Hello everyone!

 

so I have some questions that I hope I can get answers to.

 

Are we required to get insurance for our spouses aboard before the interview?

 

and I was trying to figure out the DS 5540 but it says its unavailable and then I read this.

 

Update on Public Charge

Last Updated: August 7, 2020

 

On Wednesday, July 29, the United States District Court for the Southern District of New York enjoined the Department of State from “enforcing, applying, implementing, or treating as effective” the Department’s October 2019 interim final rule and accompanying Foreign Affairs Manual guidance related to the public charge ground of visa ineligibility.  The Department is complying with the court’s order and is in the process of updating its guidance to consular officers on how to proceed under the preliminary injunction. In the interim, visa applications that appear to be ineligible under INA 212(a)(4) will be refused for administrative processing to allow for consultation with the Department, including legal review to ensure compliance with applicable court orders.  Visa applicants are not requested to take any additional steps at this time and should attend their visa interviews as scheduled.  Applicants are not required to complete nor should they present the DS-5540, Public Charge Questionnaire.

 

is this for everyone or just for New York?

Not required.  But if your spouse has any medical condition that requires ongoing treatment, the consul officer may ask about it during the interview.

Hello, I had the same question you had in regards to getting health insurance for your spouse. My husband just received his appointment notice(July 20th)  and my attorney has been telling us he needs insurance when he goes to his appt. Did you happen to have your interview already? Or does anyone know if it really is a big requirement like my attorney is making it seem?

Your attorney needs to keep up with the uscis/state department updates. He is wrong.

2015-06-16: I-130 Sent

2015-08-17: I-130 approved

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand

2017-08-01: Entry to US
