    I meant there were no immigration benefits for having served 20 years.  Take a look at my signature.  It was a great honor for me to have had the opportunity to serve.  I am extremely proud of my military career....and I reap intangible benefits from that service every single day.

    She only needs the passport to be valid on the date of VISA issuance.
    If she does not get a new passport she would need to enter the US before the passport expires since Philippines is a member of the "6 month club"-meaning she does not need to have 6 months or more left on her passport.  https://help.cbp.gov/s/article/Article-905?language=en_US

    The published interview checklist for USEM states that the passport must be valid for at least 6 months.  But I remember a case from last year where the applicant was allowed to interview with an expiring passport.  Key differences: that case was IR2 and the applicant had already completed passport renewal appointment before the visa interview, just waiting for the passport to be delivered.
     
    If your fiancee is lucky enough to get an interview slot in the next 3 months, I suggest she go to USEM anyway, even with her expiring passport.  Bring a copy of her passport renewal appointment confirmation.  Worst case: the document screener at USEM will turn her away and she'll have to re-schedule.  But she might get lucky again and be allowed to interview, then be given a 221g letter to submit her new passport when available.

    Like Daniel, I also joined the lawsuit to get my Fiancée🇵🇭 to America🇺🇸 ASAP.
    Will we win?.. ...IDK🤷🏻‍♂️ 
    If we win, will we be scheduled for an interview at USEM faster than if we hadn't joined the lawsuit at all?.. ...IDK🤷🏻‍♂️ 
    But I chose to join the lawsuit because if it's successful, I know that I would have seriously regretted my decision to not join it when seeing the Plaintiffs reunited with their Fiancées sooner than later.
     
    I also took this gamble because the lawfirms representing us have won several Federal cases in a row, so it seems not so risky. 
    Is $2500 a lot of money to risk?.. ...ABSOLUTELY!!!
    If my gamble has a negative outcome, then I'm out $2500... ...but at the end of the day, that equals less than one week of pay for me as I net far more than $2500 in a week. 
    But I'm very optimistic that we will win. And with a positive outcome, not only will I finally be able to marry my Fiancée, but I'll be in a different tax bracket in which I will easily regain the $2500 lawyer fee.
     
    Ultimately, it is ridiculous and totally unfair for USEM to stop ALL Routine K1 Fiancée Visa Interviews/Processing for over a year now, while processing other Visas. 
    Therfore, I sincerely hope that we are all reunited with our Fiancées ASAP!

    It appears that you are referring to the group cases of Milligan v. Blinken and Kinsley v. Blinken. Milligan has not had the writ of mandamus part of the lawsuit ruled on, as it is difficult to make a ruling when each consulate is processing differently. Kinsley does not have one, and was only targeting the travel bans.
     
    The Manila mandamus lawsuit is strictly a writ of mandamus for "unreasonable delay" against the US Embassy in Manila (USEM). Despite the messaging from DOS, plaintiffs have been getting priority and interviews around the world from these lawsuits. Does that mean that interviews of others who are pending will get cancelled for us? No, but I have faith in the government that they can walk and chew gum at the same time and process our cases too/next.
     
    At the end of the day, the whole point of it is to get our cases processed, which has clearly not been happening outside of expedites and 221Gs. However, if there is a ruling and an outstanding order from a judge, the lawyers have stated that the consulates do not have a choice and will need to process our cases. See my previous post.

    That's odd - then what was the point of filing the lawsuit in the first place? As far as I remember, the original round 1 of the Milligan vs. Pompeo lawsuits got interviews for all the plaintiffs, ahead of all the others who didn't join the lawsuit.

    Basically cause he’s a US citizen. Ask for an expedite for your daughter. You should be approved especially since you have the crba. Just make sure you get her passport.

