April M reacted to CS_Bradshaw in K1 or CR1? Covid Situation
I would suggest to just go with the CR1. I have a friend who went to the US with K1 visa and she is frustrated right now because it has been 9 months since she is doing the adjustment status there and till now she still haven't got her green card. Also, because of this pandemic, the CR1/IR1 has more advantages, because they consider you as immediate relatives and will still work on your case even it might take time, but seeing the current condition in everywhere, K1 application might take longer than CR1.
Also, effective Oct 2, the fees for adjustment status increase 62% from the current fees, so if you still wanna go with K1, you need to make sure that you are ready to deal with paying those expenses and wait time until you can get your green card or if you want to travel outside US. Once you get to the US with CR1 you just need to wait till you get your green card (i have heard most people get it around 1~3 months after their arrival in the US).

April M reacted to Ontarkie in K1 after a previous J! denial (split)
Sorry I have been without a computer until now. As Geowrian mentioned below. Posting questions in another persons thread can not only cause confusion to the thread but the new person's question can also be skipped over and they may never get an answer.
We move threads because we want that member to get the best possible answer. If you accidentally post a question in the wrong forum. Someone may not see where you are at in your journey and answer it as if the question is about a completely different process.
Thanks for answering

Depends on the reason for the refusal. Some requirements are the same between a J visa and a K visa. Many are different.
The most likely reason - by very far - for the J refusal would be INA 214(b): lack of ties to return home. If this was the reason for refusal, then it won't impact a K visa at all as a K visa has no such requirement to return home.
If the reason was - for example only - misrepresentation, then that would be an issue for a K visa as well.
The refusal itself would not be an issue for a K visa.
I am not aware of the context here so I can only speak generally...
The best way to get answers to somebody's question(s) is by utilizing their own thread. This is because:
1) The answers to the questions may differ from that in the other thread owner's case. Different circumstances = possibly different issues.
2) When there are multiple people asking questions ins a single thread, it becomes very easy to lose track of what circumstances apply to which person, and the accuracy of the responses will suffer as a result.
3) For future questions they may ask, one can easily go and looks at their past topics for additional information that may be relevant to their new question.
4) That's the rules. Even if 1-3 didn't apply, this does.
Also, the goal of moving and splitting threads is to help each other is the best manner possible.
Mods have the ability to split threads and such (like what happened here).
Organizers and mods and can move an entire thread to a different forum.
General users cannot perform these operations.

J1 is a visa. K1 is also a visa, but it is 2 different TYPEs.
There is many visas of different type, there are rules and regulations you must follow when you apply for certain type of visa.
In general after denial of any type of visa you need wait 1 to 2 years( as they classify it as sufficient time limit for personal circumstances to change (improve)).
Don't worry you don't have any red flag, only terrorists and people on the watch list have red flags.
Look at your history with US embassy, they know about you only what you tell them.
Anyone can apply for a US visa at embassy so what? It does not give you any privilege but be careful, don't show them constant pattern of to many attempts.

Really? I thought we were here to help each other? I was kind of interested in the question and don't really get the whole proper topic think myself but I do try. When I post and it needs to go somewhere else there are those who move it for me ( I don't get how they do that as well) so I can be in the right place. Not everyone understands technology etiquette. Do you know the answer to the question before direction the question to some other space and time please?🙏

Don’t withdraw K1 before you get married. It can be withdrawn after the marriage.
Good luck!

Thank you, Lucky Cat, and everyone that contributed. I do think the next step for us is to withdraw the current K1 visa and marry over the Christmas holiday or early in the new year. Of course, pending travel restrictions/Covid. And seek the CR1.
Thank you again everyone.

Check out some visas, there are a lot of them since coronavirus started. There is no problems other than documents being in order and the Consular who processes it, grants it. It's much more simple than people make it. People on both sides make it difficult. The word fraud causes problems for innocent people.

She is going to contact embassy and see what they say about extending her visa.

I would check with the embassy or USCIS and find out how to extend the date somehow. Also check on line for info. If none of those pan out I would ask a lawyer. Sometimes just calling and asking a question can get you on the right track without needing to hire them. YouTube might have something too. The problem is this is all new so we all are dealing with things that are not normal. Hope you find the answer. I would be interested in the info

Go via Heathrow. Not sure what transit visa you might need. United Airlines flight London to Newark is government backed so shouldn't get cancelled. It's worth looking at.
