  1. I’m also planning to upload new unsolicited evidence since submitting the petition in November 2023. Question, did you guys upload each and every file separately or did you group them into categories (so combine all several months worth bank statements into one file, all utility bills into one file, etc.)?

  10. The problem is that there are delays in receiving the NOA1 and it’s taking 4-8 weeks and ICE wants to see her purchasing a flight in the next 2 days and out of the country in 30. Without that NOA, there is no proof of authorized stay while the petition is pending.
  11. You can look at previous visa bulletins to see how much it has moved. It didn’t move from last month and I haven’t looked at the previous ones but they’re all available for you to examine. If it’s not a busy consulate, then maybe it might be slightly less. However, you’re mainly tied to the visa bulletin and it’s not possible to predict how it will continue progressing. But as I said looking at the previous ones might give you an idea.
  12. No, it’s not geographic. USCIS has their own system of dispersing petitions which is not public knowledge.
  13. There is no standard timeframe. Some spend days or weeks in AP, others months. Applicants from Pakistan are often put in extended APs due to poor record keeping in Pakistan and the need to do an extensive background check as a result.
  14. USCIS is not what will determine your wait time. It’s the NVC/dept of state. It’s about a year to approve I-130 petition at USCIS stage. However, by law, visas for spouses of LPRs are capped at a certain number each year which creates a backlog. You have to rely on the Visa bulletin to see if your PD (date of I-130 NOA1) is current and if you can move to the next stage. Right now the visa bulletin is showing the date of 15 Nov 2021 for F2A. Meaning those who have a PD of 15 nov 2021 or earlier are eligible to receive visas. It is not possible to speed this up as these are numerically capped per year with no exceptions. So in total, you’re looking at about 5 years to bring your spouse over. In contrast, USC do not have any limitations for bringing immediate relatives so my advice would be to naturalize if/when you can.
  15. I echo others saying to not put your life on hold. Why give USCIS so much power to control your life like that? We applied for ROC in November 2023. I just applied and forgot about it; I’m fully expecting it to take several years. If they call us for an interview - no problem, if not - that’s great too. In the meantime, we have purchased joint property and are actively working on other family goals together. Don’t let USCIS stop your life like that. You have passed AOS, showed plenty of evidence of bonadife marriage, and are still happily married, why worry about them denying your case when there is no indication there is marriage fraud or anything like that?

  23. I would follow exactly what the RFE letters state. It’s probably fine to mail them together if they need to be mailed to the same address. I would divide them in the packet and clearly label which is which. I would provide two separate set of needed documents for each application. You only get one shot at getting an RFE right so I would provide what each letter is asking for.