    Round 1
    Many if not all of the Plaintiffs in have moved forward in their case:
    1. Were issued a Visa
    2. Interview was scheduled and/or Case was moved from NVC to Consulate
    3. Some have already arrived in the USA

    1. Were issued a Visa
    2. Interview was scheduled and/or Case was moved from NVC to Consulate
    3. Specifically for Rio...There has absolutely been forward movement as of last week. Plaintiffs case that were stuck at NVC are now in Rio.
    4. Consulates ARE processing plaintiff cases as a priority. Anyone who says otherwise is just guessing and has no idea what they're talking about

    most of the people in the first lawsuit group gave up on VJ and either never did, or stopped posting here.  As of now, all but 6 of the original 198 (iirc) plaintiffs have either moved to the USA, gotten the visa or have an interview scheduled.  The 6 difficult cases are in non-proclamation countries (meaning not travel banned) and those cases are not moving for their own unique reasons (AP and other reasons).  
     
    To directly answer your question, I am a VJ member and we were in the first group.  We got very prompt and kind assistance from our embassy right after we sent them the email informing them of the judge's order back around December 1.  They made a special interview slot for us and we had our visa two weeks later.  There are over 100 similar cases that I follow in our private group. (fwiw, before the lawsuit, I had my congressperson try to get me an expedite, I tried 2x myself.  We were denied each time.
     
    Put simply, the lawsuit worked. (clearly for proclamation countries, which is why the new 3rd group is only from those countries).  To be complete, there were many plaintiffs in group 1 that were not in proclamation countries.  The government has processed nearly all of those visas also (see the "mooting" strategy below).
     
    The proclamation countries are still (even under Biden) not processing K-1s (except for literally less than a dozen or 2 emergencies over the past 8+ months that I've seen).  The judge has ruled that not processing K-1's in the proclamation countries is *illegal*.  (in fact 3 judges have ruled that).  Thus far the government has decided to only apply that judge's decision to the plaintiffs.  As part of their legal strategy, as our lawyers predicted, the government moved to moot the cases (meaning process the visas so there is no reason to sue) in order to get this suit to go away. There is a lot of detail behind the case and the strategy, and non-members are not privy to it.  But that doesn't seem to keep them from having strong uniformed opinions.

    We joined this third round. I regretted not getting involved with the first one, but I didn't think it would go anywhere. Now that we've seen it successful twice and lots of the early plaintiffs have had their interviews I have high hopes that this will work out.

    Can I ask you why you are involved in this you aren’t even a K1 applicant. 
     
    it’s funny how you say it didn’t help me where as there are people that have been waiting longer than I have that are still at the NVC.

    I am in Louisiana, neither of us were present in Utah, nor together, nor with the officiant physically. The marriage certificate and the marriage itself is legally considered to have occured in Utah. 

    When they asked where he was married, he answered that it was online due to COVID and explained to the officer . I had been worried about answering this way, but he says the officer was just curious about it, not judgmental and did not have any follow up questions to the answer. 

    If you or anyone else has further questions, please ask! That's why I am sharing this, because I don't know of any of successes with online marriage yet!

    To move a plaintiff ahead of others who have waited longer would be discriminatory. If that is happening more law suits will follow seeking damages for those passed over. That’s a lawsuit I would join.

    All info points to they are contacting people in order of their NOA2 approval date.  For instance, I forget the country, but they explicitly said that March and April NOA2's were going to be contacted first.

    Most of us doing a k1 would already be married if it wasnt for covid. So you can pretty much think of them as our spouse.

    Almost seven months since our K1 visa was issued one day and withheld the next over paperwork that the Embassy claimed was needed when in fact we have the personal copy of the NBI that was returned by window 37 during the initial document screening.   This whole process has been an outrage and I agree we need to spread the word through proper channels as to how bad the K1 process is being handled.   Took just a little over 4 months to process the 129f and now almost a year getting paperwork out of the American Embassy in Manila.   WHY?

    When my step daughter started school she had an extra ESL class, basically 1 on1 class while rest of class was doing other things.  This was grades K-2. She won’t need it for grade 3 as she’s now at the same level as the class.

    Well if you start having trouble, bring them to Honolulu, Hawaii.  The largest high school in the state, students wise.  Where over half the students are Filipino, and half of them are immigrants.  No acceptance problem here.

    Why dont you go to a Public notary, they probably have a Marriage license around just have to fill it up.

    The big is getting married no matter what before the 90 days is up. This is paramount and needs to be done.... You can always do AOS later on.
