Are you talking about re-validation of a K visa if someone leaves the US without AP?

Yes, it has happened, but rarely.  I’ve seen it once or twice on this board, but I can’t remember which Embassy it involved.

Also, it must have happened on “90 Day Fiancée” when Murcel returned to Turkey and then reentered the U.S.

IRS Filing can verify that you are currently single, but will not be helpful in proving that you have never been married.  CFO is over-stepping once again.

You’re right.  However, the CFO really doesn’t want to know whether you’ve ever been married.  They want to know if you’re currently married, and a tax return doesn’t prove that either.

Years ago, there was a CFO employee that kept asking for proof that you weren’t married. It seems that there is another one now.  Back then, submitting your tax return solved the problem.

If the petitioner is a Pinoy who became a U.S. citizen, or is someone who has a Pinoy-sounding name, the CFO might be looking for a CENOMAR.

The CFO would be unnecessary if the U.S. Embassy simply handed out what-to-do-in-case-of-abuse flyers to each visa applicant.

I was reiterating that no one should rely on this.

And stating that in the overall "CRI-1 vs K-1" argument, CR-1 remains the best option due to the long processing times for AP.

Why should a K1’er not rely on it?  Over the years, there have been several K1’ers on this board who have successfully relied on it.  I’ve never seen one who was refused reentry into the U.S.

Anyway, I’m glad that you finally acknowledge that the process exists.

Right.  But, leaving without it is not a good option, and the wait times for AP currently are much, much greater than they used to be.

Where did I say that a K1’er leaving the U.S. without advance parole is a good option?

  5. 12 minutes ago, Jorgedig said:

And neither option should be a realistic part of anyone's plan in the event of an emergency.

In the event of an emergency, advance parole is a very good option.  It allows the K1’er to attend to the emergency without jeopardizing their K1 process.

I stand by what I said.

K-1 arrivals who have a pending AOS case and who leave the US without AP are presumed to have abandoned their case.  This is a well-known drawback to the K-1 vs a CR-1, as CR-1 holders receive GCs immediately and do not need AP.

Anyone who would rely on the possibility of being granted an info pass to ask for emergency in the era of COVID is naive if they expect it to be 'easy.'  And knowing this, IF there is a possibility of needing to travel back home emergently before having AP, a K visa is not the best choice.

Advance parole is available for K1’ers regardless of whether they have married or not.  It’s not an uncommon procedure.  You can read about it on the USCIS website.

Also, visa re-validation is possible in cases where K1’ers leave the U.S. without advance parole, but that’s a risky strategy.

  8. You can accomplish both the Report of Marriage and the passport renewal at the same time.  Just schedule yourself for one of their consular outreach events.

The Philippines Consulate in New York has several outreach events in your general area.  Yes, you may have to make it a day trip with some driving, but you can get everything done quickly at the outreach event.

My wife, Chinook, and I went to our local consular outreach here in Seattle.  In about one hour, Chinook reported our marriage, applied for Filipino citizenship, and applied for a new Filipino passport.  It was really easy.

If you don’t go the consular outreach route, then I would recommend reporting your marriage first.

I was seeing this post reactivated after 7 years and thought WTH? But, I enjoyed the posts and wondering also, how many are still together.

We have been married since March of this year. We were lucking in getting her Visa expedited and getting out during one the lulls in the lockdowns.

Here's to everyone and good luck to all.

Getting your fiancée here during COVID is a success story.  Thanks for your post AlaMike.

  10. Sorry for this off-topic post, but it’s important:

Guys, you will save yourself a lot of trouble if you do this one thing: hire a driving instructor.

We had threads about this in the past, and the overwhelming opinion was to hire a driving instructor.

I wish I had done so!

Do you think those are rather easy to get? I assume you go to a USCIS office and request it there?

Yes, you go to the USCIS office.  I’ve never heard of anyone turned down when they had a legitimate reason.

It's fun reading all these old stories from long ago. Thanks for reviving this thread :)

I'm only a few months married but have known my husband for some years now. The pandemic did a number on all our plans but it all worked out in the end. We were just talking last night about how this is the happiest period in our lives so far.

U're welcome.   May this thread be an inspiration for those who are still on the process.  It's good that it's turning out well for you.  Yes, the pandemic prevented us from traveling and all the other plans but also allows us to appreciate life more each day.  Enjoy your marriage, when u love each other, time sure goes so fast.
