OldUser reacted to Chancy in Just got married.....confused on what to do next
Does your husband intend to remain in the US and not return to the UK until he gets a green card?  Or is he planning to return to the UK first to settle his personal stuff there before moving to the US permanently?

If you both intend for him to remain in the US until getting a GC, there's no significant benefit to filing the I-130 separately from the rest of the Adjustment of Status forms.  Just file the I-130 and I-485 concurrently by mail, along with the required supporting documents, as well as the (optional but recommended) I-765 and I-131 forms.  As mentioned above, filing the I-130 by itself would not allow your husband to legally stay in the US.

If your husband wants to return to the UK soon, then there's no need to file the I-130 immediately.  Better to submit the I-130 the day after he leaves the US, to reduce the risk that USCIS will get confused about whether your husband is applying for a GC or a spouse visa.

An I-130, alone, confers no immigration rights or right to remain in the US.

Oh I know! It’s maddening!! I know that the VAWA unit is trained to sniff out fraud.. I just pray that they enforce it enough to deter people, without valid cases to not apply! Some lawyers should really be reprimanded for giving out false information! Cheating =bad marriage, not abuse! If that’s the only thing going on!

You are right! On TIKTOK all i see is lawyers stating that even if you spouse cheated you can get vawa without any abuse .  They are sending applications without any evidence and thats how vawa gets us wait 3 years.

We don't know the whole story, but if you are asking someone to get married so that you can overstay it sounds like the marriage is not bonafide. Have your husband ever applied for marriage based greencard for you if yes what poof he submitted for bonafide marriage and on what grounds he is asking for annulment.  Then you say you family gave you suggestion about VAWA apparently which wasn’t smart.  This all sound like its all for Greencard.  If you cant prove your marriage a bonafide one your case is dead. Moreover If judge grant the annulment, you don't even have a ground for VAWA. So only if you tell the whole story people will be able to help you.

A tourist visa has completely different requirements and criteria.
neither has anything to do with the officer conducting an interview.

I had quite a few tourists visa interviews and all required documentation - letter from the company I worked for, salary, number of vacation days, financial statements, proof of ownership (I provided car, home)… i uploaded everything ahead of time and brought the originals to the interview. I had my planned vacation agenda as well.

every time before the interview started I was asked if I preferred the interview in English or my native language. In case assistance is needed, they have native speakers working and assisting the officer. Assistance was always offered.

I witnessed a few instances where a brother got approved and sister wasn’t even though they provided the same documents, travelled together too. Tourist visa is issued on individual circumstances and documents provided. There are also countries that made that process more difficult because of visa abuse.

    you are grasping at straws.
your MIL should not be helping your wife with the baby. That’s considered working.

Because for B visas, the evidence is ENTIRELY contained within the DS-160.   That’s it.   It is designed to be a free-standing application form, and COs are NOT obligated to look at anything brought to the interview.

I can’t see them getting an extension- there is absolutely zero justification for them to.

It was an unfortunate move, because now they have an overstay, and it won’t be forgiven since they’re not immediate relatives of USCs.   The B visa will be revoked.

Has their authorized period of stay in the US expired?   Yes?  Then they’re out of status.

It is really not smart to do this.

    This is a bad idea.
Are they still in valid status? When did they enter the US? Why can't they leave on time? If extension is denied, they may lose their visa and even get 3 or 10 year bar for visiting the US

    0. Did you submit I-131 with your AzoS packet? If you didn't, I highly suggest filing it with a copy of I-485 receipt. It's free.
    1. How did you find your civil surgeon? Was it on USCIS website?
    2. Who says the vaccines expired? Civil surgeon? Did they skip some vaccines during your exam? This may explain RFE for I-693. Maybe try to get the list of vaccines from them. If they sound sketch, you may want to redo entire medical with a more credible surgeon from USCIS website. Understandably, it's a lot of money, but you may lose your status, AOS filing fees and few years of your life if USCIS isn't happy about the current medical.

@Timona international visitors are estimated to bring USA 279 billion dollars by 2027.

    https://www.commerce.gov/news/fact-sheets/2022/06/fact-sheet-2022-national-travel-and-tourism-strategy

In 2022, it's estimated that foreign visitors brought $135.2 billions into US economy.

These numbers are comparable to some countries' GDPs.

You shouldn't file AR-11 before you move. Only after you move and within 10 days.

I received my card on the day of move (which was fun). Nothing worked: USPS Hold Mail, USPS Mail Forwarding, talking to mail man... So expect it at the old address.
