USCIS does not approve EAD expedite request unless you have a real emergency other than job loss. You will have to provide documents to prove your claim. The final decision to expedite the request rests with USCIS.

Just read that👆. So will just asking for it to be expedited for the basis of having a job offer not work?
  2. Thanks

Not exactly 100 percent true. Depending on the employer. My wife received her EAD approval notice on a Saturday in the mail, she went to the HR department at the job she had pretty much lined up a few weeks before on Monday Morning, She went back Tuesday to begin Orientation, and on the job training. The orientation, and job training was UNPAID, and would take 4-5 days to complete. She did orientation for 2 days ( Tuesday, Wednesday) The training on ( Thursday) Her card itself showed up in the mail on Thursday afternoon, and she took it with her to work on Friday, and that is when she filled out the I-9 and all the other actual forms for her actual paid employment to begin on Monday. They technically are not required to fill out the I-9 until you are actually on the payroll, and actually they could probably wait until the end of the pay period when payroll needs to be processed.
Looks like in this case the OPs spouse began a paid job without EAD ( Maybe not, depends on how the job was set-up) but even according to the instructions on the form, it doesn't need to be completed until the first day of compensated work, I will copy and paste below....

The verification can be completed before the employee begins work for pay; The latest — three days after the new hire's first day of work for pay, unless the employee will work for fewer than three days; for them, you must verify no later than the first day of work for pay.

He might want to reach to HR and explain that while he's still interested, he's going to have to wait for his EAD.

Yeah, they never asked for that. But I know he can't keep working. Just worried what will happen that he started working. I'm not sure how cases got mixed up but yesterday they said the combo card was approved. It's a mess and not I'm freaking out.

Where did you read this? Having a job offer is a valid reason to request an expedite. You'd choose the "financial loss" category when they ask under which category you are requesting the expedite.

I had already read it, may be you need to read yours own suggestion again... OP is asking about the expedite and your suggestions is for approved EAD. OP is asking for the expedite because it’s pending.

He needs to talk to HR and explain the situation.

You know that there are separate case numbers for the I-485 and EAD and AP, right? Are you sure you aren't just mixing those up? His EAD could be approved, while his I-485 isn't.

Did his employer check eVerify before he started? If that check came back without issues, his EAD must have been approved. Then you just haven't received the card yet.

If you are 100% sure that his EAD has not been approved, have him ask HR for a job offer letter. Then call USCIS and request to expedite the EAD.

Hi, Yes. was a real human being. Wasn't a smart human but a real one. Dialed the 800 number above. Once answered pressed 1122, then entered my receipt number and press 1 to confirm receipt number. Tells you that all calls will be answered in order and then a wait time........

I may have missed this answer but has your case status moved passed "Approved" to "Card Being Produced"? The case update system can be very bad but if not it may be worth calling and speaking to a Tier 2 officer asking why.

Never mind, I send in a request because I read on there if I haven't received the approve notice in the mail by February 26 to send a request. Hopefully they send it out quickly!

I'm waiting for our AOS, EAD/AP right now. Here is my timeline:
August 27, 2019: Husband arrived in the US from UK  October 5, 2019: Married  October 8, 2019: Sent AOS in mail  November 11, 2019: Biometrics appointment  December 5, 2019: Received RFE on AOS  December 18, 2019: USCIS received our response to RFE  February 11, 2020: AP case was approved We are still waiting for EAD and AOS. I'm hoping the AP and EAD come in as a combo card and soon. The wait sucks lol.

I think it took just over a week, but that was 18 months ago so it may be taking a little longer. There was a holiday last week so that will have slowed your husband’s up a little too. I hope it arrives soon!

Assuming your husband applied for AP and EAD together when applying for AOS? If so, then the fact AP was approved on 11th Feb should mean that the EAD was approved at the same time, and the EAD/AP combo card should be on it's way. When my AP and EAD were  approved, the case status only changed for the AP and didn't change for my EAD.

It’s not the need for the permission to be in writing. There’s a need to have permission, that’s all. But when the authorities question if said permission is given the way to prove it is by having it in writing.

The above becomes more relevant depending on the state of the relationship of the parents. I can’t asses what the state of their relationship is. But let’s say they’re not on the best of terms anymore or father has an acute case of memory loss and calls the authorities, a notarised permission letter can sway the way you’re treated.

We always do permission slips for when only one parent travels with a child (to US or any other country). Some countries are picky about it - I saw a mother be almost denied boarding heading to Bosnia with her child as she didn’t think to bring the permission form. Especially needed if parent has a different last name than child.

Would they though? There are plenty of couples with kids in which only one parent takes a trip with one of the kids. They don't seem to be immigrating so I don't see why they would need to have his permission in writing for a vacation.

It could become a problem if he ends up calling the cops and lying about the situation but something has to be seriously wrong at that point for that to happen.

Can't rely on the online status,  chances are they only update one case number online but the result is the combo card

Why yes, unless she is given sole custody by means of a court order she would always need his permission (and he hers by the way) otherwise it could be considered international parental child abduction. The only question is if you have to carry proof of said permission with you to leave the UK/enter the US to which my response is: Why risk it? If he's ok with his son visiting his older brother, get it in writing, notarise it and carry a copy of the father's ID with you and all should be fine.

If the father is not willing to do that then that implies that he's not giving permission. The only other way to bring the brother along without having to expect issues is a court issuing permission or, in case of a divorce, a court granting sole custody to the mother.
  23. Thanks
EnglishLove reacted to DELETEME1234 in Family coming to visit
You're asking if the father would need to give permission for the brother to come visit? Well, typically it's more a matter of being allowed to leave a country than to enter. But if you want to be safe a notarised child travel consent form with copy of the father's ID is wise to carry around.

When TurboTax shows you a running total of your refund it is misleading. Until you enter everything, you are being mislead by that gimmick.

But  a $3500 swing sounds like you have made a mistake. Print a copy of your 1040 From the program. Check the following lines:

Line 1. Total of [your salary income] PLUS [his foreign income]. Is the total correct?
Line 8a. His income with a minus sign in front of it. Example:  -18,000

Only in as much as it will give you both how much he earnt from April 2019 to whenever he left his job if aplicable. Otherwise go from bank account as Wuozopo said this will be the most accurate if no other info. Not sure why things are doubled though
