also how I have been affected. Someone recommended Jacoby and Meyers...I will look into them as well. Again, thanks.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

all of those letters won't even be a blip on the radar screen....third party opinions about your 'extreme hardships' are meaningless (anyone can write a letter saying anything...but words on paper are only proof of one thing...somebody sat down at a word processor)...those children who are not his and yours have zero effect on the outcome...and spurious marriages to circumvent our immigration laws are as transparent as glass.

OP I wish U luck ignore the prejudice posters who is negative towards certain ppl here,

now personally I would not use that law-firm I would try with the atty at IM2US I wish
