MarlinCobon got a reaction from Family in Public charge
    Hello everyone!

so I have some questions that I hope I can get answers to.

Are we required to get insurance for our spouses aboard before the interview?

and I was trying to figure out the DS 5540 but it says its unavailable and then I read this.

    Update on Public Charge
    Last Updated: August 7, 2020
On Wednesday, July 29, the United States District Court for the Southern District of New York enjoined the Department of State from “enforcing, applying, implementing, or treating as effective” the Department’s October 2019 interim final rule and accompanying Foreign Affairs Manual guidance related to the public charge ground of visa ineligibility.  The Department is complying with the court’s order and is in the process of updating its guidance to consular officers on how to proceed under the preliminary injunction. In the interim, visa applications that appear to be ineligible under INA 212(a)(4) will be refused for administrative processing to allow for consultation with the Department, including legal review to ensure compliance with applicable court orders.  Visa applicants are not requested to take any additional steps at this time and should attend their visa interviews as scheduled.  Applicants are not required to complete nor should they present the DS-5540, Public Charge Questionnaire.

is this for everyone or just for New York?

    thank you so much!

MarlinCobon got a reaction from humming bird in Filing N400 . Tax Return, Can I send H&R Block transcripts?
    hello!

I didn't submit any tax returns and I have my interview on the 27th of this month. I am planning on taking my tax transcripts except for the one for 2020 because I don't have it yet. My sister had her interview on the 15th and she was not asked for any of them. Keep in mind we submitted our application based on the 5 year rule. Marriage based is different. When you submit your application you always have the option to go back and add more supporting documents. Maybe you can submit the tax transcripts for the years that you have and the tax returns for the year that you don't. if you don't have them you can always request them on the IRS page and they will arrive in 7-10 days.

It's been one solid year since we got DQ,  15 months since I-130 approval and 22 months since we initially submitted I - 130. Embassy prioritizes students over families and yet again another year of separate holidays and anniversaries celebrations 😢😢

I naturalized over a year ago and my myuscis account still says:
    Estimated wait time:
We are taking longer than expected to process your case. You do not need to do anything at this time.

right below the update  that says “Certificate Of Naturalization Was Issued”. So yeah, take estimated times with a big bucket of salt!

I would take those dates with a grain of salt.
They might show you a rough estimate but not a correct one.
In my personal case it makes no sense. I have my Oath Ceremony tomorrow (12/02/2020) and my USCIS account shows completion as February of 2021.
My USCIS account shows updated and correct actions (interviews and all) but the date of completion is out of whack.

It would be foolish to vote for a person purely for immigration benefit based on just one of their policies.. you need to consider the overall impact of all of their policies vs the type of lifestyle you prefer for You and your spouse in the future..

The PP did determine spouses and minor children of USCs are not a threat to the job market but spouses and minor children of LPRs are, this is wrong on so many levels. Sadly to say that the PP was not made to protect the job market at all.

To those saying this has no chance, here's a counter opinion -

    https://www.nytimes.com/2020/07/08/us/harvard-mit-trump-ice-students.html

Harvard and M.I.T. sued the Trump administration, along with more universities, and the J1 visa was put back on track. I'm aware these cases are quite different but I believe the people saying there is 0 chance of success are not speaking accurately.

Maybe there won't be any result, but there could be.

Pretty broad indeed. The only reason why I personally think it's 50/50, is that the entire PP (both, April and June 22nd) is based on immigrants being a threat to the American labor market. This is not backed up by data, and DOS and other agencies state that immigration does the opposite (as in immigration helps grow the economy). I certainly have no clue where this is going, but I can imagine that even a PP must be based on actuals, not on personal feelings of an individual and his racist advisor.

MarlinCobon reacted to Sam&Nate in Naturalization Interview in Boston 8/19/20
    Hi everyone,

I wanted to share my Naturalization Interview at the USCIS office in the JFK Federal Building in Boston.

My interview was originally scheduled for March 31st but was "de-scheduled" on 3/17. On 7/27 I received the "Re-scheduled" notice for the interview on 8/19 at 10:45am.

Here is what the notice told me to bring:

"You MUST BRING the following with you to the interview:
    • This letter.
    • Your Alien Registration Card ("green card").
    • Any evidence of Selective Service Registration.
    • Your passport and/or any other documents you used in connection with any entries into the United States.
    • Those items noted below which are applicable to you:
    If applying for NATURALIZATION AS THE SPOUSE of a United States Citizen;
    • Your marriage certificate.
    • Proof of death or divorce for each prior marriage of yourself or spouse.
    • Your spouse's birth or naturalization certificate or certificate of citizenship."

