harden4mvp reacted to Loren Y in RFE requesting W2 and 1099
Yes, MFJ is how we filed also. wish I knew this from the get-go. would have saved a 76 day delay. guess that's not too bad in the immigration world. Most things are 12 months plus.

NVC is just being difficult. I used transcripts also hoping to avoid the 1099, and w-2 fiasco. I just uploaded my 2 w-2's and 3 1099's for me, and my wife had 3 1099's I had to upload, including a W2G for gambling winnings. Thought they would be happy, nope, 76 days later they want more clarification of what a W-2G is. I think NVC is trying to be the new IRS. This is my last round with them as I wait another 76days for them to review the W-2G information I sent them. I was really impressed with the ease of the online things at NVC, but now it just allows them to shaft you faster and keep you busy why they slack off. As you can see the NVC is really getting on my nerves lately. Have over 6 figures of income on the tax transcripts, why they care about my tax methods is beyond me.
I saw your second post, hopefully it's right. I know next time ( If there ever is a next time) I'm sending everything and the kitchen sink. But that usually backfires also because they are not very bright, and ask for more things.

harden4mvp reacted to erika86 in IRS Transcript or W-2/1099?
Per the NVC website:
We relied on the opinions of our attorney and VJ randos, ... and after much waiting got an information request for the W-2s and 1099s from the NVC. We now submitted all of the documentation to show the separate income for each spouse.
Avoid our mistake. Just submit the W2s, 1099s, and any other income documentation to separate the income for each spouse with your original submission.

Just a final update to this topic for future reference of anyone experiencing the same issue.
Today we received the email letting us know that we are now documentarily qualified!
So it was in fact a glitch on their end. We did not have to submit further documents. We phoned the NVC phoneline and the person we spoke to created a 'supervisor referral' because she believed that the mistake was on their end. She said the supervisor would take a look at it as soon as possible, which could take up to 6 weeks, but is usually a lot quicker.
Roughly a week later we got the notice that all documents were approved and we are documentarily qualified. We did not need to take any further action, did not submit any new documents, and did not 'go to the back of the queue', so to speak.
Good luck to anyone who experiences the same issue, hope this information helps!

NVC is a hose job. Send everything, waited a year for review and they asked for w-2s, and 1099 info. I included tax transcript, and they approved the 864 and every other document.... wait 76 days for them to review the new data.... now they want more info on the w-2G from the tax transcript for the I864. Why do they care about a jackpot on a slot machine and some gambling winnings. My wife and I make over 6 figure without the stupid jackpot she hit back in 2020, but now I guess if your lucky at the slot machines they penalize you. Now I wait another 70 plus days for them to review it. What a mess, I despise the NVC.

harden4mvp reacted to Just Paul in Expedite I-131 Reentry permit?
You can request it - they can schedule it even with a closed ASC. Biometrics can be waived in emergency situations. They have been waving them for regular AOS.
First step is to ask. Ask for a tier 2 if necessary.

harden4mvp reacted to Quarknase in Recent timeline for I-131 LPR re-entry permit
No timeline experience here, but what I can tell you is that the Application Support Centers are still closed, therefore no biometrics have been taken. You can check back regularly here for updates https://www.uscis.gov/about-us/uscis-office-closings
Open the “Application Support Center” tab, as those and not the USCIS offices are the ones doing biometrics.

harden4mvp reacted to Cewseww6 in LPR just arrived back in the US after 11 months and 3 weeks abroad
Hi,
I just wanted to share my experience as an LPR travelling back to the US from Europe in these times.
We traveled from Stockholm last Wednesday, to Copenhagen, Denmark, and then we flew to Chicago O'Hare, which was our Port of Entry. It's one of the 13 airports open due to the proclamation the President made earlier this Spring.
I was kind of worried, been abroad since last summer, and we planned to come back in March but then beloved COVID-19 hit everywhere and changed the world. But they CBP officer at customs was super friendly and only asked once how long I've been abroad. Told him I came back with a week to spare before 12 months hit. He said nothing, no notes in my passport or anything.
"Welcome back" and we walked to get our bags.
Not sure if this is helpful for anyone because I made it back before 12 months, but I wanted to share my experience is all. Now I have applied for a Re-entry Permit because we have to return in a few weeks and we have every intention on moving back before that expires. Hopefully I get the Re-entry Permit within the next few weeks, concerned about the biometrics and if the local office will be open.

harden4mvp reacted to phoenyxx in F2A seems to be out until 2021. What’s your move?
Agreed.
I'm going to have to travel more often to see my husband. Granted, I wasn't expecting a response from USCIS until Dec, but that just means the wait time has further increased. At this rate, I might have to upgrade his petition to spouse of citizen, I might very well naturalize before he his PD is current

harden4mvp got a reaction from Chimney in F2A seems to be out until 2021. What’s your move?
The whole situation of F2A is ridiculous.
With the ban, our spouses and kids are stuck overseas indefinitely (the ban is lasting till December 31 AND even though PD is current now, whenever the ban is lifted likely the PD backlog will come back).
Furthermore, filing of I1-30 shows immigrant intent. And this disqualifies beneficiaries from applying for some temporary visa (F1, etc) to enter US for family reunion.
This is just absurd and intentionally force families to separate indefinitely.
I guess there isn't a magical approach with US immigration so messed up, esp. for F2A category.

