English only in the upper / immigration forums please, so everyone knows what you say and can learn from it/ help.

Chimney reacted to Chancy in IV issuance statistics for June 202—barely a few F2A worldwide? (merged)
FX would be F2A cases that are exempt from country limitations. Most F2A are in this group, so you see very few that are listed as "F2A", which are subject to country limitations.

Chimney reacted to Hanna85 in F2a visa interview update
Sorry to hear that. Hope that in the next 60 days they send interview date. I saw that Amsterdam embassy processed a lot of non-immigrant visas (more than 100 per month), but still around 20 of immigrant visas. Still don't understand, why it is so slow. And I called both NVC and embassy and they just blame each other. Embassy waits for NVC, NVC waits for embassy 🤦♀️

Chimney reacted to igoyougoduke in Trump signed a pretty minor amendment tonight regarding the 6/22 EO
I dont know why the government tries to make it as dumb and ambiguous as the presidency. Simple language that says "if you already have a visa - you can travel". if you dont have a visa - a new one will not be issued will stop all the nonsense and confusion

Chimney reacted to Quarknase in F2A seems to be out until 2021. What’s your move?
F2A are definitely still processing. We got DQ on the very same day when Trump released the new EO with extension through end of the year. Ironic.
What we’re doing? I filed for citizenship 6.5 months ago and hope that we can eventually upgrade to CR1. I’m being realistic and know that there’s a backlog and now USCIS will likely reduce it’s workforce so it won’t be fast. In the mean time, I am spending all the time I can (without risking Citizenship eligibility) with my husband in his country.
It’s kind of strange that we’re technically both waiting for our interview letter, we’ll see which one comes first...
It’s disappointing to see how different LPR’s are being treated in this situation 😑

Chimney reacted to harden4mvp in F2A seems to be out until 2021. What’s your move?
The whole situation of F2A is ridiculous.
With the ban, our spouses and kids are stuck overseas indefinitely (the ban is lasting till December 31 AND even though PD is current now, whenever the ban is lifted likely the PD backlog will come back).
Furthermore, filing of I1-30 shows immigrant intent. And this disqualifies beneficiaries from applying for some temporary visa (F1, etc) to enter US for family reunion.
This is just absurd and intentionally force families to separate indefinitely.
I guess there isn't a magical approach with US immigration so messed up, esp. for F2A category.

Chimney reacted to phoenyxx in F2A seems to be out until 2021. What’s your move?
Agreed.
I'm going to have to travel more often to see my husband. Granted, I wasn't expecting a response from USCIS until Dec, but that just means the wait time has further increased. At this rate, I might have to upgrade his petition to spouse of citizen, I might very well naturalize before he his PD is current

Hi all,
So according to the recent Presidential Proclamation on immigration (thanks a lot), F-2A visa category which is for a spouse or unmarried children of a Permanent Resident will not be processed at least by the end of 2020. And frankly, I don’t believe that even if Mr. Trump is out of the office in November, somebody new would rush to change things back to normal.

Dear fellows who are in the same boat as I, just out of curiosity, what are you planning to do? Any thoughts?
I’ve been around other topics on that subject, but the majority of discussion is happening about K-1s.

Chimney reacted to Chia-Lyns in Official Executive Order for Suspending Entry of Immigrants
By the definition of CR1 which is: A CR1 visa is an immigrant visa issued to an alien who is married to a U.S. citizen or permanent resident and wishes to live in the U.S. with their spouse while the F2A visa is a US immigrant visa for spouses or minor children of Green Card holders.
In the executive order, Cr1 is exempted while F2a is not but both applicable to permanent resident. My question is how do you differentiate between F2a and Cr1?

Am I understanding this right, that spouses of LPRs are not allowed to continue the immigration process?

Yes. Unfortunately that is true! So unfair. I wish there was a way to take legal actions against this nonsense order.

Chimney reacted to Trutta in Trump To Suspend H-1B and Other Visas Until End Of Year
Don't worry desperate impoverished Latinos ruined by the free trade agreement are still allowed in to pick vegetables on massive corporate owned farms for slave wages. Maids and nannys for the rich can still come too.
It's just our loved ones, highly trained and skilled people, and refugees facing death that are banned.

Chimney reacted to WantABetterLife in Trump To Suspend H-1B and Other Visas Until End Of Year
This is a common misconception about H1B spread by anti immigrant groups. I’m surprised to find this rhetoric here in a forum that helps immigrants. There are two types of H1Bs, highly skilled with masters or PHD from an American university. Go to any top STEM school, you will find majority of students to be international. These students later convert from OPT to H1B.
These jobs typically require graduate level degree, which is hard to find among Americans. The other kind of H1B is from consulting companies, typically from outsourcing companies bringing their employees on board. If you abolish H1B, these jobs will simply be outsourced. Companies will loose talent on important projects. The H1B median wage is $80k. So forget taxes. Most of these jobs will be simply moved to Canada or India. The 3 million unemployed are mostly from restaurants and other low wage workers completely unrelated to H1B. All this potential EO does is to get some brownie points among his xenophobic anti immigrant base who doesn’t want high skilled brown immigrants in this country.
I myself have a masters degree from a top US university and working on H1B and earn a salary of $110k plus bonuses. I didn’t steal anyone’s job. In fact the very first requirement of getting a H1B is to prove to USCIS that you can’t find any American to fill the job. They have gotten pretty strict about it recently. I was hired solely because my knowledge in my field. All my friends in H1B have a similar story.

Let me see the order first. It behooves me how H-4 is allowed to join H-1 with in weeks but a spouse of LPR has to sit out due to the 60 day ban in place if they reside outside the country. H-1 has been abused big time already and H-4 EAD does directly compete jobs of american citizens so to speak where there is no criteria to get an H-4 EAD and only criteria is to be married to an H-1 and piggyback on their spouses I-140. One with an H-4 EAD can go stock shelves at Target and Walmart any day.

Chimney reacted to retheem in Petition to include K1 filers as exemption from travel bans
😂😂😂what did i just read? Since when did fiances have equal rights with spouses? Anyone who reads the definition of a nuclear family- it consists of father (husband), mother(wife) and children- did you see fiance being a family member? . Even in matters non-immigration, a fiance is just that. A prospective. As in the government does not even formally recognize you. Anywho. Good luck in the journey. Keep us informed.
In times of difficulty nobody wants to be objective. We totally understand.

Chimney reacted to Crazy Cat in Petition to include K1 filers as exemption from travel bans
That is only wording on a form. It does not create policy or legally recognize fiancees as immediate family.......An immediate family member would complete a DS-260....A fiancee is a close relationship, but not an immediate family member.

LPR here too, with end of March submission. Strangely enough I saw other LPRs submitting March/April get DQed. I’m just not questioning anything and go with the explanation from the May group that NVC is training staff and picking random cases 😄
I’m wondering though - are there any CR1/IR1 still pending from February or March?
