Hi all. I know that they do a combo card now for the Employment Authorization and Advance Parole, but if I have no intention of working after I move to the US, does it take less time to process just the AP? I heard that biometrics are required for Employment Authorization but not necessarily Advance Parole. I am trying to get home in time for my nephew's Confirmation and if this would make it quicker, then I would not apply for both.

Aos:

10-01-12. Sent AOS, AP and EAD

10-09-12- Recieved NOA's for forms

10-24-12- Successfully walked in for biometrics (originally scheduled for 11-08-12)

11-26-12- Made info pass appointment for emergency advance parole. Denied, but agent called service center to request an expedite.

11-28-12- Agent at Infopass called me to let me know service center approved my request.

12-01-12- Advance parole received in the mail (2 page version, not combo card)

It is processed when it is processed (sorry that is the best I can do). We never received any updates about the AP and only the EAD. The combo card arrived for us in 46 days, but that was last year when things were moving at a more normal pace. I would expect the AP and/or EAD in about 90 days and I do not think not filing for the EAD would have any effect.

But wouldn't not needing the EAD biometrics make it go quicker? I know in the past when it was two seperate documents people would get their AP alot sooner then their EAD. I don't want to apply for EAD and make the process drag on, if I am not intending to work and there is a chance that it could be quicker. Has anyone here recently only applied for AP? What was your timeline like?

OP: I would just file the AP alone if that is what you wish to do, but it most likely will take the same amount of time. If you want to get a drivers license, you might want to file for the EAD anyway because a lot states allow you to get the DL with the EAD. You can always make an infopass appointment after you apply for AP and ask for an expedite. The worst they can say is no.

I will not be filing until October 1st, (I am getting married Sept. 29th and the 1st is the first day I can get my marriage certificate certified) and I would hope to be at my nephews Confirmation which is Dec. 9th.

That's a tight schedule, not impossible but tight.

If you want to be sure to have it by Dec 9th, another option is to get married civilly as soon as possible, and then file for AOS/AP...

Not true. Maybe a long LONG time ago but I applied for both back when they were separate in 2010. they were approved at the same time.

no it takes the same amount of time. 60-90 days. You can apply for emergency AP but without a good reason (and I'm sorry but I doubt a confirmation is a "good reason") it won't be approved.

Doubt you'll get it by then. I suggest you get to the US asap to get married and file AOS asap OR wait until AFTER the confirmation to use the K1.

It is not possible to do it any earlier. We were one of those 'bad' people who planned the wedding before we got approved for the visa. Everything is bought and paid for. And we are devout Catholics who cannot imagine getting married 'civilly' before our actual wedding. I guess I will just hope for a speedy advance parole and try not to disappoint my nephew or try for emergency parole and hope I have a sympathetic ear at the local office.

Some people go to an infopass appointment to see if they can get the advanced parole on the spot that way but usually it consists of an emergency, not a confirmation. If you want to stick to your plan, I'd advise you to get EAD as well - it's useful for other things than just getting a job. I personally preferred dragging state ID/US driver's license with married name around rather than copy of passport and marriage certificate.

If none of them have been approved by December, schedule an infopass appointment.

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

It takes the same amount of time. If I was you I'll send both at the same time for a 'just in case' scenario.

When AP and EAD were separate documents, I received them at the same time. I assume that AP takes what it takes regardless of EAD. Anyway, if you have no intention to work, the best you can do is to apply for AP only and hope that you get it before December 9th. I agree that it is a little tight, but what else can you do? If i am you, i would apply for EAD & AP even you don't plan to work, i have a lot of friends that they just wait their GC to be approved so they can work and travel but the matter of fact is you never know what is gonna happen in the future? so some of my friends they been waiting for a long time months to get their GC and hesitate to apply for EAD & AP and now something's happen and they under pressure...

EAD & AP it takes 3Months before you have it, just like mine... i have "COMBO" Card, better to have both than saying sorry. just being honest to myself that's all but it is up to you... Good luck