No, processing does not seem to be impacted. However, you need to put into consideration that all departments work with smaller work force and all processing is anticipated to slow down a bit. F2A approvals have happened as well as NVC DQs for this category

harden4mvp reacted to WilliamHTX in F2A Transferred from CSC to PSC. Approved 23 days after transferred
Well... Let me provide more info here so that there is a better apple-to-apple comparison.
My wife said the alleged reason that our case got processed so quickly was because of the abundance of evidence. We will never know what exact factor(s) led to the difference in speed but I think it doesn't hurt to take a look on the evidence that I provided.
Photos of our trips and wedding ceremony (total: 70-80 photos). All photos were labeled with date, location, and relationship of people to us (if there are people other than us in the photo) Affidavit of our relationship written by my friend whom is an American citizen Receipts of hotels, meals, and expenses when we went on trips together Air ticket purchase receipts. (We went to quite a few places before we got married. We went to Denver, Vegas, Chicago, New York, Philly, DC, and Austin) Marriage certificate (of course) Joint bank account (U.S.) proof Note: I did not include a phone record for two reasons. First, we called each other on Whatsapp. It's not like a phone bill that can show the phone number. I felt like taking screenshots was not official enough so I didn't send the records. Second, she was here for 5 months in the US prior to our wedding. We didn't need to talk on the phone since she was with me. There wasn't much to show anyways.
The approach I adopted was to leave no evidence behind. Since I don't want to get RFE, I submitted everything possible to help them make the decision. Is this the reason I got approved so quickly? No one could ever tell.

harden4mvp reacted to WilliamHTX in F2A Transferred from CSC to PSC. Approved 23 days after transferred
Hey guys! I just want to share some information that I personally had difficulty to find across the web: What happens when your case is being transferred? (Note: YMMV) I am a LPR and I petitioned my wife for GC application based on marriage. Our case was originally processed at California Service Center (CSC). (Case was received late April, 2019) We were religious in checking the processing time on USCIS website even knowing that the time listed may not be accurate at times. We were hoping that the processing time will become shorter since there was trend lately. Then... our case was transferred to Potomac Service Center (PSC) on Feb 19, 2020. The listed processing time for I-130 for F2A was way longer than CSC. (CSC: 8.5 - 11 months; PSC: 26.5 - 34.5 months) We were scratching our heads... wondering, "If they are doing workload balancing, why would cases be transferred from CSC to PSC?" We were both quite discouraged at the time. I was trying to search online to see if anyone sharing similar experience while their case was being transferred and what could happen afterwards. Either I didn't search the right thing or there wasn't any good info out there. The only thing I saw was on VisaJourney where a limited amount of applicants got their cases transferred and then got approved in about 2 months. I tried to calm ourselves with this little trace of evidence, hoping for the best. Last night, as I was driving home from the airport, I got a notification text from USCIS saying that there was an update on my case. I was mentally preparing for the worst: RFE. Since I was driving, I told my wife to check it. She screamed ecstatically after she saw the screen. IT WAS APPROVED! Lesson learned: Case transferring seems to be a good news instead of a bad news. Don't freak out. I hope this sharing could help relieve some of your worries. -

When you get the receipt it will indicate the service center. It will be California . . . unless there is something completely crazy.

harden4mvp reacted to givionte in Translating chat history (screenshots from phone/computer)
Using Powerpoint or some presentation app (I used WPS) is the easiest way to prepare, you can make captions using the text box, and overlay text boxes on top of the image with translations and paste and resize the photos in. It was the simplest method I found, and I was able to get 3 to 4 photos plus a caption for each on every page certain evidence couldn't be shrunk down so it got a page all to its own. Change the PPT format to portrait and the size of your paper.
Chat logs are very informal evidence, there isn't a required way to do it, I prepared it how I imagined the clerk scanning this stuff in and reading it would prefer, because I didn't want them wasting their time sifting through pages trying to understand my methods.

harden4mvp reacted to Duke & Marie in I-130 affidavits / support letters from parents
I’d have to say if your thin on other forms of evidence then affidavits of support do help.. but only if they have physically met you and have knowledge of the relationship
Without any offence, it would be somewhat nice if we remember that in the majority of cases spouses who reside overseas from each other keep the majority of their finances sperate, generally because it’s easier to do so when maintaining multiple dwellings oceans apart... secondly there are usually issues with combating exchange rates and banking and insurance institutions who don’t permit much of these merger type activities to happen when spouses are not residents of said countries.. same same when it comes to emergency contacts or nominated person to make medical decisions..
I know this from personal experience, our package was very light on evidence. it basically consisted of a marriage certificate, a few photographs of us together (12) inc wedding and 2 affidavits of support one from my husbands daughter (who was residing with me at the time in Aus) and one from his step mom (a USC that I’d met once over lunch)... other than that, I wrote down dates of all our travel to see each other 7 in total and a copy my I94 as supporting evidence..
if Affidavits of support is all you have then you need to use them.. we had our i130 approved without RFE.. and are currently waiting on DQ at NVC.
