Well, it certainly wasn't because she thought the property ownership laws in the US were much more fair than the property ownership laws in Vietnam. In fact, she doesn't know a damn thing about the property ownership laws in the US, and she really doesn't care. She's not a crusader of any sort. She came to the US to marry me and live with me. We both chose the US over Vietnam because I have a successful career here and could provide for both of us comfortably, but we were both willing to stay in Vietnam if that's how it would have worked out at the consulate. We discussed all of the possible options before we started down this road.
That doesn't mean it was a slam dunk decision. She gave up a lot to come here. She had to sell her home because none of her family wanted to leave the village and live in Hue City, and she was afraid the government would seize her house if nobody lived there. She had to sell it well below market value because of the f'ing red book. That was a bitter pill to swallow because she worked her butt off for 10 years to get that house. She also gave up her career as a school teacher, and now she's looking at the daunting task of going back to school for years to get a teaching certificate so she can teach in the US. By the time she does that she'll be in her 50's. In the meantime, she's watching her granddaughter grow up on a webcam, and she's relying on her brother (who isn't the sharpest tool in the shed) to take care of her 70+ year old mother. There were and still are a lot of sacrifices. As unbelievable as this might be to you, many people are actually happy living in Vietnam, and many aren't strongly attracted by the lure of a better standard of living in the US if it means giving up the things in life that make them happy. Maybe you're not old enough to understand this yet.

Please help me to understand which TOS is involved when a member repeatedly creates new aliases to attack someone without them knowing it was a specific VJ member..
Every time I think I understand the correct TOS violation I see its penalty as a Ban, but each time the member does it and is caught , they remain here...
Which # or #'s is it? 18, 11, 1?

Don't make the mistake of looking at this from a Western perspective. Some people will do and say anything they can to get to the US; that's a fact I am well acquainted with. It's my opinion that she's one of them, based on what you have written.

The Embassy in HaNoi plays no role in it.. its only dealt with at the consulate in HCMC. The list of relatives is only mentioned by the CO when they see some red flags and they want to make sure everything is legit.... it is not all that common... you can see how many times in the past couple of years they have been requested from VJ members in the appointment results topic. There seems to be an uptick in filers stressing over this item when it it not likely they will get asked for it unless there are red flags present... most commonly related to being introduced by a relative or friend..

If they don't intend to be living in the USA its kind of silly to renew/apply for a new green card, its not a visitor pass to the USA. The green card is for LIVING in the USA.
The green card status becomes abandoned after not living in the USA for a year. I'm pretty sure their GC status was canceled before the card expired.
If they want to visit they should apply for a visitor visa.
If they want to live in the USA they will have to be sponsored and start all over again with the paperwork and fees and wait till approvals etc.

My guess is it might be a little different in Russia. But in Vietnam, you must have the appointment letter in order to have the Medical.

Took my FIL to one of those high end hospitals a few weeks ago and they had a boat load of women getting work done... I may get some spots of skin cancer cut out when we go back in a few weeks... one thing they can say about that particular hospital in Hanoi is that they dont play around.. its all business and everyone is always on task.... ran like a smooth machine...
On the TV deal.. we use a laptop to access VN programming via the net and then I have a USB connection that sends a wireless signal to my TV via the HDMI... sound and video o the TV.. if she wants to change the channel its just a mouse click.. and its free... sometimes there are lag issues... but not often...

according to the visa reciprocity tables for Vietnam, 6 mos. for a k-1. however, dependent on the age of the medical (if more than six mos. old at time of visa issuance), it could be shorter...

this was a straight up bad interview and her responses to the questions or lack of preperation has made it an uphill climb for you two.... you have a great deal to address... you need to find out exactly what her responses were to the questions that were asked... then you will better know how to address them in your rebut... the fact that you just filed a k1 a couple of years ago has a great impact on this one to start with.. but couple that with her not being prepared made it worse.. not much that can be done at this point other than to start getting your ducks in a row and prepare for it taking at least another year.... go through that list of items they had issue with and explain each one so that USCIS will understand...

IMO dont include it.. the only thing that it shows the CO is that she is relying on you financially... read through some of the VN regional discussions as this has been a topic of a few but from the interview standpoint when one is expected to show proof of ongoing... at the initial petition there is no requirement to show proof of ongoing only that you have met in person in the past two years...

IMO, the only way to overcome this is to postpone your filing (if you've not filed already), and make time for a few more trips back so you guys can develope more of the relationship and build on your evidents...otherwise, you will face some tough times ahead..good lucks!!

It's not up to the process to somehow 'check' the relationship. It's up to the couple to make sure they spend enough time together prior to filing to be as sure as they can that the relationship will succeed.
I happen to know the K1 'works' as that's how countless of successful VJ relationships started - mine included.
