    Oh yeah....  so sick. Well no USA for me unfortunately. But its been a rough ride..traumatized finding out everything was all lies. Now divorce, the a**hole wont file for divorce ..letting me pay for that too

    Thank you,  I have learned that the internet is his playground and i wouldn't wish upon anyone to experience what i have, so if he could be "flagged" at USCIS that would be the best tbh. 
    I was clever enough to bring the marriage certificate with me home. So i will divorce him from Denmark.
    Im just very confused right now sorry.

    I visit my husband on esta without problems, i have return ticket. Been asked a few questions, but no problems at all !!
     
    You are completely fine staying your 90 days on esta or the full length of visa !!

    Dont worry !!!  Im Danish married to US citizen since 20th September 2022 and just been in Michigan for 3 weeks and now back in DK.
    They pulled me aside and asked me some questions,  I didn't have to show anything.

    File online. Not only is it easier, but after your case gets approved, the NVC creates case numbers for online-filed I-130 faster than it does for paper-filed I-130s.
    No need to mail anything; just scan the 2"x2" photos and upload them online.

    I really don't understand what is the point of stating "However, anyone who enters the US as a visitor with the intent to adjust status is committing fraud." So? Everybody knows that, whoever comes here with or without intent. That's a fact!
     
    It is USCIS job to evaluate that intent. Not you, not me, not the lawyers. That's why the 90 days rule is on the FAM. And that's why they are trained to read between lines.  
     
    Each case is a universe of infinite possibilities. 
     
    We can scream here and say this and that. That will not change the facts: AOS from visitor visas is common thing and USCIS/DHS doesn't hate it. It is only a few group of senior VJ members who automatically associate it with fraud/hate/legal problems. 
     
    And I would like to offer my apologies if anybody find my post harsh, rude or similar. But this is like a group of republicans and democrats arguing about points like: guns, abortion, etc. Some people may reach the limit. I'm one of them.

    Not sure if they hate or not... I guess it's their job to check stuff like that... and if they hate their job, well, sorry - they've chosen wrong jobs... But anyway, I know a couple who got married after the foreign woman came to the US a a student, and she really was a student for couple years... She met an American guy, that happens, it's life... They fell in love and got married by the time her student visa was about to expire... Filed for AOS, approved with no problems at all.... so it's not necessary fraud when folks get AOS from different types of visa rather than Fiancée visa or smth like that... Or you say people have to stop falling in live here in US just because they entered it with a different purpose?)))) Again, I understand that there're might be different situations.... but I feel like people demonize tourist visas and AOS... everyone's situation is unique ... and if you're a fraud, they  will find it out during interview... those guys are experienced enough... Just tell the truth.. I don't think there's anything wrong to apply for AOS from tourist visa if you're real legitimate couple. Moreover another couple of my friends are in the process of AOS from tourist visa... no problems so far.. the case accepted and pending... so will see ... I guess i'll tell later how it all ended up for them.. but I'm 100% sure they will be approved

    I’m gonna add my 2 cents here since this is a topic that generates a lot of heat.
     
    I did my AOS from a B2 visa with a pending consular processing (DQ waiting for interview). The B1/B2 was renewed while waiting for consular processing
     
    Most of the people here are right. Adjusting from tourist visa has a lot of risk but it doesn’t make it automatically “fraud”
     
    My wife got her GC through EB2 (AOS from B2 visa also) back in August 2018 and immediately we requested consular processing in Mexico (I-824 to NVC). Travelled back & forward to the US between 2018 and 2020. My tourist visa expired in July 2020 and I was able to renew it in March 2021. No question asked about my consular processing.

    Came to the US and asked my lawyers about any alternative to the consular processing. They immediately suggested the AOS. I was reluctant but then they showed me all their cases and results (it is a pretty fancy law firm in South Florida) It is something more common that I thought, but you need some kind  of backstory, like mine (married before my wife applied for her GC, years of waiting, USCiS - NVC delays, months of separation, etc)
     
    I submitted my AOS in September 2021 and got my GC in January 2022.
     
    So yes, it is doable but with risks involved.

    she was allowed at POE. They let her in. She overstayed people do it all the time!!! My friend overstayed 10 years! It did not come up at the interview you n ow why? Because overstaying a visitor visa and getting married is not grounds for denial!!
    they won’t even ask her how she is supporting herself.
     
    now is she using you for a greencard? That is a completely different story! 
     
    if you love her just fill out the paperwork - all will work out!

    Omfg you are fine!!  I did both - overstayed and worked unauthorized and guess what? Nothing. came up at the interview bc it is a non issue!! They didn’t even ask me about my overstay or unauthorized (illegal?) work. 
     
    Regardless if she had bo intention to leave it does not matter!!! If you want more info Dm me!!
     
    she 100% has an easy case - not a messy case! File the paperwork and all is well!

From what can read its not illegal to seek AOS while there (i will have a return ticket) because its not filed directly after marriage. But i am confused about it ... because i also read the oppisite like you wrote.  I will try and see if i can find it again and post.
