  1. As an observation if you have been refused getting approved a second etc time is much harder.
  2. A second interview would have strongly suggested to me the need for a Lawyer. You make it sound like you do not have one, well not one that attended the interview with you.
  3. EB 1 is an Immigrant Visa variant, it just denoted how you got an Immigrant Visa as opposed to Marriage, DV etc. OP entered on an Immigrant Visa. The rest to me is a mystery.

  17. Has anything been filed? You both live in Canada nad most people would not go the K1 route. Either way you would interview at the Consulate and need a medical, if you do not complete the requirements then for a K1 you could enter and then go the Civil Surgeon in the US route, get an I 693 and file a waiver whilst seeking to adjust. If you go the marriage route then you file the waiver after the interview in Canada.
