mandamus can be filed for wrongfull denial too. you can fight it in court if you believe that USCIS has not done its job correctly. it works

igoyougoduke reacted to JeanneAdil in Combo interview : can we bring our 16 month old child? (Split)
https://www.uscis.gov/sites/default/files/document/guides/chapter5.pdf
page 6 says who is allowed at your interview
looking thru google attorneys say
Do not bring your children/
look to google for answers and what the various lawyers say
Reading thru posts some offices did allow children and had a small play area (Chicago office) but covid pretty much limited who could go where and when and the child may not even be let in

igoyougoduke reacted to OldUser in Combo interview : can we bring our 16 month old child? (Split)
Don't do it. Reasons:
1) If the child starts crying one of you may be asked to leave the room, automatically converting your interview into stokes interview.
2) The interviewer may be annoyed with the child / generally doesn't like kids which can change their mood affecting the interview.
3) You may lose focus because of the child present and answer things incorrectly.

I can totally understand being done.
@Old_Glory said it best. You have done so much research, so much fighting. I don't think any of us can even begin to comprehend every stone you turned every page you've read. All of what you have done over and over and over again.
It is easy for all of us to say keep fighting. We're not the ones going through all of this. Only you know when enough is enough. Do what is best for you.

Having followed your case here almost as long as I've been here, I am very sorry to hear this. With all the illegal aliens running around loose in this country who should be removed, and are not being, it's disheartening that USCIS should waste their resources on someone who is undoubtedly an asset to the US. VisaJourney is famously a do-it-yourself forum but, there are cases where it is prudent and necessary to involve an immigration attorney to achieve a just outcome. This seems like one of those cases. You certainly have my best wishes no matter which course you choose from here.

igoyougoduke reacted to JeanneAdil in Need help on Explanation for not filing taxes
You need this
If you and/or your parents have never filed taxes with the IRS, the IRS Verification of Non-Filing Letter must be requested by mail using the paper version of the IRS Form 4506-T available at www.irs.gov/pub/irs-pdf/f4506t.pdf You will need to print, complete, sign and send the form by mail or fax to the IRS.
is he sponsoring U?
he may need joint sponsor as non filing usually means low income

igoyougoduke reacted to Crazy Cat in What do you guys think about coming back to US for a week within 39 days after I stayed in the US for 170 days?
That can easily be seen as trying to live in the US while on a tourist visa. If they suspect that, you could be admitted, then expelled.....which would result in an automatic 5 year ban from any entry into the US. I would rethink that idea.

igoyougoduke got a reaction from OldUser in 82 days on ESTA
Step 1 : dont stay on ESTA over 90 days
Step 2: Dont forget Step 1
Everything else does not matter
even if ESTA is revoked, you can always apply for visitor visa or meet in mexico/canada. It is not end of world. you will be fine

igoyougoduke got a reaction from Chancy in What do you guys think about coming back to US for a week within 39 days after I stayed in the US for 170 days?
anything is possible
1) you wont know until you arrive at CBP and than what the officer thinks about your short duration visit again
2) they are going to ask you for the purpose of visit and they know you were there for 5 months
3) if the relationship conversations come in to the discussion they might want to dig more..
as others have said, yes the possibility of your intent to stay in US is high. you could be considered to have intent to stay in US . you will know when you travel and find out. you might get by without scrutiny this time or not. no one can tell.

igoyougoduke got a reaction from Amy111 in Any bank statements required at the airport?
its fine what you are doing. she can say that you are going to take care of her expenses .it is perfectly acceptable. 3 months stay is not an issue. lots of people stay 6 months granted for visitor visa
Bank statements and funds are not required as you are going to cover her expenses

Expect to be turned around with that short of a period between visits. Rule of the thumb is twice the amount of time in the US remain outside the US.

igoyougoduke got a reaction from SalishSea in EB-5 Immigrant Investor program
your uncle must have signed an investor's agreement. that agreement will dictate when the money will be returned. you need to read the agreement and reach out to regional center . this is not an immigration question though

igoyougoduke reacted to pushbrk in Help Needed for Denied I-485
For the self employed, your "current income" is the "total income" number from your most recently filed federal tax return. You cannot qualify using any other evidence, unless it is with "liquid assets" 5 times the income shortfall.
You say you are making enough money now. If that means your 2023 total income line will show qualifying income, then file that return as soon as possible, and then use the total income on that return as the current income on your new filing.
-
igoyougoduke reacted to powerpuff in Help Needed for Denied I-485
Tax returns/transcripts are not evidence of current income. It’s evidence of past income.
You need to include actual evidence of current income which would be an employment verification letter on official business letterhead stating your salary, position, date when you started the job, etc. and paystubs.
