  1. #0P this is very direct but before u continue this spouse process and pay the addtional fees , u need to know this person is coming to u not using u as a backup for a green card if u can find out her K1 case # check the progress of it to see if it gets cancelled, denied or visa issued it will come up under immigrant visa on the following site https://ceac.state.gov/CEACStatTracker/Status.aspx
  2. that what i said "I would 1st find out if your wife intends to follow thru with the K1 and interview/ seen it happen before" this Moroccan spouse has a lot of explaining to do 1st to the USC and if he stays with her, then to the CO this is Moroc and this has been done before /usually not with 2 USC's but petitions with US and another country both thinking they are the ONLY love
  3. I would 1st find out if your wife intends to follow thru with the K1 and interview/ seen it happen before she nor u can cancel the K1 / only US petitioner can BTW u married while she was engaged to another and had a petition in progress/this interview will go thru a lot of Scrutiny during the interview. she has a lot of explaning to do. Like who broke it up? when it the break up happen? When and how she met u? i have never heard of Casa doing a Stokes interview but u may get a call to explain why u married someone who was at the time engaged to another also , u need a LOT and i mean a LOT of quality time spent together to prove this is a bona fida marriage . Casa can and has denied a CR1 and the situation is not so unigue but the timeframe is to quick to go from one USC to another
  4. transcripts list income but that can be from more than 1 W2 that's why they want to see W2(s)
  5. Exactly as i said "send IRS transcripts and your W2(s) and any 1099 /its better than a 1040
  6. did USCIS return the petition and say 'complete it" or tell u to explain i would mark it as No and enclose screen shot of 1st meeting that u mentioned in your cover letter
  7. yes, why? no one knows but if u don't want a long AP after interview, send them and IRS transcrpripts don't show actual W2's it lists income from them
  8. both need an I 864 with DS 260 and the fees do not confuse a personal written affadivit one would write and get their signature notarized with the affadivit of support (i 864) best to u and the future
  9. not true always refer to instructions https://www.uscis.gov/sites/default/files/document/forms/i-864instr.pdf
  10. all pages of IRS transcript even if they do not apply to u (IRS transcripts are best instead of 1040 ) W2 and any 1099's that show income not mentioned on the list but is always needed is USC proof of residency like copy of state photo ID or DL proof of payment of any taxes owed or payment schedule of agreement to pay if petitioner owes back taxes otherwise not needed Good to submit proof u have researched health care insurance in your state and can afford the costs
  11. Household size is described page 6 #14 for income Provide all of the information requested in the table below about yourself, all of your dependents, and any other individuals you financially support https://www.uscis.gov/sites/default/files/document/forms/i-134.pdf so if just u and fiancee its 2 unless either of u have children and its 100% for K1 125% comes in for AOS on the I 864
  12. Are u a USC? Are u trying to bring him to US on a visa? OR is he trying to return on his own? Why did he leave? Did he surrender green card and sign I 407 to abandon status? Take the answers to those questions and see immigration attorney
  13. yes, https://global.psu.edu/article/how-internationals-can-get-pennsylvania-drivers-license Pa allows u to drive a year (in PA only ) on foreign license DO NOT drive out of the state with foreign license as it my not be legal in another state I say this as if u r in Pittsburgh as indicated, u r close to Ohio and Maryland and it easy to take a day trip to see other sites Get that SS card / upon arrival that's the 1st thing to do
  14. https://egov.uscis.gov/processing-times/ for NYC NY says 7.5 months
  15. did u get receipt notice? did u get notice to do biometrics? usually that is in a few weeks
  16. Only the petitioner gets the notice now/ embassy use to (2009) send packet to bene's home address but petitioner gets notice of documents needed and makes sure all his /her originals are sent to fiancee in time for interview USPS Overnight (is cheapest and takes about 10 days for Morocco -letter package) other carriers are quite expensive Incha allah allah yekbel
  17. check # 6 and fill in VA notice of disability with monthly or annual amount and send in copy of the VA letter who is filling out this form? as u refer to the petitioner as he not me or I ? petitioner also needs a letter from IRS that says "no return listed " for this person He can get it from IRS Completed IRS Form 4506-T to the address or FAX number provided on page 2 of form 4506-T. If the 4506-T information is successfully validated, tax filers can expect to receive a paper IRS Verification of Nonfiling letter at the address provided on their request within 5 to 10 days.
