molehills reacted to TrinitySnow in August 2021 - AOS Filers
Date filed AOS / EAD / AP (sent to Chicago office):  July 29, 2021
    Bio appointment: Aug 30, 2021
Interview scheduled by USCIS on: Feb 15, 2022
    Interview date: March 28, 2022

Almost exactly 8 months from sending out the AOS and almost exactly 7 months from the biometrics appointment, we finally have an interview date!

It seemed like it would never happen and I feared my case might've been forgotten so I called USCIS at +1(800) 375-5283, said "Infopass" and asked to speak to a "Tier 2 Officer" for a service request. I was put on a waitlist where I was supposed to be contacted by the Tier 2 Officer within 30-days. However, after a week of that initial call, my case status was finally updated. I am not sure if this was because I requested to speak to a Tier 2 Office but I highly suggest it nonetheless.

Best of luck to the rest of the July/August filers!

Hi VJ members! Today we had our AOS interview for green card and we were approved! Thanks God!
The interview itself took about 10 minutes. Immigration officer was super friendly and she asked just some questions most of them to my husband ( petitioner) . Everything went very smoothly, she didn't ask any documents at all. Interview was in Mount Laurel NJ
    Here are our questions:
    To beneficiary -
1 Have you been in any groups I don't remember details of question but it was about my background?
2 Do you like America? Do you feel free here?
3 Did you commit any crimes or drug something involved I don't remember details I was worried and nervous?)
4 Do you work? I said no I can't work on k1 visa she said actually you can but I think it was checking questions or she meant possibility to work in some conditions
    5 Have you been married?
    6 Do you have children?
     petitioner questions
1 when and where did you meet?
2 Are you parents happy you got married?
3 How many times you went to Belarus and how long did you stay each time?
4 Have you been married before?
    5 Do you have children?
6 Do you feel free in America? She mentioned she does!
I signed document and she said there are no red flags your case is easy! You will get your GC in two weeks and you need to apply for SSN!
It was easy and comfortable to be there!
I wish all of you such an easy interview! Just relax and say true!🙏

All of that is irrelevant to the fact that the burden is on YOU (not USCIS) to demonstrate evidence that your religion opposes vaccines.   A lack of structure will, in my opinion, make that next to impossible.  If you do not have written, documented, well-established teachings, doctrines, dogma etc, then it really is more of a personal belief than a religious exemption.

I would have a plan B in the event of a denial, with or without a lawyer.

Yes the immigrant can collect the third stimulus ($1400) on the 2021 return as long as he has a SSN issued before filing deadline in April. OR if you file an extension, he has until the extension deadline (October 15) to be issued a SSN.

We filed in August our first year after getting married for this very reason.
A little known fact:  You have three years to file IF you don’t owe any money (are due a refund) and there is no penalty (and) you get your refund anyway.
You can also file an extension, but since we were owed money we didnt worry about it.
So:  If you are due a refund, just wait to file

I understand what you are trying to do and think it is worth a try. And did you know if your wife gets her SSN prior to the October extension deadline, she qualifies for the third government rebate of $1400. She does not with an ITIN.

This is a link to the paper form for an extension which I think will give you the basic information you need as well as ways to pay. There’s four pages of info to read so don’t skip the instructions. . https://www.irs.gov/pub/irs-pdf/f4868.pdf

You may have to fill out the paper form and write “pending” for the SSN. Tax software may not allow an efile without a proper SSN in that field.

You only have to pay in an estimate for your extension if you are going to owe the IRS. Have you worked out your taxes yet? Many people are surprised by the married filing joint benefit and the extra standard deduction a wife will bring to the process.

If the SSN doesn’t come through before October, you can file Married Filing Separately instead and amend to Jointly later. Sorry I can’t help you with State income tax questions.

Hi everyone. Happy valentine!! Little update here. I received my GC last friday (02/11), my interview was on 02/03.

Interview was very relax. Questions were :
    1. When did u meet ?
    2. When and where ur wedding was ?

That was it. She asked for additional document. I gave her joint bank account, my health insurance, copy of flight tickets, copy of cards from the family, photos. But she didn't even look at it. She just clip it all together with the rest of my documents she already has.

Since the officer lives like 10 minutes away from us so we talked about restaurants around us. At the end of the interview she said "you're green card will be delivered within 1 or 2 weeks". But I got in in less than 2 weeks.

Well each stay was under 180 days, however if you look at the full aggregate duration, you spent more time outside the US than inside the US.  The CBP officer is better at math than your lawyer.  I would stay put for at least 6 months.  Fully understand the desire to be with your wife, but plenty of folks on here are in the same boat of being stuck apart during this COVID backlog.  Do you really want to spend a bunch of money arguing your case if there is a negative impact the next time you travelled.... I wouldn't, especially if CBP put a mark in your passport.

According to VJ, our EAD should be adjudicated between Feb. 6-24. AP is Feb. 15-22. Only update for EAD was our biometrics in August, and AP has been quiet since submission.

I'm a little cautious with timelines these days just because anything can happen to throw off these dates, like the CO getting ill and being out. We've our AOS interview tomorrow, so I'm anticipating and hoping, frankly, that we just going straight to greencard.

Personally, I'd feel comfortable with bringing a complete copy of everything submitted (+ the RFE docs/if applicable) and whatever you can scrape together for the evidence.

The interviewer said that officially it will take 3 days to finalize but she was gonna approve it. So woohoo!!!!!
