TRAVELING TO THE US is the phrase here that is needed as u need B1/B2 to get off the vessel but those ships leaving the US need D visa as u state above Those who will provide services on board a commercial vessel and who meet the requirements under INA 101(a)(15)(D)(i) above are classifiable D. Coming to US on B visa to board and work would be commercial vessels not licensed in the US like the Norwegian cruise ships which a crewmember would be working not under US visa but the country of the vessel license -

JeanneAdil replied to jack09524's topic in K-1 Fiance(e) Visa Process & Procedures
Since u r coming on a K1, your work and income are not important for the interview the income of the USC is what is looked at U will not be able to continue your present digital photography or do any other type of work in the US until the AOS process is complete and u have a EAD or 2 year green card to work -
As mentioned "The totality of circumstances" in your case is important On SSA you receive medicare and can not add him your part time job would also not have full health benefits So, it would have been up to u to show u researched health care providers in Ga and could afford his That aside did u send the 1099 for SSA along with your W2 as otherwise the CO would have looked at AGI https://travel.state.gov/content/travel/en/us-visas/immigrate/i-864-affidavit-faqs.html#:~:text=Financial sponsors can only include, the value of their home. Assets: Financial sponsors can only include assets that are convertible into cash within one year and without considerable hardship or financial loss to the sponsor and his/her family. Examples of assets easily convertible to cash are savings, stocks, bonds and property. Sponsors may include the value of their home U can include the home but u needed an appraisal, the mortgage lender recent page of lien(s) to show actual asset along with proof it could be sold in a year but savings, etc are more important what u do not mention is both ages and is it the norm in spouses' country to marry a widow? HIs country is important your ages are important not of child bearing age for some countries is important the actual time spent together is Very important for some countries and understand the CO must not only protect the USC but needs to protect the immigrant

A Few Questions from a Newbie
JeanneAdil replied to sonnyboy0323's topic in K-1 Fiance(e) Visa Process & Procedures
38 is left blank/ she is not here and do not include a local office on any form /that is also for those who are already here , we say K1 is expensive as the cost to adjust status once in the US is costly, with fees going up April 1st; the immigrant can not work or travel outside the US until the AP is approved /all this makes it harder to get SS # , DL ,, add to bank account -
Applying for Firearms ID
JeanneAdil replied to Pats5415's topic in Moving to the US and Your New Life In America
Not just state by state but in some states like NYS ,its county to county In TN we now do not need a concealed carry permit /that is a new rule In Tx, LPR can buy a gun NY city no, only authorized personal are allowed hand gun permits TN you can even carry a gun into a business UNLESS the facility posts on the door "NO FIREARMS PERMITTED" If you are a resident alien or a citizen you may buy a gun in the USA. according to ATF https://www.atf.gov/firearms/qa/may-aliens-legally-united-states-purchase-firearms An alien legally in the U.S. is not prohibited from purchasing firearms unless the alien is admitted into the U.S. under a nonimmigrant visa and does not meet one of the exceptions as provided in 18 U.S.C. 922(y)(2), such as possession of a valid hunting license or permit. -

DIvorce in NYC
JeanneAdil replied to vamphog's topic in Effects of Major Family Changes on Immigration Benefits
It is a requirement you are not legally separated and the following is from NY Bar for "No fault " divorce If the lawyer wanted $5000 he might have been going for "grounds" for divorce for inhuman treatment and that's more intense https://nysba.org/legalease-divorce-and-separation/#header1 The other (“no fault”) grounds are: one year of living apart under a separation agreement; one year of living apart under a separation decree granted by a court; an irretrievable breakdown of the marriage for a period of at least six months, provided that one spouse has so stated under These “no fault” grounds afford New Yorkers a basis to get a “no-fault” divorce, in which neither spouse is judged to be at fault. Unquestionably, the “no fault” laws will provide a disincentive for people who wish to challenge the basis for the divorce. -
Adopt minor sister
JeanneAdil replied to Zongkeh's topic in Bringing Family Members of US Citizens to America
It would be the USC applying for the I 130 the following is from the USCIS site on adoption relative a so the USC needs to live with the child for 2 years https://travel.state.gov/content/travel/en/Intercountry-Adoption/Adoption-Process/how-to-adopt/adopting-a-relative-for-immigration.html#:~:text=Yes%2C you will need a,adoption services have been provided. INA 101(b)(1)(E) requires the child to have been in the legal and physical custody of, and resided with, the adoptive parent(s) for at least two years prior to filing the Form I-130 petition. If the child is or was habitually resident in a Hague Convention country prior to the adoption and the adoption occurred on or after April 1, 2008, the two-year legal custody and physical residency period generally must be satisfied outside the United States in order for the Form I-130 to be approvable. There's a lot of reading u need to do to understand all that is involved especially since the father is still alive /and i mean a lt of reading Very important to answer as others have asked "What country?" -
