  3. I have not advised anything. If you enter on a F2 you will have F2 status. If you want to have E2 status you need to enter on an E2 visa.

  19. Well the Petitioner pulls the case. It would not be denied, you would need to attend an interview for that, but yes it will die. No impact on you VWP, not an ESTA question. I suppose it is theoretically possible you might be asked about it at a PoW.
