The problem may have been interviewing in India where such age gaps I am told by Indian friends are very unusual.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

A fiance visa would expire and that's the end. With a spousal visa OP will get a second chance, so no, a fiance visa would definitely not be easier

but harder.

I still think a fiance visa in this case would have been the way to go. And here are the points in favor:

1. A relationship with such age gap looks like an unknown territory for both individuals, if they applied for fiance visa it tells IO that they have dipped their toe to test waters ( got engaged) and now taking the next logical step in this case to further relationship to a live-in relation and the move to USA ( which is another unknown), not a lot of people can immigrate happily to USA as opposed to general thinking of people. Some people do run back home.

2. For the IO it doesn't looks like much risk to grant fiance visa as if later they cannot prove the marriage is bonafide it is upto the AOS IO to decide to send the beneficiary packing. and doesn't hurt track record of IO who grants a fiance visa ( yes they care about track records. I know people who work at the American Embassy in Delhi. And they give green cards to every indian who retires after working with them. Recently met a person who was just a security guard at American Embassy and got the green card after retirement. So it is in their interest to keep their job till retirement).

Well now they have married and got denied once, so this option is out. I hope he gets an American national IO next time and can answer their questions with proofs more confidently. I know a person who married in pakistan and brought the wife here, there was indeed 22 years age gap which is uncommon but still exists in arranged marriages there. They had theirs arranged too, and didn't have issues in obtaining visa. I don't exaclty know if it was fiance visa or spouse visa.

To add some more info to this, I'd like to ask if he was interviewed by an Indian or an American. If Indian, then that's one more thing that added to the problem. And it might help to take the interview in Kathmandu, Nepal and they will be more sympathetic towards the couple.

Earlier in the thread it was stated IO was an Asian woman....possibly the Dragon Lady lol

Age gap when K1 was applied for can look more like a scam in my opinion because the parties haven't made a full marriage commitment.

Well water under the bridge now.

I hope the steps the OP has taken post interview work in their benefit!

2. Huh? desi staff automatically entitled to GCs? Laughable.

Consular interviewers are St Dept employees, doing their job and unconcerned about track records and such. OP was interviewed by an Asian American officer.

For the record to those reading who think a fiance visa is more likely approved than a spousal visa, NO it is not.

A fiance visa is not a get-to-know-you-let's see how it goes with the age gap visa but a couple that has intent to marry.

A CO is not more likely to grant a fiance visa than a spousal visa and the thought process is not as outlined by an above post.

Again, a returned K1 in this instant would have been expired and a spousal visa will have a reaffirmation chance.

For point 1, I have personal knowledge of some people moving back home, or other countries. You are allowed to have your opinion and I am entitled to mine, but that's not how I would comment on your post, even if you might be Desi.

And for 2. My family members worked for the American Embassy all their life, and that's how my uncle and their family immigrated to the US, after which they decided to move back home. Just because you don't have personal knowledge of everything that goes around in the world, doesn't make it Laughable. Sorry for being harsh, but what goes around comes around.

I do not have knowledge of a Fiance visa with Age gap got approved, and like everyone, i was just trying to understand and curious as to what could have been done in this case. Anyways nothing can be done about a fiance visa, A reconsideration of Spouse visa is the only way. I hope OP doesn't face the Dragon Lady this time. It is my firm belief that Communication skills help a lot for an Interview, and a lawyer can help if the Beneficiary needs more communication skills handy at the time of interview.

I had a question about that sex interview question.

What is typically a good answer?

I know aside from being as honest as possible....and if you don't remember or know how many times, you just don't.

But do you think a high number is a good or bad thing?

Is a low number a good or bad thing?

I am asking this is if you are interviewing for a spousal visa.

Whats typically the truth in any question is the truth no matter how uncomfortable it is. I don't think they give a flip of quantity. It's about are you genuine or not. A fake coupe getting married for green card are in it for the money or whatever perks. They ain't screwin. And trust me CO's can sniff it out. You can say not that much we are staying at his mothers house. If you fake you would exhibit mannerisms nervousness beyond just the question being asked.

It's not about quantify or quality or how long you did it. It's about how well you know each other. Many times they just ask questions just to get a rise out of you like:

"why would you an African marry a white woman"?

"Why would you marry someone old enough to be your mother"?
