    Your marriage certificate will be a legal name change document.  You can use your new name on all the Adjustment of status forms .

    Another month another round of AOS submissions. Please be aware that this checklist is NOT all inclusive and you must consult the USCIS website to crosscheck this checklist against/with. The AOS process has been confusing since the pandemic hit, not to mention the added politics. So please I want to stress that you only use this check sheet as a starting point and guide if you will. The USCIS site will be the final guide. Please ensure that you check your forms for the correct versions and editions because if you use the wrong forms USCIS will reject your application and send it back to you. This is easily checked on the USCIS website prior to downloading your forms. You should also ONLY download your forms from the USCIS website.  The current and correct fees can also be ascertained from the USCIS website   
     
     
    AOS Checklist
    Cover Letter listing Table of Contents (Check Payable to U.S. Department of Homeland Security - $1,225.00)   
    Form I-485 (completed and signed by non-US Citizen/beneficiary)
    Form G-1145   Copy of beneficiary's Passport with biographical page  Copy of beneficiary's K1 Visa from Passport and entry stamp  Copy of NOA2 Approval letter (from K1 process)  I-94  Copy of beneficiary's Birth Certificate  translation of birth certificate (if needed) Certified copy of Marriage License  Passport Photos (2) name written on the back  Copy of DS-3025     
    Form I-864 (completed and signed by USC) (goes with form I-485)
    Proof of USC's citizenship (copy of birth certificate, copy of passport bio page, or other) 2020 (current tax year), 2019 (optional), and 2018 (optional) Tax Return (with W-2) or Transcripts (transcripts are better if you can get them) Employment Verification letter (updated one - not the one used during K1 process)  Pay stubs (last 3 months)     
    Form I-765 (completed and signed by non-US Citizen/beneficiary)

The I-765 instructions explains all the codes in detail. If you are filing under a different code (other than (c)(9) the fee for your AOS will not be correct and USCIS will reject your entire packet.  
    Form I-131 (completed and signed by non-US Citizen/beneficiary)
    Copy of beneficiary's Passport with biographical page  Copy of beneficiary's K1 Visa from Passport and entry stamp  I-94  Passport Photos (2) name written on the back  Copy of NOA2 (from K1 process      
    Be sure to double check for the current fees as fees do sometimes increase and they can change on a dime so please check. Additionally, check the forms as listed above i.e., current version and or edition date, there have been many changes to various forms. Consider sending tax transcripts instead of the 1040, and W2's. Also consider preparing a cover letter for each form in addition to the main cover letter. 
    Make sure you send long form birth certificates and not the short form.  Hope this helps in your preparation of your AOS. When in doubt ask questions.
     
    Please consider filing the I-131 and the I-765 even if you don't think you'll need them right now. You never know what changes your life will have on down the road, so I recommend you file these two forms from the start. There is no extra charge to file them with your AOS and it's better to submit them all at once.  There has been much confusion coming out of USCIS, partly due to Covid-19 and partly self-inflicted. This confusion filters on down to the people filing for AOS. The above listing is subject to change at a moment’s notice so please check, recheck and check again BEFORE you send off your packet for any last-minute changes.

    Isn't Spain in the Schengen area?  If so, you'd have to quarantine for 14 days in a non-banned country before coming.
     
    Correct, you cannot work (even remotely) in the United States, without a work permit.
     
    The biggest hurdle would be to demonstrate to the CBP that you will return to Spain and not "suddenly" decide to try and adjust to avoid the wait, which is what seems to happen a lot lately.  Because you have immigrant intent, it is not legal to do that.

    If you were denied entry for that reason, it would not impact the K-1, as immigrant intent is implied with that visa.
     
    A letter from your employer and any rental contracts would be helpful to bring along.  Good luck!

    Hey guys,
     
    This is very exciting!! We just received an email from the NVC that our case is in transit to the embassy in Madrid. This is the first movement we've seen since getting our NOA2 back in June. 
     
    Has anyone else seen movement on their cases from Madrid? Any actual k1 issued?
     
    I'm still in awe but very happy!!! (Btw we are not plaintiffs of the lawsuit.)

    I'm not a K1 case but I really hope they start to process K1 cases soon. The priority should be to reunite fiances now especially considering it has been suspended for such a length of time. If it's safe enough for flights to continue, with social distancing, regular testing and isolation periods it should be facilitated!

    NO. FRAUDULENT VOTES by the evil LEFT have to be recounted. The democrats, with the help of all the media, US postal service, etc. are trying to steal this election! The ballot-counting can not be stopped the night of any election, which is what happens here. Our GREAT President was LEADING! Around 4am 'lost' ballots in the THOUSANDS showed up at polling stations. All 100% for Biden??? BS. Watch the news (Not the Fake news, but conservative outlets for facts) Once all the VALID REAL VOTES are counted, that will decide the real outcome.
     
