I am looking for some information on what lawsuits have been filed and if there are any that would benefit my fiancée and her two kids. 

 

I have read and been provided with conflicting information. Someone said that the Philippines is not part of any current lawsuit. A December 2019 filer for a Filipina beneficiary said he was part of a lawsuit and they were just approved.

Lawsuits for what?  United States DOS has no impact over COVID lockdown processes in the Philippines or any other country.  

 

If you haven't yet even had an interview, there is absolutely no point in attempting a writ of mandamus.

Per the other petitioner, he and his fiancée were plaintiffs of some lawsuit and it got their case moving after having been stuck at NVC since May of last year.  Ours has been stuck there since last summer.

Yeah, I don't think that can trump any local COVID restrictions or force the embassies to prioritize K interviews over others.  You may still be able to buy into it though, not sure.

The Milligan vs. Pompeo lawsuit concerned K1 applicants covered by certain regional proclamations, which does not include the Philippines. Source here: K Visa Processing Update (state.gov)

On November 19, 2020, the U.S. District Court for the District of Columbia enjoined the government from suspending K-1 fiancée visa adjudications for the named plaintiffs in Milligan v. Pompeo due to the regional COVID-related Presidential Proclamations (P.P.s) 9984, 9992, 9993, 9996, and 10041.  These COVID-related regional proclamations suspend entry into the United States of aliens who have been physically present in the People’s Republic of China, Islamic Republic of Iran, Schengen Area, United Kingdom, Republic of Ireland, or Brazil in the 14-day period prior to their entry or attempted entry into the United States.  K-1 visa applicants who are named plaintiffs in Milligan v. Pompeo and subject to a regional proclamation should contact their nearest Embassy or Consulate for guidance on scheduling a visa interview.

 

 

The petitioner below was likely part of a different lawsuit. Curious though, did you get any other information from this person? @NoMansLand2020

I've heard this rumor a lot. No proof or persons actually named. It is definitely not from that lawsuit. This affects when USA bans. So mostly shengen country. Plus only half of that lawsuit was moved forward. They talked about this on a live stream on Facebook. They do updates often for all the lawsuits they have.

They are December 2019 filers, like myself and the petitioner has an account on VJ.

Thanks!! this was the first I saw the name for this. I still have some doubts, talking to a few lawyers in my family this cannot be if it just one person. This would have to apply to all k1 visas. There would have been other factors to be expidited. We will see shortly as the next batch of plaintiffs are added. The lawsuit only covered from the judge issues where usa ban travel to the country. USA never ban PH. The local "conditions" that don't allow is from the embassy and PH. The lawsuit would not have covered it. Maybe they got lucky and someone saw lawsuit and just passed it through?

I have no idea. I didn't get involved in any of the suits because I thought they were more of a "sign this petition" deal and wouldn't get anywhere.

I agree, just going to @Dougefresh56 's profile and looking at his post history, looks like he had another reason to expedite (petitioner's medical issues).

 

Hello @Dougefresh56, hope you're feeling better these days. @NoMansLand2020 is saying you expedited your case through a lawsuit? If I've guessed correctly, you filed an individual lawsuit to have your case speeded up, and not a class action lawsuit like the ones involved in Milligan VS Pompeo?

While I appreciate that. It was not the reason my case was expedited. It was the lawsuit Milligan V Pompeo that got it moving. The Government wants to have the lawsuit dismissed. So they are pushing plaintiffs out by adjudicating our visas. I did not pay 5,000 dollars. 
 

my expedite request got denied. 
 

It was the Lawsuit. PERIOD.
