  1. If they want original then they want original, not a photocopy. It is not uncommon for consulates to ask for an original divorce decree. You can go to an interview and try a photocopy and see what happens. If they will want to see an original, then they will issue 221(g) and ask you to submit the missing document. This will delay your case. If you’re willing to take that risk, then that is your decision. I believe your fiancé can request certified copy of the divorce decree from the state which is considered original.
  2. Are you waiting for NVC to send you a notice that they received your case and provide a case #? If so, they don’t do that. You’ll have to send a public inquiry to ask. NVC only send a notice via email when your case departs NVC for the consulate.

  5. Starting a December 2023 ROC thread. Please share your progress and your timeline. 11/30: Delivered to Elgin, IL lockbox I’m anticipating a delay in text/check cashing/NOA1 due to a possible backlog after thanksgiving but who knows.
  6. It’s not a problem. If they met in person in the period of two years before filing I-129f and they can adequately demonstrate that, then I don’t see an issue - your mom can file. However, having myself gone through K1, I’d like to recommend spousal visa. It’s a better choice.
  7. Yes Correct I highly recommend filing I-131 Advance Parole as well. Life is unpredictable and it’s always good to have that in your back pocket if an urgent need to travel arises. especially that it’s free.
  8. How old is the child he had with the 22 year old woman?
  9. *** Topic moved from Bringing Family members of US citizens (consular processing) to AOS work/tourist/student visas *** Highly dependent on your local field office (LFO). Check processing time here: https://egov.uscis.gov/processing-times/ pending I-485 grants them authorized stay in the US. You didn’t state that you submitted I-765. This is a form that, if approved, grants an Employment Authorization document (EAD). This, along with I-131 Advance Parole, should have been submitted along I-485 and everything else. They’re free if filed concurrently with I-485. You should file both forms now, attach all required supporting documents and include a copy of I-485 NOA1.
  10. Were you parents married to each other? Are they in a relationship?

  15. Withdraw the existing petition, meet in person and then refile a new I-130 with evidence of meeting. Meeting in person to consummate the marriage is a must/requirement in order to have an I-130 approved. It is not possible to show you met after filing with the hopes that you will be approved with the existing petition you filed.
  16. Three threads on the topic of interview questions merged together. Please do not start multiple threads pertaining to a topic (in this case interview questions) as that’s considered spamming and is against TOS. Post all subsequent questions regarding interview questions in this thread only. VJ Moderation

  22. *** Topic moved from Progress Reports to Process & Procedures *** Agreed - get a new medical done. This is not uncommon for K1s, it happens unfortunately. My recommended strategy with USCIS is always taking the path of least resistance.
  23. *** Topic moved from Progress Reports to Process & Procedures *** Current I would convert that into salary per year. This is what we did, my husband asked HR to take his average weekly earnings (he was paid hourly) and multiply that by 52 (number of weeks in a year). We also added an employment verification letter and pay stubs for last 6 months. No RFEs.
