    No. A fiancé is not a spouse for the purposes defined by immigration, if you're referring to that statement. 
     
    If you are talking about K1 in general, it is not mentioned in the EO. As it has been pointed out, it is a Non-Immigrant visa, and most are of the opinion that currently, as the EO is written, is exempt from the ban. But time will tell, there may be additional restrictions as per Sec 6 of the EO.

    The Sydney consulate has scheduled an emergency interview for my K1 visa today. My interview will be next week. I expect this means that the EO doesn't apply to K1 visas since they are willing to issue one to me.

    Sorry to hear that you keep getting rejected. I actually know of two people who got their waivers. One person got it within an hour and they’re leaving today for the US. The other person got their waiver for a flight in June.

    Yeah we are allowed to apply for an exemption if we need to leave the country. I know of others who have applied and received approval to leave - it’s not an issue. Basically they don’t want aussies to go on holidays and then bring back the virus. But if you’re not coming back in, they likely won’t care.

    I'm really not sure how else to say it....it's pretty clearly stated in the text already.
    Are you:
    1) Outside of the US;
    2) Not in possession of a valid immigrant visa; and
    3) Not in possession of a valid travel document (like AP or something)
     
    If you meet all of the above, then you are banned unless you meet any of the criteria in the subsequent section (all the exceptions to the rule).
    If even one of those does not apply to you (such as having a valid immigrant visa already), then you are not subject to the ban.

    It is quite clear  
     
    If they are outside the USA, do NOT have a valid visa in hand , and do NOT have a valid travel foil, then they are affected.. 
    .
    He holds a valid visa, he should be golden

    do not have an immigrant visa that is valid on the effective date"
     
    So if you do have a valid visa already, the ban does not apply.

    Visual Clue -  when the immigrant visa is printed is says IMMIGRANT VISA on it and a K1 does not have that printed

    This is the answer I got from the Madrid embassy. I already have my K1 visa and asked them if I can travel after the ban but I think they didn’t get my question. I guess their answer is clear enough though.

    I'm in the same boat. I'm a medical doctor and I've had my K1 visa interview on September last year, I have been on AP ever since due to the Presidential proclamation 9645. My plan was to participate in this match cycle and get my CS exam in Chicago around August this year. I've seen earlier discussions in this thread that the exemption in this EO about Healthcare professionals is not solely specific to single visa category but there's no evidence about that as they mainly specified work related to Covid. Although most of the people agree that K1 is most likely not affected due to it being NIV, I have sent an inquiry to the embassy and I will be sharing with their reply. I'm worried about the effect this might have as I've already been on AP for more than 6 months.

    Someone has summarized the EO on the first page of this thread and from that I understand that if you are a USC then it shouldn’t affect your husband. The only thing preventing him from getting his visa is the interview at the embassy. You can always try to request an earlier interview - there is no harm in trying. Hope you hear some good news soon.

    How can it be incorrect.   Only two classes of visas.  No such thing as a "hybrid" class.  K1s are interviewed at the IV unit but are processed and issued by the NIV unit

    Hi All, I have a flight booked from LHR-EWR-DEN on Sunday under an IV and I am the Spouse of a US Citizen. Would anyone like me to document what happens on immigration if you are also looking into going? I am travelling on an IR1 and emigrating for the first time. United Airlines says I can board etc.... and may be subject to additional health screening. I was hoping an update on Monday might help anyone thinking of heading out there soon.
     
    Additional - I'll also let you know if I successfully emigrate, if not, I will also update. I thought it might be helpful to all CR1/IR1 holders waiting to go.

    That’s how I’m reading it too. I just checked the legal references on USCIS and fiancés issued a k1 visa are are definitely categorized as a non-immigrant. And the EO itself states it is suspending aliens as immigrants. I’m hoping I have interpreted this correctly because I filed for an emergency k1 visa interview two days ago.

    This is really just unfortunate for those affected by the order. Not all immigrants are seeking to take jobs. In my case, I would have been coming in still employed with my current employer (we do work remotely even before the crisis), so it's not as if I'd be coming in to compete with other US citizens for work, it's really more of just changing who I pay taxes to. But it is what it is, and I'll just see if the government actually lifts the order in 60 days, but I have my own suspicions it would be extended well into Trump's next term (assuming he wins in November). The economic fallout from COVID-19 is vast, and two months is a very small amount of time to make a call that the economy has recovered enough to resume immigration application processing.
     
    That said, I'm happy for those who were able to get exempted from the EO. Don't waste the opportunity given to you. 😄
     
    P.S. Apologies if this sort of reactionary post is not allowed in this thread. The original megathread got closed, so I figured reactions should go into this one. I did my best to keep this post civil.

    If it was an immigrant visa there won’t be any need to adjust status. The K1 visa only allows you to enter the US to get married. You can leave and adjust your status or you can stay in the US to adjust your status. Immigrant visa holders enter as immigrants, K1 visa holders do not enter the US as immigrants.

    I believe it may only impact temporary visa workers. I don’t really see why they should ban K1 visas when applicants cannot work for several months. Let’s try to stay positive.
