    Be patient and don’t give up yet. If you do that it will have impact on your new application. What is your timeline ? I am an October 2018 filer.

    Please guys don’t judge me but this journey has been to hard for me. I’m about to give up and file through my husband again. We are still together. Have anyone been in this situation before? If I filed through him do I have to disclose that I had filed for Vawa? Are they going to question about my Vawa in the interview?

    You attorney knows the details of your case so trust on her. Maybe would be good listening a second opinion but remember : Consider only the opinion of lawyers who know the details of your case.  Do not believe everything you read here because they don’t know your case.  I think here is an excellent source of general information only bc each case is different.  I wish you good look and keep your faith always. Don’t let people let you down. You know your marriage was real so put all your effort on getting evidences to overcome immigration decision.

    thank you so much for sharing your story and also valuable info "one day". this boosted my confidence, I ve been really mood off/upset seeing their RFE. They claim that we never lived  together, although we lived together. I will submit more affidavits from friends and others.

    You told USCIS already how was the living  arrangement between you and your husband. USCIS will not take into consideration your residence now regarding the time that you lived with him.
     
    It doesn't mean because he was not coming home often you can't prove commune residence.To prove residence get affidavits from friends stating you lived with him, if they visited your home and your husband was there they should mention when they met him, ask them to describe your house, if they were there for lunch or  dinner etc.If they attended any party in your house and they saw your husband there. Ask the landlord a letter that he saw your husband several times in your apartment. Ask your family to write affidavits for you if they saw your husband in your house through FaceTime or Skype, how many times they saw him, when and if they talked or not .If you used to go to the church and he went with you ask a letter from the priest/pastor stating he/she saw your husband there a few times and specify at least month and year. Gather all mails that arrived in your house with his name.

    Hi Dear
    You got enough residency proof to show since he used  to go spend weekend with you in Florida also you got the lease and Bill's under both of your name, I dont think it is a good idea to reconcile with him and go back to New Jersey just to gather another proof of residency over there.

    Sandra may sound harsh but she is telling the truth. A man that can abuse you one time will not feel any remorse doing it another time. In fact by accepting him back you are putting yourself in danger. Act nice with him but never never forget what he did. save all the money you can and get the f out . You need freedom and peace,=. You abuser can flip in a matter of second. I almost believed my abuser until he started kicking me in the head because I went to the park with  my toddler and came back at 8pm.

    They are trained..believe that and put your trust in God!🙏 so what is this I'm hearing now...your husband married you before he got a divorce? No alarm though..if it was unknown to you..I've read somewhere it wouldn't pose a problem..but wow! So many terrible people roaming free!😳😩

    The U.S. House of Representatives passed the five year Violence Against Women Act (VAWA) Reauthorization of 2019 it has now move forward to the Senate awaiting approval is a step closer.  For every each Victim of abuse in need of domestic violence programs and much more

    Then you should be fine. When you mail the forms together it will go to the mail room. They do a check that everything is there and then forward it to the service center. In order to file the 485 you need a basis for filing. Its called an 'underlying form'. Its the form you use to qualify to file the 485. For non VAWA spouses its the 130. For VAWA petitioners its the 360. The 360 is what makes you eligible to adjust with the 485... So when you mail the 485  they need to know on what basis you qualify and that there is an active underlying form. When its all in one packet they have it, when its mailed separately you need to attach the NOA from the 360 to show that. Does that make sense?

    Divorce is not mandatory ,all officers ask if the person is divorced ,it’s part of the interview .If the person is still married just has to say “I am not divorced”,that is it and the person doesn’t have to show that filed for divorce or that the person will file soon.VAWA  Law does not require the person to be divorced to obtain the green card

    It's a sign that they rejected lol, you just need to pay the fees. Did you submit bank statement? if not then you can try again submitting a bank statement and don't forget to show your income and expenses.
