I-601 A for ULP/unlawful presence indicate EWI ( entry without inspection) in 99% of the cases. The rare exception is crew member IR , not likely here. The reality of most I-601 A applicants is that they have used/existed with some form of ‘chueco” SSN ( tax returns, paystubs) that are routinely disclosed/submitted for waiver approvals. This has NOT been an issue w USCIS or Consulates , your friend is ok.

The congressional Liason will reach out to USCIS and get a written response and action from USCIS. ‘Write up a simple affidavit ( scanned signature of both of you) stating Withdrawal of Petition is USCIS Service Error. Neither petitioner nor beneficiary requested such , relationship is rock solid and we both intend to marry within 90 of beneficiary entry into US/

The RFE wording is boilerplate and does not walk you through the specific deficiency of your submission. The good news is that you have pinpointed the issue and can do a simple correction with your wealthy joint sponsor. 1. Do an I-864 for the joint sponsor ( I-864 A was wrong , it’s only for specific relatives that live w you). 2. It’s ok for them to have 2022 and proof of extension for 2023 ( three years of taxes is NOT required , just current year or most recent and proper extension). 3. Assets you listed are perfectly fine. -

Filing the N-336 is not complicated. Yes it does require a fee ( can even be done with fee waiver, for low income applicants) and is the most effective action, given OPs particular facts. …and no, it won’t take long or longer than starting all over.

You can DIY the N-336 if resources are an issue. Human errors and misinterpretation /reinterpretation /incorrect standards is par for the course ….so don’t take it heart. Fight to win 😂. You outlined your facts clearly in your post and all you need do via the N-336 is lodge the challenge . Complaining to supervisors, aka Service Motions ( without fee) were discontinued years ago, so don’t waste your response time window.

File the N-336 . You will win. Denial is a Service Error as nothing in the statute prohibits filing for naturalization while physically outside ( like for example a rentry permit ) For naturalization , temporary travel does not invalidate one’s established domicile/residence and you clearly meet all the residence and physical presence test.

I am all for extreme vetting 😂…heck some here even suggest the USC should pre vett ( what like send the future mother in law to take a crack ?) As for fixes, surely ANY measures would be better than the existent practice of doing nothing, saying nothing for years. As a nation of immigrants and a country where we value our right to be heard in a court of law, to say American citizens have no fundamental liberty interest in building a life with their spouse or their life partner in the United States is a staggering over-reach by the government. The USC citizen in Munoz case happens to be an attorney herself and this is likely the only reason she managed to take her fight all the way to the Supremes, most do not have the resources or stamina to fight the legal battle. The facts in her husband’s case are not the Ohh OMG a gang banger was trying to sneak in. Fellow had been living in the US , no rap sheet , he then married and dutifully tried the “ legal “ way . ..2010 to 2015 they did the I-130 consular process and he went merrily on his way in 2015 to attend interview… where he listened to the sounds of crickets for 3 years. Tattoos are an immense risk for anyone doing consular process…God forbid your ink is a Madonna , praying hands ..popular with Latinos. The amici nailed it on workload ( 30 interviews per hour is insane) lack of adequate training/supervisory review ( less than 10% of the required minimum and rubber stamping initial denial anyway) ..plus the inevitable bias and bad faith of your CO. A few years ago , two Iranian sisters ( each with husband and kids) went to Ankara for their F-4 immigrant visa interview. Both sisters (principals) and their children get approved and come to the US. Both husbands get put in AP…radio silence for over 2 years. ‘Finally , after congressman gets through, consulate says ‘National Security ‘ both husbands denied …and NOTHING they can do I am still scratching my head…why let the immediate family of suspected terrorists in… ‘

Yes, you can do this on your own…and help your son. I definitely say teach the boy to fish …rather than spoon feed him. ‘He needs a USCIS account on his own …and needs to understand his steps. ‘For example, once he files the free I-90 to correct error ( delay is ok , just say he did not know) …he should immediately apply for N-400 US citizenship, if he can learn civics test. Even you, no matter the separation, can go for N-400….What is holding you back ?

Boots on the ground report from your favorite True Blue Dem 😂. I attended graduation ceremonies at UCSD ..no pro hamas protester disruption . During the Dean’s speech , about 5 girls chanted free Palestine a few times, though barely audible. He paused briefly, acknowledged the right to peaceful protest , then went about his presentation. The next speaker was Al Gore , hurray for climate change…yup , I like the man ..but he is not a captivating public speaker . The 5 girls protesting got up and walked out ..a few of us in the family/friends section..called out Bye Bye!! and applauded their departure. They were gone and forgotten in seconds I really really wanted to shout BYE FELICIA 😂… -

Everyone responding is assuming IR/ immediate relatives is constrained to the usual USCIS definition….not applicable in this case. You should try submitting the application for them and so you will have a chance to email back and forth w support https://www.uscis.gov/ukraine The Ukrainian citizen (or their non-Ukrainian immediate family member) who is outside the United States and who may be considered for parole under Uniting for Ukraine.
