    How is he going to adjust? He does not have status to adjust from. It sounds like he entered on a non immigrant visa and has been out of status for many many years. DACA is not a status. He could adjust through marriage to a USC as he was inspected and overstays are forgiven.

    After seeing people mess up online filing I have a general preference for paper especially as you are going to have send some of it in anyway. Others may disagree. Her current EAD is tied to her HP expiry, and it is free so apply for the adjustment one.

    You file an I 130 for your Husband and the child would be included as a dependent. Now F2a is backed up so it could be a long wait. If you are close to Naturalisation then you also need to file an I 130 for the child as spouses of USC's for some reason do not include dependents and that will be much quicker.

    The Consulate has the discretion to issue a non immigrant visa, they may choose not to.

    There has been some talk of the K1 speeding up, but 6 months? It has been many years since I have seen one that fast. There is a thread here about January filers getting approved now and that is just the first stage. Plus of course a K1 can be returned to die and you have wasted all that time.

    What have you been reading and where? This will not be a quick case. Either way. K1 seems foolhardy in the circumstances. A Passport is not needed at this stage. Middle East and North Africa.

    She can certainly try, it appears her ban is up. The maximum ban would be 10 years. Well assuming there is nothing else in her record. You have listed quite a few reasons they would say no and no obvious reason they would say yes.

    Trying to think which Dutch religion would have an issue. Anyway it would need to be from verifiable religious sources. And yes it will take time and money.
