  1. In policy highlites , it says Provides that USCIS may only reuse a previously collected BSA photograph if, at the time of filing, no more than 36 months (3 years) have passed since the date the photograph was collected at a BSA. Before covid all photos had to be within last 6 months but covid relaxed this policy old rules said Taken within the last 6 months to reflect your current appearance https://travel.state.gov/content/travel/en/us-visas/visa-information-resources/photos.html also states when they will not use one that is old photo N 400 , N 600, I 485 and I 90
  2. News reports on this are confusing some say suspended while others say paused i have looked for a white house memo to find which it is but even there , white house statements are overlaping and confusing Gavish Law Group says paused and NBC and other news media say suspended for the original countries that are suppose to be under full ban , USCIS on December 17th says https://travel.state.gov/content/travel/en/News/visas-news/countries-subject-to-visa-bonds.html Any citizen or national traveling on a passport issued by one of these countries, who is found otherwise eligible for a B1/B2 visa, must post a bond for $5,000, $10,000, or $15,000. The amount is determined at the time of the visa interview. The applicant must also submit a Department of Homeland Security Form I-352. Applicants must agree to the terms of the bond through the Department of the Treasury’s online payment platform Pay.gov. This requirement applies regardless of place of application. and all this is on case-by-case review / it seems not to be black or white but a grey area in all respects with immigration
  3. how much actual face time did you spend together? and did you prove all of it? did you decide to do the K1 within a short time of meeting? Is there a big age difference ? Have you filed any previous petitions? Has the fiancee been part of any other petitions?
  4. if you check online , there are several organizations like Immigrant Advocates & Allies and Church World Service and IRAP that are pushing back to fight this ban (for a varitity of reasons. they probably have more legal assistance than any of us can afford “Eight years ago, IRAP led the fight against the first Muslim ban. Lawyers and Americans from communities across the country came together to push back on President Trump’s politics of division and fear, and we continue to do so today.
  5. Having a Green Card (officially known as a Permanent Resident Card allows you to live and work permanently in the United States. no need for separate EAD From USCIS site https://www.uscis.gov/green-card
  6. it does say this under the medical exam rules for those already in the US / i could not find info on the exact question you are asking https://travel.state.gov/content/travel/en/us-visas/immigrate/the-immigrant-visa-process/step-10-prepare-for-the-interview/medical-examination-faqs.html Visa medical examinations may not be conducted in the United States. An alien pursuing a visa application abroad while physically present in the United States must have the medical examination conducted by a panel physician approved by the visa issuing U.S. Embassy/Consulate.
  7. Each case is decided on case-by-case basis so attorney may think yours is strong Did you ask them why they said to wait you paid for answers so give them a call and ask why wait
  8. pushbrk I think this is why he is concerned Page 1 in footnote 3 This applies to aliens who list one of the 19 high-risk countries as their Country of Birth or Country of Citizenship OP it says each case will be considered on case-by-case review u have been in UK since age 3 and you are not trying to bypass the system by getting dual citizenship You are not one of the ones that got citizenship by investment (Dec 16 white house statement) to conceal identity and bypass the vetting u are truly a UK citizen you have the ESTA and that is also in your favor the very best to you and spouse
  9. What you all face now is the Holiday slow downs -from thanksgiving to New years many offices tell staff (not just immigration ) to use their built-up vacation time or loose it with the new year 3rd quarter stats showed over 11 million pending petitions (all petitions) end of the year i have not found (fiscal year is Oct to end of september for immigration) 3rd quarter stats are here https://www.uscis.gov/tools/reports-and-studies/immigration-and-citizenship-data
  10. Receipt for the petition is the only notice u will receive unless you get a RFE the next notice would be in about 12 to 17 months and would be the NOA2 as case sent to NVC USCIS does not keep us notified / probably because at the end of the 3rd quarter, they had 11 million pending cases (all case types) end of the year report i have not yet found
  11. you must respond to the RFE or the case will not continue and please , i know you like Caps but set your caps off and write all in small letters if u have to
