    Okay so my husband and I don’t have any joint accounts, bills or land together yet. I decided to take the advice of a lawyer on YouTube, and just simply tell our story of who we are so that USCIS will know, without a doubt, that our union is sincere. Well Here is the evidence that I submitted, and our petition was approved.
     
    1.) My cover letter explaining our love story
    2.)about 60 photos, of us throughout our relationship 
    3.)) two affidavit letters, one from his best man(in Ghana)  one from my maid of honor.
    4.) itineraries for flights and hotels 
    5.) Wedding invitations
    6.) Receipts from deposits made on our future wedding
    7.) love letters and emails we sent to each other
    8.) receipts of money my husband has sent to me.
    9.) copies of civil documents 
     
    THATS IT… We never questioned if our evidence was enough because, honestly,   you really don’t have to go over board when your relationship is solid.

    Sooo from what I’ve gathered, doing research, yu shouldn’t over share when filing.The lawyers say it makes you look guilty. Answer the questions that they ask yu.  Write a convincing cover letter that tells a great love story between yu and your fiance’. Keep the focus on your relationship. Include photos of yu, your fiancé’ and your child as a fun loving family.

    Thanks. So I did add my income in my wife's I-864 form, under the section:
    That's why I thought we would be fine regarding the financial income. 
    From the I-864 instructions:
     
    My income will indeed continue when we move to the US. So do I just need to provide some employment letter/contract from my current employer showing that my income will continue whilst in the US? (Conveniently my job offer letter explicitly talks about my salary once I move to the US!)

    So USCIS approved the petition initially (they are verifying that the petition and beneficiary appear to be eligible for the immigration benefit).  The consulate eventually denied the visa.  The petition was returned to, and reviewed by USCIS (something a K1 isn't eligible for).  The petitioner wasn't able to address the issues in the NOIR and have the petition sent back to the consulate.  There doesn't appear to be anything that USCIS err in but that doesn't stop an appeal from taking place.  It doesn't sound like the petitioner wants to live in Pakistan and build up a better case and refile. Regardless, it will cost more money and time - which the petitioner should use to strengthen her case by spending more time with her husband.

    I used lots of Photos, wedding invitations, receipts to wedding deposits, itineraries, boarding passes, copies of love letters, affidavit statements from supportive family members.
     
    And ours was accepted.

    It is not fraud to enter on a tourist visa and then get married, if you then leave back to your home country to go through the CR1 visa process.
    What would be fraud is entering on a tourist visa with the intention to get married and then staying in the US to adjust status.

    I think the red flag he was referring to was "Change Of Status" of someone getting married on a tourist visa.
     
    If they can prove you entered on a tourist visa with the intention of marrying a US citizen then they will try and charge you with fraud.

    I respectfully disagree with this almost completely. There is no guidance or instructions from USCIS/CBP/DHS on how you meet, how you interact, or how long you know each other, or where you are getting married. Almost everyone meets online nowadays. The only requirement is that you have 'consummated the marriage' i.e. that you have been together during or shortly after the wedding. Everything else on what is a 'normal' way to get married is based on cultural perceptions, anecdotal stories, and personal preference and 'experience from being on this forum' which is highly non-representative sampling of immigration cases. Many people that go through the CR1 visa process have never lived together, figured out chores, meals etc. It is very speculative that USCIS would consider this a red flag.
    OP is in the best position to decide if they want to take their time and when they are ready to tie the knot. Remember, the slower you go the longer it will take until you will be actually living together.
    In my case (and this is also anecdotal but I'm just mentioning this as an example), we did not supply any information on how we met or how long we had been dating. The fact that we got married in a proper wedding ceremony was sufficient. What was more important was what you do after you get married, that you spend time together, that you interact as a genuinely married couple.

    Hi,
    My wife just got her CR-1 and we have been through the process in the last two years.
    We got married on 2/2/2020 outside the US, in The Netherlands. We never lived together in the US or anywhere else. After the wedding we were in the same situation as so many: she had to fly back to Russia and me to the US.
    We filed the I-130 on 2/28/2020.
    Since we never lived together we didn't have any joint accounts, no house rental lease or mortgage together, no assets together, no kids together.
    All we had was basically our marriage certificate.
    We did submit pictures of the wedding (which was just six people) and receipts for the rings, and some airplane tickets of trips we had done together before we got married. But I actually doubt this carried much weight. The I-130 got approved in May 2021 without any RFE.
    In the meantime we had been on trips outside the US together a number of times and I had diligently collected all airplane tickets / boarding passes, made copies of stamps in our passports. We also filed taxes as 'married' for 2020. (I didn't bother sending copies of chats or emails or get affidavits from family members because they are very hard to be verified for authenticity and are known to carry very little weight for USCIS/DoS)
    During my wife's interview they didn't ask for any of this 'proof of relationship'. The only thing coming close was the question: "when did you last see your husband?" (which was just a few hours ago since I was there waiting outside the embassy). And that was it. Approved.
    Of course they may have looked at some information that was submitted electronically or that is available to them through some other systems.
    But my impression is that they are well aware that many people that are going through the CR-1 visa process do not have the opportunity to show many documents (it may be different for IR-1 or people who adjust status within the US and that lived together before filing).
    I think that if you are not from a high-risk country and are willing to sign the I-864 affidavit of support and don't have any major red flags, and you have your basic documents in order, that you are already 99% there.

    My husband and I met have been long distance living in different countries for our entire relationship. We applied for CR1 (still awaiting final interview) but our i130 was approved in under three months.
     
    We didn’t have a lot of relationship proof from the list above. No joint accounts, no property lease together etc. Yet we managed to submit a strong package of relationship proof. 
     
    1. We had proof of each of us adding the other as beneficiaries to our life insurance
    2. We had proof of adding each other as our emergency contacts
    3. We had affidavits from 3 family members and 2 friends vouching the authenticity of our relationship.
    4. We had 100s of pages of relationship proof, right from matching on OKCupid (96% match), to our first dates, in memorable travels across the world together, family visits and occasions together, wedding etc.
     
    You will be fine with this info. USCIS understands it is difficult for people living in different country to comingle their finances.

    Don't stress so much, if you have a genuine relationship then you'll be fine with the items you can provide from that list plus others items like, photos of you together , receipts of events things you have done together, plane tickets, you can also provide signed affidavits from people who know the both of you attesting to their knowledge of your relationship, (you can find guides online with examples for these).  I imagine Australia is not a high visa fraud location (someone else can confirm) so as longs as you provide everything you can it should be fine.

    I don’t think yu have anything to worry about if it says your petition was approved. The same document that yu see online, are the same documents they will send yu. I think at this point, USCIS has done their work which is probably why it says CLOSED.

    How can your fiancé’ be the stepfather if you’re not married? That does sound like misrepresentation, or atleast where the disconnect is.

    Why do you think it was approved ? The status says being reviewed. It got to that stage quickly because it’s an expedite request … you’ll need a status update that actually says approved to confirm if/when it is approved.

    I shouldn't need a reason to refuse the government's meddling with my personal and private data.
     
    If they think they have a good reason to suspect me in any way, which they shouldn't, they can get a warrant. At least that's how it should be done, and I understand that at the border there might be different laws and authorities given, so that's why I am here asking.

    I travel internationally all the time and have access to sensitive or restricted information at "work".  I have several work visas for countries of concern.  I use a separate "clean" phone and laptop to travel outside Mexico, Canada and Caribbean and even then nothing sensitive travels with me.   Anything sensitive or restricted I can access using 2 factor authentication over a VPN.
     
    Everything physical is subject to search anywhere anytime.
