Hello everyone,

reading the forums I know I’m not alone in feeling frustrated on how K-1 are being handled. I’ve spoken to attorneys and I basically have been told by all of them a k-1 is a wrong choice. Have any of y’all decided to just ditch the k-1 and go to your fiancé country? As that’s what I’m considering doing but, if I do that would it impact  us in the future if we obviously went the spousal route years later.

Did they say why a K-1 is a wrong choice?  I suppose they want to "help" you with a CR-1 ?

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

They said due to how everything is going pandemic, government issues that k-1 are the least of their worries . They added onto that by saying I would be in a long wait to the point I left feeling defeated and stupid. 
being patient is key in this situation but, I’m wondering if it’s just best to let the ship sail and just go there for a few years. Although, I’m sure timing will just get slower and longer with everything.

If anything, living abroad with your spouse would actually strengthen your spousal visa application down the road, as you'd have tons of evidence to show for it. In terms of abandoning the K-1, I don't think it would have a negative impact because given the Covid situation, there would be a legitimate reason to do so.

 

The lawyers aren't wrong to say it would be a long wait. Everyone is in the same boat right now. CR-1's aren't exactly getting processed speedily either right now.

Correct, which is no one fault it’s highly difficult for many of us regardless of which visa k-1 aren’t “alone”. As I’ve seen some feel k-1 are the target when we aren’t but, I think if a chance comes for someone to be able to spend alot

of time overseas they should. Hence my situation :)

One option is to re-locate, marry, and start the CR-1 process.  Then in roughly 2 years, your spouse would be a legal resident upon entering the US.  That is not possible for some people, but you would be together for the entire process.

I am here in my fiance's country but we are still waiting on a K1. Been waiting most of the year. Getting married here is a massive hassle requiring thousands of dollars, several bribes, and lots of travel back and forth across the country. So we did K1 and plan to get a cheap courthouse wedding in the US. But now we're stuck here.

 

It wouldn't matter either way. They're not processing K1 or CR1  at the local embassy, so what's the difference? Especially now that USCIS will lay off most of their staff.

Right. The target is all immigrants.

 

And "overseas" ain't that great. Most of the world is pretty tough living. Millions are barely surviving. That's why people risk their lives sneaking across deserts and oceans to get into the US, while no one risks their lives sneaking in the other direction.

Yes we have done that! We have decided to abandon the US K1 and start the UK fiancé visa process. From what I have read it would not affect the spousal route back to the US (we plan on doing this as well).

Do what you think is best for you; if you have just submitted your K1 visa application and the process of immigration of you to move over to your fiancé's country is an easy one, that could be the best thing. However, if that country has an equally  complex immigration process you could be shooting yourself in the foot. Try and get a sense of that and hopefully that will help your decision.

My timeline is filled out. However, it does not show here but it is filled out. Now how I can get it to show that’s something I am figuring it out.
