in 2010 my fiance came to us as k1 . she received her conditional green card on jan 2011.feb 2012 i found out she is cheating on me and told her about it. on march 2012 she filed order protection and divorce and put me in jail 4 times last week we went to court and got dismissed . i gave the judge all pictures and evidence. anyway i won the case . now she is still on conditional green card . i want to deport her what should i do ?

well, alas, there's no direct route for that.

the most you can do (emphasis on most) is to ask that a casefile be opened with ICE for a VISA fraud case.

Set up an infopass at yer local USCIS office, then once you are there, ask for the ICE Shift Supervisor. Be prepared beforehand, bring as MUCH EVIDENCE as you have or can generate. Then ya wait.

IF the ICE person there thinks the evidence has weight to it, a casefile will be opened. This casefile will be cross referenced to her A File. When/if she files for removal of conditions, then the fraud casefile will be examined.

That's about the most you can do, alas. IMO, she's using a VAWA playbook that her mentor has given to her.

Sorry you have been through so much, hearing these kinds of stories always makes me sad :(

The best thing you can do and the best revenge (which it seems you want) is get on with your life.

You cannot get her deported! Sorry.

You can forward all your evidence to ICE and they may follow it up, but you will not know (as far as I am aware) the result of the investigation.

I know you are heartbroken. It is really tough. It seems a lot of people change when they come here, especially from countries that don't have the freedom that we do. Even though you feel betrayed, your spouse cheating on you does not constitute immigration fraud, unless you believe she tricked you into coming here to be with that person she is cheating with. If you don't think you can/or don't want to resolve things, just let her go... I know it is so hard to forgive a cheating spouse and it takes a very special person to be able to do that, but people do make mistakes... it does not make them fraudsters. The only way she could be deported is if you had evidence of immigration fraud, which IMO, this is not... seems like someone got caught up with their new found freedom...

Nothing you can do with regard to immigration status. She has a green card. The relationship is over. Divorce and move on.

You can not deport her, that is the job of USCIS to place her in removal proceedings -- all you can do is report her to ICE and USCIC if you feel she married you for the immigration benefit. They will make notes in her A-file. You can withdraw the I-864, which will cause her I-485 to be denied when she decides to file for ROC. This will cause her to be eligible for removal -- but even then, ICE will not drive to her residence to pick her up for deportation.

She doesn't need to be married to you to remove conditions on her green card.

That is incorrect. The I-864 cannot be withdrawn.