  12. you would not be able to consumate the Utah marriage in Syria if family is serious about the religion / like maybe not even able to stay in the same house or room There is one way/ convert in Syria and marry there/ this does not mean you have to practice that religion in the USA even can convert back if your religions demands it to be done formally we are of 2 different religions in my house Just respect her religion and be supportive of her needs to practice it My wife even fast with me during Ramadan you need to agrree about children and what u will teach them in regards to religion / this could be a factor down the line so talk about it now
  13. and I am still upset with the whole process after our 6 year ordeal been married now a few months short of 16 years i do understand some issues like big age gap but why do some (really weak cases) fly thru the system
  14. interesting read especially since 119th Congress is a 2 year Congress https://www.congress.gov/bill/119th-congress/house-bill/6225/text
  15. what visa? Is this 3 year N 400 based on USC marriage? Does USC claim you, if so? are u on anyone's tax returns? In your case a consult with good tax attorney (not CPA) would be advised you r right that gifts do not need to be claimed $19000 in 2025 and $18,000 in 2024 but this is assuming the giver is filing US taxes and IRS rules state who pays the gift tax Since , I believe your father is not in the US and doesn't file returns here, u need to know the rules / you do not have to include the gift money as u stated (under the threshold) but officer is gonna want to know what money u live on from https://www.irs.gov/businesses/small-businesses-self-employed/frequently-asked-questions-on-gift-taxes The donor is generally responsible for paying the gift tax. Under special arrangements the donee may agree to pay the tax instead. Please visit with your tax professional if you are considering this type of arrangement. you can certainly write your letter with proofs of father's contributions but that begs futher security checks from immigrations as cost of living index in California is well above national average at over 142% and you claim to be living under poverty level in that state / what drives California so high is housing (includes rent prices), utilities especially for u just south of LA are in the higher range
  16. you should have received instructions to bring the documents to the interview / all the documents submitted to NVC are to be taken to interview both the sponsor and joint sponsor need to provide proof of US residency (state DL is what we usually send )
  17. you'll need to pay the fee at local bank showing your confirmation of DS 160 when u get it you have to follow instructions from following site to expediate at embassy (yeah, i know, u think it is done but has to be completed at embassy also) https://www2.ustraveldocs.com/Emergency apps tutorial.pdf
  18. Congratulations to her
  19. https://www.mayoclinic.org/departments-centers/oral-maxillofacial-surgery/sections/overview/ovc-20459929?mc_id=us&utm_source=yext&utm_medium=l&utm_content=omssurgerydeptmn&utm_campaign=mayoclinic&geo=minnesota&placementsite=enterprise&invsrc=consult&cauid=188214&y_source=1_MTAwMDA5OTkxOC03MTUtbG9jYXRpb24ud2Vic2l0ZQ%3D%3D Specialized maxillofacial surgery is done at Mayo Clinic your dentist in argentina can contact Mayo clinic and the clinic can arrange treatment and help with B2 medical you will need hotel during recovery as u would not be able to travel immediately they pick u up at airport and will transfere u back to the plane for travel back to Argentina as B2 is not permanent residency surgery all is not cheap plus airfare and hotel $20,000 - $45,000 or more for complex jaw surgeries, with major expenses covering the surgeon, hospital, anesthesia, and orthodontics. Key factors are the complexity (single vs. double jaw), geographic location, surgeon's fees
  20. My 2nd rhinoplasty for deviated septum was done in Ecuador but i could not travel by plane for 2 weeks after. What i saw at CDG in paris was men that had hair transplants (in turkey) and women who did breast implants (somewhere) all bandaged and flying home. this is probably why they have issues after. I do think when the list was made it takes into consideration the costs and US is expensive
  21. she says they won't do it but never says they will work to transfer her to dentist here?? she doesn't mention she has a US dentist just wonder if anyone here will want to do her surgery
  22. Since the following has always been the policy, i assume officers were not following their own policy Your photos must have been taken within 6 months of submitting your application and reflect your current appearance. that's under photo policy https://travel.state.gov/content/travel/en/us-visas/visa-information-resources/photos/frequently-asked-questions.html they also are suppose to take photos and fingerprints after applying here in US for AOS, I 851, N 400. at biometrics appointment i am going to assume the letter is more to tell immigration officers to do the job as when reading the letter, it indicates they relaxed to much during covid by not doing biometrics because offices were closed
  23. that 's a long process that involves dr/ dentist in her country to corridate with 1 in US and if the specialists in her country that received PHD in USA will not operate, probalby a denitst here is not going to either BTW B2 visa requires her to return to home country
