    In the exact same position as you!! Coming from the UK also. 
    I’m besides myself with anxiety in regards to this. I have a great career in hospitality and have job links in my fiancé’s city, so I’m hoping that this will outweigh most obstacles.

    Since this form is so new getting definitive answers here will be challenging.  
     
    However, remember that this form is being used to adjust status from many situations, not just K-1 and family based visas, so the questions apply to different people in different ways.  Entering on a K-1, yes, you will not have income because you cannot legally work.  To answer part one of your question, yes, you should definitely include your spouses assets as household income.  100% yes.  
     
    As someone with good education and work background, and with a spouse that has a strong income, you have a lot of positive factors weighing in your favor as far as the public charge rule goes.  By the time you enter and get married and get ready to file, some people will have more concrete experiences with getting the forms in to share as well. Keep checking back and I'm sure more and more info will appear!

    have a couple questions, perhaps some of you will be able to help me out. I'm based in the UK, about to enter the USA on the K-1. 
     
    Obviously I'll ultimately be filling out the I-944. 
     
    1. Would my US-based spouse's assets count towards the 'household income'? (she owns a house/car, no mortgage/student debt)
    2. Obviously I'm quitting my UK based job in order to move. However, the I-944 asks for my income. My understanding is that the I-944 is submitted at the same time as the EAD application (meaning my income would be 0 at the point of application). Am I missing a trick here? Is there some way of getting eligibility to work prior to submitting the I-944?
     
    I've got a decent career in financial services, so I won't have any issue getting a job that satisfies the income requirements, but I only have a few thousand in savings, so there's no Earthly way I'd be able to demonstrate assets in lieu of income that satisfies the criteria. Seems counter-intuitive that I could be penalized for not having income when I don't have the legal opportunity to even pursue employment (but it's immigration, so nothing surprises me!).
     
    Any advice is massively appreciated, my other half is besides herself with worry about it!

    I have found out you will have to file I-1944 with I-485, making applying for and EAD almost a catch 22

    I know. But one of the questions on the new I-1944 asks for your EAD number. If you are filling altogether then you have no chance of receiving it before filing aos and filling the form. 
     
    it’s as if you haven’t got the opportunity to prove you can work and won’t become a public charge

    Just wanted to send an update to you all. 
     
    I had my interview yesterday.. and I’m am very happy to say that I was granted my visa abd I wasn’t asked for any evidence lol!!
     
    Thank you all for your help and advice... thanks for being a part of my journey so far!!

    Unless you are using assets to qualify, you do not need to send statements. I did not . The bank balance sections on the forms i filled out with my average daily balance. It is the tax transcripts and current paystubs that will be required and important.

    I will do it regardless... but it’s just disheartening knowing you are putting all this work in, that they ask you to do, to not even give it any thought

    we filled out this form before medical. answered no and added "VACCINATION RESULTS WILL BE AVAILABLE FOLLOWING SCHEDULED MEDICAL EXAMINATION"

    So... I actually managed to get through to the NVC on the first ever call I’ve made, today. Was on hold for almost 30mins. Nice lady. She informed me it could take up to 6 weeks to reach them. So I will try every other day or so. 
    I called them 15mins after they opened, I’m guessing this is one of the best times to get through to someone. 
     
    I will call the USCIS as well, and hopefully they will be able to tell me some sort of time frame as to when our petition will be sent out

    check the guides above for the lists of needed documents
    you can get your IRS transcripts ready
    apply online or walk into an IRS office with photo ID and SS card and ask for them
    when you do get these ,  write the case # and both names and both DOB's in the upper right hand corner so they always remain with your packet (thru out the interview and AP)

    Hi Mattie0212,
     
    In 2017/2018 My husband and I went through a VERY similar situation. He is also from the UK, less than a week after we were engaged he was denied entry on his esta, and then denied a B2 visitors visa a month later.
     
    We decided to file for the K-1 immediately after his visitor's visa denial, and after a VERY long 11 months of me only being able to travel to the UK to visit (2 weeks total time together), he was approved for the K-1 visa and was admitted into the US.
     
    He said it was brought up shortly at his embassy appointment, but he gave a quick explanation of the situation and he was in and out within 30 minutes with an approval. He decided to fly through Dublin for the US pre-clearance check there, and it was a breeze.
     
    It seems all impossibly scary and heartbreaking at the moment, but in time it will only be a blip on your radar.

    Im just looking for some insight on my situation. 
     
    I was denied entry to see my fiancé in March of this year, then subsequently denied a visa in July, when I applied for a tourist visa. We decided to apply for the I-129f and filed it in May, after my denial in March. We are currently waiting on a response from the USCIS. 
     
    I would like to know if anyone has been through something like this and how you overcame this stressful situation and what steps did you take to get a positive result?
     
    Your insight is greatly appreciated

    Oh.. well that’s misleading as the embassy website recommends you being evidence to strengthen your case...
     
    oh well... at least someone knows for next time!!
