  1. its always best to see what the US embassy says in your country as the embassy has to request cases to NVC and there seems to be a long queue https://lr.usembassy.gov/visas/ Visa Appointments Visa services for both nonimmigrant and immigrant visa cases have resumed; however, due to the demand for visa appointments, the earliest available appointments may be many months in the future.
  2. Things CO will consider 1. Was spouse in college and only working part time and that's reason for low income in the past 2. is his job new or he went from part time to full 3. cost of living in NYC (although the poverty income is the same for lower 48 states , some cities like NYC and Miami are very expensive) 4. how long has he worked and how long has he worked for this company and any of the red flag warnings that u can see as posted by NOLO law https://www.nolo.com/legal-encyclopedia/red-flags-that-make-uscis-suspect-marriage-fraud.html USC should be ready to provide a qualified joint sponsor
  3. Son needs to be filing US tax returns as he is USC He needs US residency and at the 2nd stage of this process , he needs to have US income to support the household size he would need to stay living in the US and show he can purchase health care insurance for the parents Otherwise do not qualify for reasons stated above by others
  4. Beginning June 4, 2012, immigrant visa applicants who are applying for a waiver of a ground of inadmissibility from outside the United States will file the Form I-601, Application for Waiver of Grounds of Inadmissibility, by mail with a USCIS domestic Lockbox facility, rather than with a USCIS international field office, or a U.S. Embassy or Consulate. https://www.uscis.gov/forms/all-forms/centralized-filing-and-adjudication-for-form-i-601-application-for-waiver-of-grounds-of
  5. If u were married in Texas, how did the county or state error by putting Colorado
  6. Petitioner has to report all income as noted on the tax returns Self employed -she would put her address on the I 134 as she works from home as u said she has 1099 k Form 1099-K reports payments from payment apps or online marketplaces when the gross payment amount is more than $600 and from credit, ...
  7. I wish all consulates followed the same rules it sxxks that they don't Sorry i did not know and i apoligise
  8. Many went thru interview (during and following covid because of inabliity to schedule medicals) and then did medical it puts u in limbo but still is faster than rescheduling I was assuming tickets were to fly to interview from her home
  9. Still attend the interview during covid many could not do the medical and the embassy put case on hold while waiting for medical exam results its faster than trying to reschedule nterferon-Gamma Release Assays (IGRAs) are whole-blood tests that can aid in diagnosing Mycobacterium tuberculosis infection
  10. all pages of I 130 even if there is no info about u on it this will be the same later when u submit the I 864 and all pages of IRS transcrpts (much may be not filled it as it doesn't pertain to u but immigration can not guess at that-it needs to be seen)
  11. With the tax transcripts , proof of US residency is needed like state ID or DL Why? because its possible to do tax returns while living abroad and put a US address on the return I did my US taxes for 2009 from Morocco in march 2010 when i was there to marry Joint sponsor and u both have to show living in the US
  12. yeah, u should also have a health care notice where u added him to your plan with the date after child's arrival (which would follow his immigration stamp)
  13. I can only relate my experience with Filing a EOIR and what happened U may get a NOIR or NOID They sent me a colored paper saying i could appeal with EOIR 29 form What is Form EOIR 29? The Notice of Appeal (Form EOIR-29) asks for specific details about the underlying application you filed with DHS. Please refer to the decision of the DHS Officer for specific appeal instructions and for the requested details about the underlying application you filed with DHS. I did /this took little over a year and our marriage was declared bona fide but told me to reapply (another 2 years)/ Basically i could have reapplied and skipped the EOIR by addressing a couple of issues with the new petition. when doing the RFE for the issues , u need ACTUAL proof of why the CO is wrong CO says u and he did not agree on some answers / u need to find chats or emails where u discussed these and see if it is because of the language differences or not understanding u and being confused. I can only say in our case the CO said "Does she like to read?" and he said , 'Yes" CO asked what books and he said the classics and CO asked latest book and he told the CO "it is about the exploring Dead Sea but i never told him the book title/ Book is Narrative of the United States' Expedition to the River Jordan and Dead Sea" Our whole discussion on this was written in a yahoo chat where he asked me what i did all day . that conversation turned to how my life had changed with death of my husband and me quitting racing. I also had said i read online to research items for my mom who was writing her 3 books and he told the CO that and CO said that wasn't reading. I ended up explaining what i meant by The Classics and what types of racing i did. This type of actual proof that things were discussed and words like the "Classics" meant nothing to him because of cultural differences and what u may have done to make him understand your life, your interests, your family, even your climate (all the things 2 people should talk about so he and u know each other well to have a life together. Actual proof of what u talk about and experience together and how you each perceive Now, u must wait about 6 months to hear about the NOIR/NOID and answer the CO with ACTUAL PROOF not a "say so" answer as to why CO is mistaken You will be given a timeframe to get these answers submitted if u do it as RFE otherwise, find your proofs and submit them with a new I 130 So, ask him now about the CO interview and start preparing your response /I will say your husband probably knows what went wrong
  14. expedite requests are for hardship of the USC https://www.uscis.gov/forms/filing-guidance/how-to-make-an-expedite-request#:~:text=You can generally request expedited, top right of this page). There are 32 countries at war with Burma (Myanmar) civil war lasting now 60 years i would expect a long AP for Iranian after the interview for additional security checks so prepare especially with K1 and understand a petition does not guarantee a visa will be issued /many of us are denied and have to follow thru with CR -happened to me
  15. proof of resdency like parent's state DL, bank account statement copy of his birth certificate with parent's name his passport page(s) showing date of entry to USA copy of your natrualization or US birth
  16. All supporting documents need to be originals
  17. USCIS does not schedule interviews Case goes to NVC from USCIS and after all the work is done there, u will be in queue for embassy and NVC to schedule interview
  18. Congressman can inquire about your case only the answer would be same answer u already know "Case is dq at NVC stage and is in queue waiting the interview to be scheduled "
  19. Does she have legal residence in Egypt or Thailand? That is the requirement to ask the embassy to accept your case
  20. Marriage visa is superior in many ways mostly lets him work , get DL and SS number easier but u are almost to interview so , do not let this dishearten u CR1 do wait longer at NVC for interview as there are documents to be checked at that stage but u should hear in less time Have u checked the word portal that takes u to Moroc site and looked at timelines of others going thru the K1 process / there is a list on the right of approved and those scheduled for interview
  21. the children need to be listed as stepchildren on the ds 260 The USC may not claim them due to his divorce agreement where that agreement will be seen and divorce papers have to be included at NVC and embassy and he pays child support for 2 of them so they are part of his household the older child may be part of household if he lives with his father and is supported by him even if not underage
  22. you can only adjust status thru current husband or with a divorce and a divorce waiver finding a new husband while still married does not look good i would suggest going a little slower i am not judging just looking at this from the eyes of immigration hope u can be happy perhaps get a consult with a good immigration lawyer
  23. yeah, we have to stick to question asked by poster and create a new post to ask a different one don't worry about it u r new
  24. she should not bring paperwork like a resume , that make it look like there is intent to stay as that alerts CBP Look at your state requirements to marry and don't even bring a birth certificate unless it is needed to get married Marry here if granted the tourist visa and she returns home after your honeymoon/ don't misuse the tourist visa and try to AOS as this reuins it for others that follow the very best to u both
