    it doesn't matter, work is work and he will be compensated. He can volunteer but that is with no compensation, not even gifts
     
    and the work permit can take even more time, there are people that have been waiting up to 5 or 6 months for the work permit, that's the downside
     
    so if he isn't ready to or can't handle not working for a very long time, the k1 isn't for you

    yes, most of the people have already gotten their GC
     
    very few, Mexicans and Philippines and some grandfathered under the 245i law
     
    I got my GC under the 245i law in 2005, and became a USC in 2010

    you will fill out the i1864 as the sponsor, he will file an i864 as your joint sponsor and his wife the i864A as his household member

    he doesn't qualify for the i864A, he can file the i864 but you can't combine income. if he is married he can combine income with his wife
     
    in that case he would file the i864 and his wife the i864A
     
    if he's single then he will use the i864
     
    if you filed for both parents he would need to file 2 i864 if he has enough income. or he may be able to be a joint sponsor for one of your parents since each petition is separate and you can find another joint sponsor for your other parent

    you don't mention how you qualify under the 245i law
     
    were you a beneficiary of a petition before April 30th 2001?
     
    did you send a copy of i130 of the original petition before 2001?
    did you send the i485 as well?

    nope, that's the wrong form, that's for removal of conditions once you are a GC holder
     
    you need the i130, i130A, the i485, i864, i693 medical and vaccinations
     
    plus the i765 work permit and i131 travel permit

    yes, the petitioner has to be at the interview
     
    there aren't many questions, to make sure you qualify under the 245i law and that the affidavit of support is from the petitioner is enough  I suppose you paid the $1000 fine to adjust status in the US?
     
    I adjusted under the 245i law, my US Citizen mom filed for me in 1999, I had the interview in 2005 and became a USC in 2010

    lawyer is a thief, so don't pay a dime. does she have to go to the interview or can you just go? when you sent the i130, what proof of bona fide marriage did you send?
     
    you have to take to the interview all evidence and proof of bona fide marriage, they will ask questions about your marriage
