It might take a few weeks for the case to reach NVC, be processed and then sent to the Embassy/Consulate.

But you can contact NVC to see if they already assigned a case number.

what is the immigration fraud here ? clearly confused about the post.  marriage didnt work out and he wanted a divorce. proving anything here is pretty difficult and why would ICE get involved..

You will get a stamp, in your passport, this tells you how long you can stay. Overstay, no more visa. Seems some people never travelled.

Not sure if there are two people writing this, but in an earlier post you said you were 33 years old then recent posts say you are 24. Maybe there's a confusion in the facts presented.

Could you please fill out your timeline?  In which state are you located?

My husband came in on a K1 visa and we went to the SSA office to get the SSN within a week of his arrival.  We got the SSN in about 10 days.  We were able then to get married and do the rest.  Having the SSN allowed us to get the joint account, medical insurance, etc. while we waited on the AOS to be approved.  We live in Florida, so we got to be able to do a lot of things with his SSN while we waited on the AOS/EAD/AP.  Unlike other states, we were even able to get his DL as a regular one (10 year valid) and did not have to renew every year or when the GC transitioned, etc.  However, this varies per state and some states are less familiar with immigration than others.

My suggestion would be to just go to the local SSA office as soon as you can once you arrive to get the SSN.  Then, get married, and submit the AOS with all the proper documentation and your assigned SSN.  One thing to note:  As soon as your AOS is approved and you get the 2-yr GC, please make sure you go back to the SSA office to get the restriction on the SSN card REVEMOED (a restriction will be printed on it when you first get it).  Removing this off the SSN card after your AOS approval and BEFORE your GC expires will help with a lot of things once the waiting time comes between the expired GC and the approval of the ROC (this is going to be a few years from now).

Why don't you take the TOEFL in Spain?
That way you can come back to the US directly to do your master's.

My husband has a terrible habit of leaving things in his pockets. All sorts of stuff has gone through the wash - pens, wrappers, receipts, money, electronics, keys, candy, ketchup packets, remotes... you name it. This extends to also just leaving things in there he's totally forgotten about. The TSA agent got really huffy when he discovered shredded old gum wrappers and pocket fluff. He really thought he had something there.

There was also the melted chocolate bar incident - TSA agent mortified with dirty fingers which then got smeared into his trousers. Oh and the half opened ketchup packet. It's also amazing the stuff he's accidently brought over that they somehow missed on the carry on baggage scanner! He had no idea his dad had previously stored some tools in a piece of luggage and had forgotten to take them out.

It's my experience the TSA agents don't really want to be all up in your business in the first place, as they are miserable people. They will do *anything* to avoid it. Practically begging you to just get in the scanner. Then they will make you wait a long time, and at our airport make a spectacle calling someone until they find some agent from somewhere across the airport willing to do it. They will be grumpy by the time they arrive for what special purpose they've been called to the scene. But mostly they will be mortified to do it, and in the end they might get something to laugh about.

i really want to thank you all for caring and giving me advise. i'm sorry for confusion if i caused so i want to summurize everything again. i hope i'm clear now.
if you can read it again, give me advise, i would really appriciate. i can explain more if you need to know details.

1 - i'm 24 year old spanish citizen and i went to us embassy to get F1 visa to get my masters at northeastern uni in boston. (masters in criminal justice)
2 - school gave me conditional acceptance because my toefl score was low. condition was to come to boston, finish language school(SCHOOL A) (different than northerstearn, but their partner) and start my program next year. When i went to embassy, the condition was there so i didn't lie or hide it.
3 - i arrived boston last year(10 days before my class starts). their tution increased a lot, cost of living in boston was more than i guessed so i decided it would cost so much and i wanted to find cheaper option for just language school.
4 - i researched and found a school in chicago. went to my friends place who went to this school. this school (SCHOOL B) was cheaper, i also found a roommate for a lot less price.
5 - i contacted SCHOOL A to transfer me to SCHOOL B. They did it. I got A NEW I-20 from SCHOOL B.
6 - i have no way of checking transfer process, i just asked my school "if everything is fine" they said "fine you are good"
7 - I went to SCHOOL B for 9 months. no issues. learned a lot. getting ready to take toefl again.
8 - Had to move back to spain for 2 months. i spent a month in spain to find sponsor. now i have it. SCHOOL B gave me a new I20 before leaving us.
    9 - now i have valid F1 visa with SCHOOL A, and I20 from SCHOOL B.
10 - I read it is fine(having f1 visa from another school) and very common to re-enter in this case, but i want to ask you guys. i also read i don't need a new visa.

I really didn't make any illegal move or mistakes without knowing but i'm dealing with a system i don't know well and im worried something can be missed in all of this.
i was told many students change school, nobody care as long as you have valid visa and valid i20 document and valid student status. now i get different views which makes me worry.
thanks again, thank you a lot.

Not that I want to scare you - and the cases I'm talking about were not for naturalization- but there have been members whose cases were denied after rescheduling because in the system it appeared as if they did not attend the interview.

Of course, those are the ones that post in the forum because they had an issue. Many must reschedule and everything is fine.

My point is that one should do everything to minimize the risks.

For instance: we are still waiting for an interview to be scheduled and we definitely don't want to reschedule, so we book two week vacations, two weeks in advance.

Really? Not that I doubt what you're saying now but the use of the word "miraculous" sounded more like sarcasm to me.

And if the master's degree is serious, it definitely requires a level beyond writing short paragraphs in a public forum.

It was a snarky remark at your level of English. The person that posted cannot believe you have learnt so much in 9 months -called it miraculous- and thinks you do not need to come back to the US to learn more -actually thinks you're ready to teach English rather than learn it, given the command you've shown on your posts-.

Whoever commented is basically implying that you might want to come back to the US not necessarily to pursue a degree but to immigrate.

Allaboutwaiting reacted to thoracicarnold in Work Visa rejected 4 years ago, ESTA approved in August, successful entry this weekend
    Hi!

I thought I'd just report in with some good news and for anyone with a visa rejection on record that may like to hear. I was rejected for a temporary work visa back in 2019 and given a 214b rejection.

I plucked up the courage to apply for an ESTA in August 2022 and to my surprise, it was approved. This month I finally felt I was in a good position to try and visit the US. I'm currently on a temporary work visa in Canada - I have a job here in Canada which I've been in for just under a year, and a rental agreement, I'll also shortly be applying for permanent residency in Canada, and I have a trip booked back to my home country next month as well as a few other trips. Aside from that, I didn't feel my ties were massively strong (well, to me they are, but maybe not from CBP's perspective). I went on a weekend trip via a land border, and I was also with a Canadian citizen who has nexus - so I think this might've also helped. Got asked a few generic questions such as what my job is, what we'd be doing, and when we were leaving. I was worried that some questions about my visa rejection would come up, and was also concerned that as we were travelling via car then I'd have nothing to prove that I would return back to Canada a few days later (though I did have proof of flights out of Canada the following month as mentioned) - but not to worry, this wasn't a concern from the border agent and I didn't need to mention or show any of the documents I brought as proof that I'd be leaving.

All in all a very smooth process and I'm very relieved to have been able to visit the US again as I spent years reading this forum and worrying about not being approved an ESTA or not being allowed in due to my visa rejection, or not having strong enough ties to Canada.

Don't listen to everything you read online like I did  totally convinced myself I wouldn't get in. Perhaps it was luck, perhaps it would've been different with a different agent.

It was a sincere compliment of OP’s language skill…and a bit of shade to the many language universities on ICE radar ( many shut down others under investigation).  Perhaps testing again the scores would certainly exceed minimum…and help right the course for the degree program.
