Is there any way at all for Mare to get a job when she gets back to the US with me? Is there any legal way she can do like freelance or something or small jobs babysitting anything like that but legally?

Is there any way that she can get some sort of temporary work permit while she is waiting for the AOS and/or EAD?

EAD is the work permit that is used before the green card.

You can apply for the EAD before AOS but its around 400$ and expires the same time as the I-94.

Before you would even have the green card. So not really worth it.

Yes she can babysit for cash.

She can walk neighbors dogs for cash or mow lawns.

She can also volunteer to get something to put on a resume.

She cant get a job that pays salary without SSN and EAD/GC.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Well actually the EAD is included in the AOS fees for K1 holder. The thing with those is they are cash jobs so they can be done under the table, but i dont know if its really legal. I mean for babysitting you either have to know someone with a baby or advertise, and if you are advertising you are no longer under the table.

+1 working to earn money is still working and can be considered a violation... no work can be done prior to EAD (legally)... volunteering is ok.

He said legally... that's not legal. Any income must be reported to the IRS regardless of cash or not

I POEd in August, got married in September, filed AOS/EAP/AP in October and received my EAD in December... Really it's not that long and it'll give her time to get used to her neighborhood and what not.

And she can also start looking for work before receiving her EAD to see what the job market is like and work on her resume. I wish I would have done that sooner!

She can do volunteer work but nothing that gets any kind of pay or compensation. Not sure if non-paid internship work would be ok, but I suspect not.

Most people don't think about this ahead of time, but part of the decision whether one is able to do the K-1 is whether one has the means to support their fiancee/wife while she's waiting for the work permit.

"Working in the US

The United States welcomes thousands of foreign workers in multiple occupations or employment categories every year. These include artists, researchers, cultural exchange participants, information technology specialists, religious workers, investors, scientists, athletes, nurses, agricultural workers and others. All foreign workers must obtain permission to work legally in the United States. Each employment category for admission has different requirements, conditions and authorized periods of stay. It is important that you adhere to the terms of your application or petition for admission and visa. Any violation can result in removal or denial of re-entry into the United States.

Temporary (Nonimmigrant) Worker

A temporary worker is an individual seeking to enter the United States temporarily for a specific purpose. Nonimmigrants enter the United States for a temporary period of time, and once in the United States, are restricted to the activity or reason for which their nonimmigrant visa was issued. "

If you accept payment for work in the US before obtaining permission then you violate the terms of your visa. Even if it's cash for babysitting. Is that worth the risk?

Can your fiance can do freelance work/work remotely for a company back home if that is an option. (I know of people doing this, however, I have not checked the legality of this)

Good luck.

K1 is not a good option if you need to work immediately. Volunteering is a good option to fill time, gain experience and make connections for when GC or EAD does arrive.

In the past they have had issue with nonpaid internships because they lead to or are tied to employment. cant say its consistently applied in the case of unpaid internships though..

No i'm talking about applying for EAD after entry doing that IS NOT included in the AOS. You are paying BEFORE AOS to get an earlier EAD. Not many people do this because it is 400$ extra and expires MUCH sooner than it would had you applied for free with AOS.

You said it yourself... "under the table"... that term right there is synonymous with illegal

I am a speech therapist and I also teach English on the side before I moved here. I had a client who pre-paid me for 10 sessions before I left for the US. I wasn't able to complete them before I left so I completed them here in the US via Skype. I got my EAD last week so if my clients want to continue the online ESL classes I can do it legally now :) I am certified as a speech therapist in the Philippines, but not here in the US, which is why I am going to graduate school this fall. But my ESL certificate is from a US company (online course). It's a great way to make money but I charge very little since most of my clients are students from China that I met when I lived there. It's so much fun and I recommend it to all native English speakers :)

Create a family business, she does the labor you do the invoicing on your ss#. Sell something, she can buy the inventory, market it online and you can have it pay into your pay pal.