  18. a person willfully misrepresented a material fact is deemed inadmissible for visa u can not lie to immigration office u want to say parents gave u enough money for a year and a half when u came to US a large amount of cash in this instance would have to be reported to CBP at POE and u worked illegally ? What to do? u can not give what u don't have https://www.uscis.gov/policy-manual/volume-8-part-j-chapter-2
  19. Several sites post fraud/scam warnings including US Department of State and romance and marriage are not the only scams they scam businessmen and ask for money to make a horoscope dream come true https://travel.state.gov/content/travel/en/international-travel/emergencies/international-financial-scams.html US embassy Algeria has good examples of how to spot a romance scam for a US visa Some of the signs that an Internet contact may be developing a relationship with a U.S. citizen in order to obtain an immigrant visa through marriage, or financial gain/identity theft are: Initial contact through unsolicited requests via Skype, Facebook, Viber, on-line gaming, or other means The person uses on-line dating sites to meet other foreign nationals Lack of real shared interests – i.e., the person on the other end parrots back whatever the U.S. citizen mentions Requests for relationships between a young Algerian man and a much older American woman. (In the Algerian cultural context it is extremely unusual for an Algerian man to have a legitimate relationship with a woman even slightly older – and especially unusual to have a first-time relationship with someone beyond child bearing age.) Declarations of love within days or weeks of the initial contact (Big one) Proposals or discussions of marriage soon after initial contact Requests to send money or provide access to financial accounts Responses to messages from the U.S. friend are along the lines “I love you/Sorry I missed your call,” or similarly one-sided conversations Request to get married in Tunisia or a third country with a single witness because “it’s easier to get married quickly there.” Note that weddings in Algeria are major social occasions, and it is extremely unusual for large numbers of family and friends not to be present at the wedding Once engaged, married, or an immigrant visa petition is filed, suddenly starts missing scheduled appointments to chat or call 1. If you suspect the romance is for a green card , offer to move to the person's country and see how fast the chats end 2. and don't assume that because u r in love, the person is too. 3. use your head / not your heart 4. when a person call u baby , could mean he talks to many and doesn't want to call u by wrong name/ make the person use your name
  20. Careful of the wording of waiting time on internet sites some say none and some say up to 180 and this can be 1. to file divorce papers 2. to be legally separated 3. or wait time after papers are signed by judge to final divorce
  21. could it be the oath ceremony was going to be scheduled too fast making 5 year rule to wait out so 3 year was better?? and if all tax transcripts were done for ROC, the IO would have them available
  22. Fee type Cost K-1 visa petition (Form I-129F) $675 U.S. State Department processing (Form DS-160) $265 Medical examination *Varies Adjustment of status form (Form I-485) $1440 if doing the AP for advanced parole I-131 $630 if done by paper Income needed for K1 if only 2 (remember to count all kids living and not living with u but u support https://www.uscis.gov/i-864p poverty guidelines left column K1 100% and right is 125% for AOS after marriage 2 $20,440 $25,550 forgot to add ROC to remove conditions on 2 year green card so add that Add all this and traveling expenses it is not fast, easy or cheap
  23. make sure that the 1 year separation is legal separation
  24. NBC doing I 751 and local office doing N-400 it will pop up in computer when N-400 is worked on but local office still has to work the process same as always and immigration has same as any government entiry a right and left hand that don't know what the other is doing what we have seen on other post from those who did N-400 and I 751 iinterview together is that N-400 will not be approved till I-751 is so that slows up the N-400
