Timeline

Co didn't gave look at any evidence of photos .. Asked 2-3 questions and gave a white slip stating that visa is denied without any specific answers

As white letter they gave says petition will be send to USCIS ..

Is there anything we can do at present

I don't know what you would do at this stage but I wanted to tell you how sorry I am. :( Hopefully, someone will come along soon and give you some good advice of what can be done. I hope it works out for you.

No co didn't said anything. I asked her and she said it's being sent to USCIS n the white letter has info

The letter says insufficient proof or other legal reasons. Hello she didn't asked for any proof didn't saw any photos . I had tons of documents with me which I had carried with me

She has me following question

When did u meet ur wife

Where

How many times did you had sex with her

Why did you married her

And kept on typing .. She didn't asked or even saw any proof

And handed me white paper and said your visa is denied .. Have a good day

What the hell is this ???

What other legal reason. Never married both in past... No criminal history .. Never been denied visa to us or over stayed as I never applied before this

So what other reason

Wow, that's crazy. If I remember correctly, you put a lot of evidence with your initial petition, which USCIS obviously thought was enough?!

They asked you how many times you've had sex with your wife???? :o That is such an inappropriate question. Seems like you got interviewed by a very unprofessional person.

Have you gone through the proof you initially sent, to make sure you didn't miss something? How many times have you and your wife physically met?

We.met for anniversary

She came before we even became couple and we.met the.

After a year of her first visit we got married

Co just didn't wanted to see anything at all. I had carried all evidence .. Tons of it.. She just didn't wanted to see

We both are devastated .. Everyone back home is sad

Well we had more proof than needed if co wanted. She walked to window with me.. Co said her to get back to waiting

What proof they want.. Phone bills, joint finances, photos, tickets what else .. More than 1000 pages of proof and different and multiple kinds of proof we had ..

Wow, I'm so sorry. I guess maybe if it was the proof there was an issue with, they would have interviewed your wife too, right there on the spot, since she was with you?! I really hope someone can come with some good advice soon. It must be heartbreaking for the both of you. :(

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

My husbands case was denied in 2011 and we didn't get another interview until now, I went through so much I totally understand how you feel. We were separated and asked maybe 50 to 60 questions it was horrible, and they did not deny us the same day, our case was put under AP for a year then it was denied. They sent all the paperwork back to uscis and then the reviewed for another year and a half, try to get a lawyer that can send them letters and speedy the process

There was a case that was recently denied a K1 visa. The petitioner took immediate action with her congressman and was granted a second interview. They were just approved last friday. I'm not saying that you can be successful but if I were I would contact your congressman asap. She also had family and friends send email attesting to their relationship. I don't know if this will work for you, but it can't hurt. You have to act fast before your case leaves the embassy.

Contact your senator / congressman immediately and request a second interview and clarification on the exact reason they refused the visa.
You seem to have plenty of relationship evidence with the items you mentioned and you front loaded right ?

If granted a second interview bring all the evidence again, especially all co mingled evidence.

Why did the USC petitioner not inquire what the problem is and insist on speaking with the CO and /or section chief ? She was there with you.

That was a wasted chance right there.

If they don't grant the second interview then upon return to USCIS the petitioner will receive a NOID/NOIR letter listing the reason(s) and you then have

a chance for a rebutal. If USCIS is satisfied with your rebutal they will send it again to the embassy with recommendation to approve.
Bad news is that they are backlogged and it may take over a year + to get the NOID/NOIR letter.

NVC Received : some dinkelsberry yehoo in the house of clingons send our petition to the wrong consulate.

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Date : Oct 22, 2014

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

US Entry : Nov. 21, 2014

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Email &text : May 18, 2015, check cashed May 19,2015, return receipt May 21, 2015 stamped USCIS Lockbox, NOA1 (3x) May 22,2015

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

There was a case that was recently denied a K1 visa. The petitioner took immediate action with her congressman and was granted a second interview. They were just approved last friday. I'm not saying that you can be successful but if I were I would contact your congressman asap. She also had family and friends send email attesting to their relationship. She was able to get another interview and was aporoved? Good for them, I missed that....I felt bad when they were denied.

Same thing just happened to me... Here is what I did from advice from here and my fiancé just got approved 2 weeks ago.

1st thing. call your senator or congressmans office in the USC petitioners district. ask to speak with the immigration liason. tell them what happened and see if they will help.

2ndly send an email immediately to the embassy asking if they will provide you the reason for denial and ask if you can provide more proof and get a second interview with the petitioner present

3rdly have friends and family email of proof of relationship and your intent to marry.

YOU NEED TO ACT FAST!!! try very hard to understand the reason so you will be able to over come it. good luck! sounds like they don't believe your in a real relationship. inbox me what you sent in but first do the items above.

I was asked about sex at my most recent fiancé interview not uncommon..
