    Rather than getting upset by what anonymous people here say, I would immediately find a competent attorney......although I think the attorney will tell you to reconnect with your husband and file for adjustment of status....

    If anything, living abroad with your spouse would actually strengthen your spousal visa application down the road, as you'd have tons of evidence to show for it. In terms of abandoning the K-1, I don't think it would have a negative impact because given the Covid situation, there would be a legitimate reason to do so.
     
    The lawyers aren't wrong to say it would be a long wait. Everyone is in the same boat right now. CR-1's aren't exactly getting processed speedily either right now.

    Fees go up on October 2nd, so not sure why you want to file on August 2nd. 
     
    And no, you can't file earlier than your eligibility date, they will reject your application and you will have to start over again.

    I have received two speeding tickets over the years. One from 2004 and one from 2014 or maybe 2015. I paid the fine for the first offense and took an online class for the second infraction. 

    “Have you EVER been arrested, cited, or detained by any law enforcement officer (including any immigration official or any official of the U.S. armed forces) for any reason?“
     
    I took the instructions as they were stated and answered “yes”, I was cited on two occasions. I then spent very little time tracking down the court for my first offense and received documentation to prove that I paid the fine. The evidence for both citations was submitted along with my application. 
     
    I didn’t like how the online application opens up a new box for further clarification when you say yes to that question but felt it is there for me to clarify my position and I took the opportunity to do so. I slept well that night. 
     
    It’s up to you what you do. This is the way I interpreted the instructions.

    Wrong--it seems you have misunderstood. 
     
    It does NOT read as you should not document them, it says you do not need to submit documentation for minor tickets as you need to do for major one. Here is the text FYI. 
     
    "NOTE: You must submit documentation of traffic incidents if:
    (1) The incident involved alcohol or drugs;
    Form N-400 Instructions 09/17/19 Page 13 of 18
    (2) The incident led to an arrest; or
    (3) The incident seriously injured another person.
    You do not need to submit documentation for traffic fines or incidents that did not involve an arrest or did not involve drugs or alcohol, if the only penalty was a fine of less than $500 or points on your driving record."

    I agree that it can be interpreted differently, even lawyers think the same (based on my research most lawyers are saying you should mention, but there are a few saying it is not needed, and it also depends on how certain states and IOs handle the case). In this situation, there is a room to defend yourself why you have not mentioned them. 
     
    However, I have seen a few crazy cases how the case depends on the interpretation of the IO, I decided to mention it just not to leave any space for misinterpretation. One example was the gentleman who submitted his application 1:30 am in the day he became eligible, and his case was initially rejected!! Because USCIS website clock set on Hawaii time. Based on that, it was 30 min too early to apply. After a month of work, lobbying with congressmen, interview newspapers etc he was able to turn the decision in his favor, but who wants to be in his shoes. There is a long and exciting thread somewhere online which you may enjoy reading it.   

    What if the IO uses this (perhaps combines another typo/error) to reject your case. After all, traffic tickets are not a deal-breaker for N400. Mentioning them might be perceived as a good moral character too (in terms of showing honesty)

    How pathetic when the level of political discourse is reduced to schoolyard epithets and populist scare mongering rather than a reasoned debate of actual positions taken by people.  This is why we should be keeping politics out of these forums.

    Please let’s not make political debates out of this discussion. Here it’s not about who’s better and who’s worse. It’s about the article and concrete impacts on future-to-be immigrants.

    i think people are either missing the point, lost, or deliberately disingenuous. Of course there are people on here who are anti most types of immigration so it is no surprise😆 🤣😆The point is that Trump is cutting immigration drastically regardless of whichever program he is touching, ultimately it affects ALL immigration processes and almost none in a positive way. He says he is for merit based immigration, well H1 programs are heavily affected. Processing times for virtually all types of petitions and visas are negatively impacted.
     
    So those who are saying the media is exaggerating are the ones who don't know what they are talking about. There is virtually no immigration process which has not been adversely affected under Trump, none. The media loves to cry wolf, but guess what there really is a wolf in the immigration world!

    I’ve been researching a lot on the subject because I also am in a CR1 process. Trump has never touched on those situations in all of his Former “immigration plans”. He is primarily focusing on job related visas and their families. His plan from 2018 (maybe 2019?) was not touching anything with spousal immigration. If anything, I think he’s trying to make it somewhat easier. That’s what I heard, we shall see  
     
    I think if anything, our biggest worry will be the USCIS putting people on furloughs. I don’t think Trump’s immigration overhaul is gonna affect people like us. 
     
    I will say this, DO NOT believe everything written about this subject. Nobody knows what the heck theyre talking about anymore. Plus the media is doing their best to push fear and make people crazy. Read, but take each article with a grain of salt and follow this forum for updates.

    Agree......there are some great folks here on VJ who are really good at seeing through the misinformation and inaccuracies out there (I am not talking about myself).  I have trouble keeping up...

    Passport is a travel document not "linked" to any AOS application.   Your AP is linked to your I485 not the passport

    Thank you. My husband is going to drive me and him crazy with what to wear. 10 outfits later he still don't know. But I think he got it together. I'll be all dressed up sitting in the car.

    Hey all! Here is a little bit of good news for this thread  

    "The chairwoman of the House Appropriations Subcommittee on Homeland Security said Tuesday (July 7, 2020) that a supplemental bill to address the US Citizenship and Immigration Services funding shortfall caused by the pandemic will move through Congress this month in an effort to prevent the agency from furloughing about 70% of its staff on Aug. 3."     Nothing is set in stone yet obviously, but based on the article it seems like lawmakers are starting to pay more attention to this issue. Keep emailing your state representatives (as I have done) to continue bringing attention to the USCIS budget shortfall in order to protect USCIS employees from potential furloughs, and ultimately, prevent more delays in immigration processing time for our loved ones!

    It’s simply not a comparable situation to have online courses when you are about to live anywhere in the country, including the same city as the brick and mortar college if you wish, than being forced back home to a complete different country.
     
    Others have already pointed out time zone issues as well as a possible lack of technology infrastructure in some countries that could make online learning difficult or near impossible.
     
    My friend recently learned she is going to be doing her final Masters year online. Almost immediately she got emails from professors letting their classes know they will be available for face to face meetings for students who may need to check in from time to time. She’s already been invited to some outside study groups with fellow local students. Local organizations and businesses that are popular internship spots are already stepping up to offer hybrid options regardless of the all-online class model. All of these are things an international student who was sent home wouldn’t be able to participate in.
     
    There’s probably more I’m missing, but acting like International students are going to be in the exact same boat as domestic students if they get sent home is... ridiculous. When you consider that international students often pay astronomically more in tuition and fees it becomes even more upsetting.

    As I stated in my post above, I gave the numbers for the 1st quarter of FY 2019...In addition, I have read that about 75% of initially denied cases are appealed and approved. 1%, 3%, 5%.......very few I-751s are denied.
