Stressed about CBP interview for Japanese fiance
JeanneAdil replied to gandalf1989's topic in Tourist Visas
She will then do the process for Customs and Immigration in Toronto which is a plus Understand now that USCIS has new rule and prepare for this United States Citizenship and Immigration Service (USCIS) is responsible for administering the Alien Registration Requirement, including establishing the G-325R form and online process for registration, fingerprinting, and biometric information collection, as mandated by the Immigration and Nationality Act (INA). USCIS has established a new form, Form G-325R (Biometric Information (Registration)), and an online process for aliens to register and comply with the law. For more information about the Alien Registration Requirement, visit the USCIS website at https://www.uscis.gov/alienregistration -

She's a USC ; she has family and friends in the USA so she has support here from family and friends the income statement is needed for a visa and she is going to have to produce it / that's the jist of it if she can not produce a joint sponsor (and they only are obligated to the government -not support you 3), she needs income (job) even having a baby there are day care centers and/ or babysitters in the US / working as a new mother is not unheard of she needs to return , find work, have a US address to satisfy that section of the visa You can put a 1 year hold on meeting the requirements at the NVC stage by writing once a month to keep the case open while she returns and finds a job

Expired green card - Wanting to return

What i pick up on "Also, I got married and had children outside the U.S., will that affect my chances? " you plan to come and leave them behind as they have no status to enter the US? -
No, if your were not among those selected as USCIS overselects as some do not qualify so extras are already there and no new drawing will take place so they already have the over 55,000 selected Here's why the DOS over-selects: Ineligibility: Some winners may not meet the requirements for a DV, such as not having the necessary education or work experience, or having criminal records. Failure to pursue the process: Some winners may not be able to obtain the required documentation or financial resources in time, or they may simply choose not to pursue the visa process. Time limitations: The DV program has a time window for processing applications, and the DOS needs to ensure all visas are issued before the end of the fiscal year.

Name change (beneficiary)
JeanneAdil replied to ope's topic in K-1 Fiance(e) Visa Process & Procedures
this is for the man (husband to be ) , he must do this thru a court order as they will need to check criminal records , etc In most cases, you must file a petition with your local court to change your name. To do so, you may need to file paperwork and appear before a judge to complete the process. Find your local government website and contact your circuit court to get information about how you can legally change your name.Feb 2, 2024 -

Divorce with my wife
JeanneAdil replied to Samibra's topic in Effects of Major Family Changes on Immigration Benefits
if the children are USC / the police can demand she return them / this has happened to others and he expected them to be returned so he can do something https://travel.state.gov/content/travel/en/International-Parental-Child-Abduction/prevention/prevention-faqs.html its under what can i do if my child was taken out of the US Local police can work with you to enter your child’s name into the National Crime Information Center (NCIC) database. This will help in searching for your child. If you believe your child has already been taken out of state, you can also notify the nearest FBI field office, located by state. Some law enforcement agencies may be less responsive if there is no court order for your child. If you have difficulty getting local law enforcement to focus on the search for your child, contact the National Center for Missing and Exploited Children (NCMEC) 24-hour hotline at 800-843-5678. NCMEC is a non-profit organization that provides support to parents whose children are missing, including domestic and international family abductions. -
Divorce with my wife
JeanneAdil replied to Samibra's topic in Effects of Major Family Changes on Immigration Benefits
It is done according to Islam in a muslim country, it is legal all the husband has to do is repudiate the wife / it is done under the customary laws of the area In Comoros, Muslim divorce is primarily governed by Sharia law, with the talaq (unilateral repudiation by the husband) being the most common form. The legal system also incorporates elements of French civil code and customary law, leading to some discrepancies, particularly regarding women's rights. While the constitution states equal rights, men have a legal advantage in family matters, including the ability to divorce unilaterally and the right to polygamy. USA accepts both foreign marriages and divorces when legal in that country OP are your children USC;s ; if so, call 911 and report them as not returned to you / get help from the law and don't take an answer like "we can not help u" they had to return a son to his Cuba father (several years ago ) when other family tried to keep him in the US yes, he can -
https://travel.state.gov/content/travel/en/legal/visa-law0/visa-bulletin/2025/visa-bulletin-for-may-2025.html Brother/sister of USC is F4 PD is not current USCIS approves the petition and sends it to the NVC, but the NVC will not process the petition for an immigrant visa interview until the PD becomes current, according to the U.S. Department of State. The NVC will then notify the applicant via a welcome letter or email once the PD becomes current or is likely to become current soon, according to Nolo.

Police clearance from the usa
JeanneAdil replied to Riccardo Nastasi's topic in K-1 Fiance(e) Visa Process & Procedures
USCIS will do the US FBI report The FBI — Federal Bureau of Investigation (.gov) conducts FBI reports for US visas, specifically through its National Name Check Program (NNCP). The NNCP searches for individuals' names and potential matches in the FBI's records, including name variations and phonetic spellings, to determine if there are any criminal records or other relevant information. The FBI processes these checks based on requests from federal agencies, including USCIS (United States Citizenship and Immigration Services). -

Is the I-130 Approval Process Getting Longer Because of Trump?
JeanneAdil replied to NMinLasVegas's topic in Philippines
USCIS Puts out stats on each quarter for all visa categories Fiscal year ends September 30 and YTD total for 2024 family based petitions was 981,202 received (2,194,373 pending -before Trump) 1st quarter of 2025 67,742 (already ) and the pending # has gone down to 1,448,873 So, the # of petitions received that makes it slow or go the following would have a big punch in processing all visas but i haven't seen news since February on these embassy lay offs maybe another member had WASHINGTON, Feb 13 (Reuters) - President Donald Trump's administration has asked U.S. embassies worldwide to prepare for staff cuts, three sources familiar with the matter told Reuters on Thursday, as part of the Republican president's effort to overhaul the U.S. diplomatic corps. The sources said some embassies had been asked to look into reducing both U.S. staff as well as locally-employed staff by 10% each, with a list of the workforce due to be sent to the State Department by Friday, which will then determine further actions. trump is targeting ilegals, F1 visas and a few others as far as i can see , he is not talking about family based visas except in his list of 43 countries that he wants banned or extreme vetting needed i would like to see more honest and reliable news reports if anyone has them as there is a lot of fear mongers out there -
both US and Canada border patrol are going to question how you are supporting yourself for the year as u can not work in either country on tourist visa / not even online

Overstayed, will he qualify?
JeanneAdil replied to Don0's topic in IR-1 / CR-1 Spouse Visa Process & Procedures
you do not need a lawyer to apply as the following is the normal rule for I 130 petition https://www.uscis.gov/family/family-of-us-citizens/provisional-unlawful-presence-waivers read about waivers Typically, aliens cannot apply for a waiver until after they have appeared for their immigrant visa interview abroad, and a Department of State (DOS) consular officer has determined that they are inadmissible to the United States. -