    Trump is against ILLEGAL IMMIGRATION! Everyone on here are working on entering the US LEGALLY! There's a difference! An example of other countries who criticize President Donald J. Trump:
     
    Trinidad and Tobago. Being a US Citizen, by their IMMIGRATION LAWS, I had to leave after 90 days, then return anytime thereafter. I traveled back and forth like this for the time I spent with my new family. Almost three years. (That's very costly, but my family was worth it!) I returned from a trip and because I did not have a printed return ticket OUT of T&T, they wanted me to leave! When it was confirmed I had a return ticket from the airlines, it was only then they let me re-enter! And they still criticized MY PRESIDENT for doing the same!
    (Keep in mind, Obama was the US Prez when this happened. When Trump was elected, they criticized him when he said US will be deporting criminals back to their home countries. These were illegals, committing atrocious crimes like raping and killing.)
     
    That's ALL countries but like the DemoNcrats, the rules don't apply to them. Criminals running from the police in T&T were found in the US. #######? They got a Visa to enter MY COUNTRY but I get when they think I don't even have a return ticket and want to turn me away. 
     
    I migrated my wife and stepdaughter who arrived in August, 2018. My wife WORKS!!! (part time) She doesn't have to. She WANTS to. Our daughter had a PT job, herself during the Christmas Season. (before the scamdemic) She WANTS to work! 
     
    I've gone on a rant here, but made it as short as possible, with details I hope people will understand. I'm not against anyone entering the US legally and with nothing but good intentions. Same as our President. People coming in expecting 'free' gov assistance, welfare, live off the US tax paying citizens, and any criminal intent, KEEP THAT IN YOUR OWN COUNTRY! America is FULL! No room for you!
     
    **Coming legally IS a long process. Plenty of fees, making it somewhat costly. At times, it will seem as though the process wants you to just throw in the towel and give up. It gets frustrating sometimes. We went through it too! I told my wife, I AM NOT GIVING UP! I'LL GIVE THEM THE DOCUMENTS THEY REQUEST. (They repeatedly asked for some of the same ones we had already submitted. Fine. I kept everything filed and organized and sent what they wanted.) Now that my family is here, I know it was worth all the frustration we went through!
     
    TRUMP WILL BE RE-ELECTED! FOUR MORE YEARS! That's a GOOD thing. The democrats represent a Socialist mind-set. America will NEVER be a Socialist country! It will remain the GREATEST COUNTRY EVER! Trump is keeping our country safe for the US Citizens and safe for the LEGAL Immigrants, from the criminals trying to enter illegally.

    I just received an email from the NVC today saying that my case was sent to the Tokyo embassy. And the status on the CEAC site is now "in transit." Do you have a copy of the P3 for the Tokyo Japan embassy, Greenbaum? And the next steps would be getting the documents listed in the P3, filling out the DS 160, and scheduling the interview once the case status changes to ready?

    Approved on September 9th. We have already the NVC case number but it still says "at NVC". Should I complete the DS-160 while then, or wait until getting the nvc email or ready status? Also, would you have a p3 copy for Madrid Embassy? Thank you so much!!!

    Just wanted to let you all know about our happy ending; sorry it took me a bit to get this post done.  We first applied for a K1 December of 2017.  The interview was August of 2018, denied.  We applied again for a K1 January of 2019.  (Yes, it is typically recommended to marry and apply for a CR1 after a K1 denial, but we felt our case was a lot stronger and took a chance.)  We did get an RFE October of 2019 for intent to marry as well as essentially to refute the reasons for the previous denial.  We were successful in getting the petition approved and the interview was 1/28/20.  He was told the visa was approved at the interview, but that the old case still appeared active, so they had to take care of that.  (I had already received notification that it was terminated.)  It went to AP and on 2/26/20 changed to non-immigrant received.  I'm not sure how much COVID slowed things down from there, but it went to AP 4/1, Received 5/21, AP 6/22.  On 6/25 he received a call asking if he could travel before the medical expired on 7/13, and he said that he could.  On 7/6 he got another call saying that they did not have his passport in his file but would look for it.  From this point on we got persistent with our inquiries.  On 7/27 he got another call, followed by an official email, asking him to make a new passport and get a new medical.  The status changed to refused  7/28.  The embassy received the passport and medical on 8/13.  Status changed to AP on 8/19, updated again 8/20, and the visa was issued 8/26/20.  He arrived in the US on 9/6 and we married 9/26.  Thanks to God!  Now we're trying to get AOS done.

    I just called and got my case and invoice numbers. There was no wait and the agent told me they entered it on Oct 13. She told me I would get an email when my case ships, but due to pandemic and Frankfurt embassy being closed they don't know when. My noa2 was sept 24. I'm happy to be at this stage😁

    The Embassy in Seoul, Korea is also scheduling interviews now for K1, ours is Nov. 23rd!  Hoping more Embassies are opening soon.  Good luck to everyone!

    Usually where your petition is sent to is based on the beneficiary's current residence (as of when you submitted the form), not which consulate you picked. I've said before that I don't know why they even bother to ask.

    You generally can not interview somewhere unless you have valid residency there. So if it goes to Germany you would need to have documentation that you are a resident there for Germany to process you. I suggest you contact your congressman for assistance with this. There are various posts on VJ about how to do such. They can inquire for you and get confirmation its being sent to the correct place. Ideally you want to do everything you can to ensure its sent to the correct place. If its not it will cause additional delays for them to get it transferred.
