    Tne NOIR gave u a chance to overcome the CO decision
    you did respond  but your responses must not have had the needed proof to overcome the visa denial
    in responding to a NOIR u don't just say "this is true"  u have to show proof a statement is false
    example :
    CO says u didn't meet in last 2 years before applying
    so,  u send copy of boarding pass to his country along with photos of the 2 of u together during the visit (date stamped in a computer or cell phone is even better)
     
    When u get the NOID,  the USCIS did not accept your answers to the NOIR as proofs
     
    Appeal?  what would u do now to appeal? U did not show proof with the response to  the NOIR
    BTW I did an appeal and in normal pre covid ,  it took over a year and the notice from the court said,  "marriage was declared bona fida so i could reapply"
    but i had actual emails that showed proof of the 2 issues the CO had / emails that were sent back and forth to each other when we first started talking / things about what we each liked and disliked
     
     
    U can reapply and try to overcome the issues or move to his country

    It was revoked by USCIS. It was sent back to USCIS after being in AP for 2 years, received NOIR and responded in February, now received revocation notice.

    It's been a crazy week!
     
    Just a quick update!
     
    To board a flight from Pakistan a covid test must be taken (and negative) a few days before.  My husband traveled back to Islamabad to complete the Covid test and fly to USA from there.  He flew Qatar to (stopping at Doha) JFK  (JFK POE was quick and smooth).  He was out of the airport after landing in under 45min (this includes getting off the plane, immigration and bag collection).
     
    We both still feel like this is all a dream and so very Thankful!

    When a case is reaffirmed it is only at NVC for transit all updated documentation goes through the embassy.   The embassy will contact you in regards to your next steps.

    221(g):
    The document issued by the Department of State under Section 221(g) of the Immigration and Nationality Act (INA) is for the most part used for requesting additional information from the beneficiary such as missing documents, additional evidence, or advising them of not being able to issue their visa due to pending name/security checks i.e. Administrative Processing However, Section 221(g) is also used by the Department of State when returning petitions/applications to the USCIS for further review ultimately recommending revocation.
    Why are Petitions/Applications Returned to the USCIS by an Embassy/Consulate Under Section 221(g)?
    Petitions/applications are returned for a variety of case specific reasons. Returning a petition/application to the USCIS means that the embassy/consulate refuses to issue a visa to the beneficiary, but they do not have specific evidence to actually deny a visa application. So the next best thing to do is return the petition/application to the USCIS office where the petition was originally filed requesting further review and ultimately recommending revocation.
    What Happens When a Petition/Application is Returned to the USCIS by an Embassy/Consulate?
    • 221(g) is issued to beneficiary at conclusion of the interview stating the application and/or petition is being returned to the United States.
    • Petition is returned to the United States by the interviewing consulate for "further review"
    • Returned petition is received by the NVC. It is reviewed and entered into the fraud database by fraud management.
    • Returned petition is sent to the local USCIS service center where the petition was originally filed and approved.
    • Local service center receives returned petition.
    • Local service center who processed the original petition sends a notice of receipt to the petitioner.
    • Local service center reviews the returned petition and consular officer notes on the case.
    • Local service center then sends either a NOID (Notice of Intent to Deny) or NOIR (Notice of Intent to Revoke) to the petitioner also asking for more proof of the relationship, many cases have specific consular objections to rebut.
    • Petitioner is given 30-60 days from date of NOIR/NOID (depending on the service center) to respond with additional evidence of the relationship or other specific evidence. The timeframe to respond will be provided in the letter.
    • Local service center receives evidence...if in the timeframe given (30-60 days) the case is reviewed and either original approval is reaffirmed or the petition is officially denied.
    • If the petition is denied the local service center sends the petitioner an 'official' denial letter. This can be officially appealed if the denial letter states such.
    • If the petition is reaffirmed the local service center sends the petitioner an official notice of reaffirmation.
    • Local service center sends the reaffirmed petition AND its evidence provided in the rebuttal directly to the consulate along with a recommendation to issue a visa.
    • Consulate notifies the beneficiary of a new interview date.
    • Beneficiary has interview for the reaffirmed petition and the visa is either issued, or the case in placed in Administrative Processing which after cleared a visa is issued, or worst case scenario it is denied via Section 221(g) and returned again to the USCIS with a recommendation for revocation.

    Yeah honestly #### people are so ignorant! And nobody understands because they aren’t in the same situation. Being a married couple and not being able to be together and start our lives especially being married for almost 3 years really sucks! It doesn’t get easier especially when people say stupid . And we’ve submitted everything in August and it’s like we’re so close but still don’t have a guarantee like it’s so hard 😭🤯

    If your case will approve,uscis will send u confirmation of approve.it could take 4 to 5 months max.
    than uscis will forward your case to nvc than embassy.
    Embassy will ask latest documents again like affidavit of support. 
    there will be second interview.

    We were not asked to.  If they need it updated they will ask as well as you'll see it re-opened on your CEAC.

    Hi Everyone,
       Our case got reaffirmed back in July 2020 and sent to US Consulate Islamabad in Nov, 5 2020. We are told to wait and response when receive any email from Islamabad Embassy. Anyone who went through same situation, what to expect next? Any info will be appreciated!

    No,  not for you but in  muslim countries,  it is extremely important to show the muslim mother approves of the marriage 
    my mom could not be in Morocco (arthritis makes it impossble for her to travel and use the hole instead of a tiolet) iand my mother in law was in the hospital when we were called to come sign the marriage certificate which meant we were married but we had proof in many other photos that she was with us for my visits and i stayed in her home.   very very important for a muslim.

    You should FIRE that lawyer who didn't object to the original petition to go through without any REAL evidence.  I understand a lawyer wants to make money but he should have some ethics knowing that the petition would most likely be denied without evidence of bona fide marriage.  
     
    I think your wife needs to do some more research if she believes that it is "culturally normal for a Muslim man to marry a Christian woman 21 years with 2 children old than him."

    Best advice is always to meet in person first before any considerations of US immigration should even be on your mind.  Take your time after that and think through things rationally.  The process is long and expensive, so be aware up-front what it will take, with no guarantee of success at the end.  If you love her as much as you say, and if she truly loves you (not for US immigration reasons), she would also be happy if you move to her country, so bring up that idea and see how she reacts.  Good luck!

    Hi everyone we hire the attorney and they get all the information about my case from uscis but only one last information they are waiting for is called CBP check Is called customs border protection what is this for I want to know about this and it's been more then 7 months we are waiting for the attorney answer whether they take the case or not this is going to be forever to be with my wife it's very hard but what we can do so helpless right now thanks

    Anytime a NOIR is involved, it's no longer "simple" IMO. Failure to not just have but also present a strong case at that point usually does not end well. this is when you start throwing in everything including the kitchen sink.
