The CPB officer can give you the 6 months (which is the max amount you can get on the B2) but not always. Or, for example, if you say to them you're visiting for 2 weeks, some might only give you those two weeks on the I-94.

breadlover408 reacted to Chancy in Some other Qs about B2 tourist visa
It's 6 months by default, but I've seen reports here on VJ of some being given much less than 6 months, like 1 month or 2 weeks, regardless of the date on the return ticket.

In my case, I was always given 6 months, even if all my return trips were scheduled for 3 months or sooner.  Same for my mom.

Just asking as before I was in the US we never really travelled to this side of the world, so wasn’t sure about procedures etc but good to know incase family or friends want to visit in the future.
Yes of course. We have never overstayed anywhere ever from all the years we have travelled to different countries.

    1. The I-94 dictates how long she can legally stay in the US during her visit.
    2.  There is no sponsorship for B2 visas.  She will have to apply on her own merits.  She should be prepared to show strong ties to her country.  Your full support does not help her case.  Your I-134s could also harm her case.
    Good luck.

breadlover408 reacted to Dashinka in Some other Qs about B2 tourist visa
If CBP only authorizes her for a 4 week visit, then that is all.  If CBP authorizes a 6 month visit, she can stay for that period.  Therefore in your scenario, if she is given authorization for more than 4 weeks at the time of entry, she is free to stay longer and there is no need to notify anyone.
Focus on her paying for the trip herself, don't muck it up with I134s or invitation letters, etc.

    Good Luck!

Always easier to keep it simple especially with aged parents

She can stay for an extra amount of time, but only if the date on her I-94 allows her too. It's important she check's the "admitted until" date on that so she doesnt overstay and lose her visa.

CBP will be looking for a round trip ticket so if she stays longer (within the dates allowed at POE) just pay the hundreds extra for the change in the return ticket

I would not worry about it.  My wife traveled like this for four years and had no issues and was never asked for the marriage certificate.  I do remember that when re-entering the US, she presented both her GC and her Russian passport, so if the system tracking exits and entries was working properly, it should be fine.  We never checked, and when she went through naturalization, I assume they reviewed her entire international travel history then and there were no issues.

    Hi everyone!!
So my i-485 has finally been approved today!
I'm really happy because last night I prayed for any answer as my aunt was ill and I just prayed I wanted to go back home to see her asap and my family too.

My Employment Authorization and Advanced Parole strangely has not been approved. It was sent together with the i-485.
Will this come after or together?

breadlover408 reacted to Dashinka in Name on green card Vs passport name
They will only put your married name on your GC if that is the name you used on the I485.  USCIS does not automatically assume a name change due to marriage as many people do not change their names.

That being said, if you did fill out your I485 with your married name, and the GC arrives with that name, you will be fine.  If using your passport for traveling (international travel) you need to buy the tickets in the name on your passport, but if it is domestic travel and you have a real ID DL/state ID you can use that name.  If returning to the US, you will use your GC as is, and keep a copy of the marriage certificate with you in case CBP questions the name difference.  My wife traveled like this for several years until she naturalized, and no one ever asked to see our marriage certificate.

Lastly, when possible and if it is not too much of a hassle, change your name on your passport.  We did not do this as changing the name on a Russian passport is a real pain.

    Good Luck!

Yes. The green card will allow you to travel internationally and work. The EAD and AP were designed to allow you to travel and work while waiting for the green card. However, in our cases, they were never received. So, because of receiving the green card, the EAD and AP should move to a status of "case closed benefit received by other means"

    Thanks so much -
So apparently they called me up and said they can't process the W8 (although they tried) because I am eligible for W9 / system says I have to fill out W9 since I have been in the US for X days.

But I explained the situation again...and in the end they just said I don't have to submit it now, but only submit it when I do get my SSN number (to which I reminded them soooooooon), and they said they will just hold back some. credit % of my savings account (which I opened up too). I was like ok cool, that's a better optionn.

Because I originally received a letter stating I will get fined if I don't submit the tax form, so I questioned them about that - and they said "oh the fine is actually from us, not the IRS".

Oh well...I guess that's just that.
But yeah I guess they don't understand too much about K1 and AOS...

p.s. - am not even using funds in this card atm - just hooked it up to my Apple account for $0.99 cloud storage fee/month. That's it...LOL!

    Hi Sir/maam,

text message should be fine, Ideally you should have a notice in the mail. You can call them and ask them about your receipt number and they would be handing it over to you.
NOA1 would be the notice of action in the mail. Recieving texts means that they have your case and working on it.

There is no rule that you must file before day 90 however after day 90 you will become out of status which usually isn't an issue unless you come in contact with immigration enforcement.
Carry your shipping receipt and passport to prove you did file.
USCIS counts the day it was postmarked as the date it was sent.

yup, read around that they prob didn't scan it.

Would advise to anyone filing to get signature and not use USPS 2 day priority service. Please pay extra for a signature.
I will do so for future things.
