  3. Because you’re already counting her in box 1. As a result, you can’t count her twice and put her in 3. Matter of fact, we put 0 in that field where it says currently married.
  4. It says to not count a person twice. So put 1 in box 1 and do not put her in box 3
  5. I’m sorry to hear that. It is unfortunate but there’s no other way besides filing I-130 for your baby. You can try to request an expedite after filing but no guarantees. If you’re able to find a remote job and move to them to wait out the process, that would be great. I wish for you to be reunited with you family as soon as possible.

  7. Yes, new I-130. There are no derivatives for immediate family members of US citizens. As Boiler pointed out in that article, you’re no longer a foreign national but a US citizen.

  10. No. Once I-485 is denied, EADs and APs associated with it are void. You will have to wait for a new EAD when you file the new I-485.
  11. What status are you adjusting from? Is your husband a US citizen? How long have you known each other? Prior marriages from either side? Has the petitioner married and petitioned for someone else before? Have you been petitioned in the past? Any criminal history?

  14. That’s good, you should see the notices in the account soon. USCIS online updates can be very unreliable and also they don’t always reflect reality. My guess would be that they haven’t generated the notice and scanned it to the online account even though they say they sent it already. I would give it a few more days

  17. NOA1 wasn’t generated yet. It’s too early for it to appear on the account It’s not based on your location. USCIS assigns it according to their internal system of workload distribution among the service centers.
  18. Each set has to have its own set of accompanying documents. They all get assigned to different places (I-765 and I-131 go to National benefits center and I-485 to your local field office ).

  24. I would stick with staying in the US and refiling. This has happened before (denied I-485 due to technical stuff) and no issues with refiling if that’s what you’re worried about. She can’t use this EAD anymore as it’s tied to the denied I-485. You have to file all the forms again; include the I-130 approval but I’m not aware that it will expedite the I-485. Switching to Consular processing might muddy the waters.