Since I am applying for naturalization as the spouse of U.S. Citizen I brought all of the above (except the proof of death/divorce as this is our first marriage) to the interview.

If you are using Google Maps to get to the interview, it will likely direct you to the Employee Only entrance, as it did for me and another woman. The security guard had to come out and direct us to the appropriate entrance. The main entrance is off Cambridge Street NOT Sudbury Street.

When you enter, someone will ask you for your appointment notice, if it is 15 minutes or less before your appointment, they will let you pass through to security. I believe I saw someone turned away for not wearing a mask. Security was typical, put your bags in a tray, empty your pockets, walk through a metal detector. Once you're through security, just follow the signs for "Immigration Interviews E-160" down a long hallway.

Once you arrive in the USCIS lobby, there are marked spots on the floor to stand while you wait to be called to the front desk. The lady at the front desk will check your appointment notice and assign you a number, then tell you to find a seat wherever you'd like and wait until an officer calls your number.

There were seats that were taped off and seats with signs saying "please leave room" encouraging social distancing. There was hand sanitizer everywhere. I waited probably 10-15 minutes before my number was called.

I followed the officer through a door, she led me to her office with the door open. There was a big piece of plexi-glass between the two of us and she asked me to sit in a chair that was against the wall. She asked to take my picture just to prove I was there. She asked to see my interview notice, my green card and my passport. She asked me to take an oath that I would tell the truth. We did the English & Civics test first. There was an iPad mounted on her desk on my side of the plexi-glass. She asked me to read the sentence on the iPad, which was "When is Columbus Day?", then she asked me to write on the iPad using a stylus, "Columbus Day is in October". She asked me the civics questions, the ones I got were:

What is an amendment? What are the first ten amendments to the constitution called? Who is the chief justice of the United States? Why are there thirteen stripes on the American flag? What age do you register for the selective service? And I can't remember the last one!

We spent the rest of the interview going over my application. Everything seemed in order until she asked me if I had proof that I am still married. This was not something listed on my Interview notice, so I hadn't brought anything. I told her I had our marriage certificate and my husband's birth certificate but she did not ask to see those. She told me that I would need to submit more evidence and that she was putting in a "Request for Evidence". She said they're looking for documents that show that my husband and I still love together, like mail or bills with our names and address. I had already submitted tax returns but I guess they wanted more. She said I could submit the evidence online through the myuscis portal or via mail. She told me she would check my account later today to see if the evidence is uploaded. I told her I would submit those documents as soon as I got home.

That ended the interview and she printed out a letter explaining what documents I could submit as evidence. She also printed an Interview Results document saying that they needed more evidence before they could make a decision. Then she asked if I had any questions and when I didn't she walked me out to the waiting room.

I got home as quickly as I could and uploaded the evidence requested. This was as of about 12:30pm today all said and done. Now I am waiting to see if my application will be approved. The officer told me I should receive notice in the portal, but if I don't, it will come in the mail.

Feeling a bit in limbo right now so fingers crossed this all works out!

Word to the wise: bring proof of marriage to the interview (bills, bank statements, child's birth certificate, lease, mortgage, etc.) whether the letter tells you to or not!

MarlinCobon reacted to ReneeGG in Interview at Tbilisi, Georgia Embassy...Approved!
Hi all, I wanted to share our experience today for the IR-1 Visa interview in Tbilisi, Georgia.

First of all, the interview letter requested that I attend the interview along with our 1 year old son. I have been living with my husband in Georgia since we were married, so attending the interview with him was no problem. His appointment was at 11:30am and we arrived at 11am. The embassy guards asked us to fill out a COVID-19 questionnaire regarding any symptoms or recent travel. After we filled out the form, they informed us that only my husband was to enter the embassy and if they needed me they would call me in. So, I waited outside with our son.

My husband entered the embassy and they told him to take a seat. After a couple of minutes, they called his name and requested the following documents: passport, birth certificate, relationship evidence (our sons birth certificate), military record, police certificate, and passport photos. They wanted all original documents.

Next, he sat for 10 minutes until he was called to the window. He had to swear by oath that he would answer truthfully to the following questions:
    - When did you meet your spouse?
    - Have you ever been apart from your spouse for an extended period of time?
    - Why are you both living in Georgia?
    - When was your son born?
    - Where are you planning to live in the US?
    - What does your mother-in-law do for work? (we are planning to live with her initially, so that's why they asked about her)
    - What's your goal when you get to the US?

The consular approved the visa and told my husband to expect the visa in 3-4 business days. He gave my husband the option to arrange with a courier or to pick up his passport when it was ready.

And that's it! My husband also mentioned that there were only 2 other people in the waiting room and everything was very sanitary with employees taking the necessary safety precautions due to COVID-19.
