    We spent a week arguing with a visa journey member last week on this issue. In the end, the member flew to JFK, and after time in secondary inspection was admitted as a returning resident.

    Seems like a good case for traveling as returning residents, especially since their child is a U.S. citizen.
     
    Logically, giving them an NTA is a waste of time because they would be able to file I-485 in that event.
     
    Pakistani citizens require a visa for UAE. So Qatar is the better option: book a round trip to Doha, enter Qatar, book a flight to JFK. 
     
     

     
    I get beaten up here all the time for not buying into the VJ conventional wisdom that
     
    * it is OK for new LPRs to spend more time outside the U.S. to wrap things up
     
    * and so a re-entry permit is not needed
     
    They got caught by covid and then medical issues. So a re-entry permit was needed as it turned out. At the very least, applying for one would have made a stronger case that they did not intend to abandon status. 
     
    LPR status is for living in the U.S., period.
     
    Please list the risks.

    In my understanding they won’t know people are gay unless you do super PDA (public displays of affection). But even heterosexual couples can’t do a lot of PDA because of Asian culture - so any PDA for any kind of couple, gay or not gay is still unacceptable. 
     
    The reason that I mention this is because I don’t want our country to be generalized as a homophobic country. Of course there are homophobic people anywhere.
     
    I really hope you will get the tourist visa, but if you cant get it, like I said…your bf can come to indonesia safely and won’t be stoned.

    IMO you need to tweak the email slightly and said “I would like you to go ahead and file motion to terminate or reopen or whatever directly to the court before end of the month” ( something like that). 
    u notice that’s not a question. U pay ur
    lawyer to be ur counsel and that’s what u want to do
     
    in the mean time, shop for different lawyers

    There is only one path as outlined. A great deal of what your attorney emailed is pure bs . ..but “sounds “reasonable 
    You can resolve things with your attorney ( without conflict) by showing them you now understand the process AND insist filing the motion ( terminate/recalender) w court is the next immediate step you want them to take. If they agree , you are all set
    Ask for a copy of the motion .

    I called 70 lawyers in 2 months so I can fire my unmotivated lawyer at that time. Almost pulled the trigger to hire a new lawyer but in the meantime once a week I keep sending email to my current lawyer. He can’t stand it after 8-9 months ghosting me finally he gave up because of my persistent and filed termination to the court.
     
    always have ur eggs in many basket. @Family know I even wrote motion to terminate in 4 versions just in case everything didn’t go through

    No matter where she files , it will do nothing for your case. Once you understand it cannot be filed or feed in w court while admin closed…then you also understand juggling USCIS initial acceptance rill only result in no jurisdiction hold..
     
    Just do yourself a favor and talk to a few other attorneys AND insist ALL you want NOW is to file motion with the court .. Your attorney is doing a song and dance …and lacks hands on volume expertise. @Verrou has experience getting her own reluctant attorney to do it, hopefully she also chimes in

    DHS aka USCIS notoriously did this to some people (including me). They “supposed” to update automatically on SAVE check system ( that’s what government agency used to check ur status )  but from time to time, they didn’t do it.  I know it stupid since they can see u have the GC.
     
    But i never need to show my GC to supermarket ( for what ????) and also doctor office ? ( for Whatt ???)  the only time I showed my GC were for DMV and SSA office 
     
    Have u get ur unrestricted SSN card from SSA office ? If not, go to that office, and tell them you are GC holder now and want unrestricted SSN card. You will be put on on hold misery for couple of weeks until ur SAVE check update

    DMV also can do it for u. Usually they will request it manually to DHS. 

    don’t bother to call USCIS. They won’t do anything for u.

    Save check is the ONLY way. There’s no manual override unfortunately. I was in agony for 2 months because of that. I tried congressperson, I tried to contact USCIS, I even tried ombudsman. I tried everything. For once, I can’t win and just have to wait for the save check to be complete. 
     
    now my thought theres probably something else going on here since OP already got unrestricted SS therefore theres no issue with the save check. OP need to be proactive and ask question in this case to DMV

    Nope. It’s DHS not doing their job. They are the only one who can update the SAVE check so other agency can see the change of status. Plastic GC won’t work if the SAVE status not updated
