while k1 is a non-immigrant visa, it is processed by the immigration visa unit at the state dept.  after the interview, if u are approved, then it will change to non-immigrant in CEAC just as they prepare to stamp the visa in the passport.  before that time, u will track it under the immigrant visa section of CEAC.

The beneficiary can submit the DS160 anytime after NOA2.  So if ur the beneficiary, u can submit it now.

In our case (Kuwait) the Embassy used the info from the DS160 to send P3 via email to the beneficiary including detailed instructions on what to do next. Also in Kuwait the Embassy set the interview date/time in that same email.

I dont think reponses are showing because your question is vague and your timeline/profile is blank. Based on your other posts i am assuming that u are the petitioner.  If that is the case then u dont need to do any background checks as both USCIS and State Dept have their own ways of doing it internally.  If u are the beneficiary also u dont do any police clearances for USA.

Maybe VJ ought to create a separate section for Filing with USCIS International Offices. That may be partly why folks equate DCF to Filing with a USCIS International Office.

TandSarahJane reacted to millefleur in Beginning K-1 Process while residing outside the US
What did I say incorrectly? DCF is filing at the USCIS field office abroad when all conditions/requirements to do so are met. I never said that DCF is filing at the Embassy or US Dept of State.

TandSarahJane reacted to USC4SPOUSE in Beginning K-1 Process while residing outside the US
I think there might be a gap in communication here. @Millefleur recommended to file with the USCIS International Office in Frankfurt, Germany. That is not DCF. You are filing with USCIS and not directly with the US Embassy (US Department of State).

In a nutshell, the DCF route entails that the petitioner:
    1. resides in a country without a USCIS International Office
    2. has exceptional circumstances that merit filing with the US Embassy
    3. explains their exceptional circumstances to the US Embassy, which then presents that information to USCIS. At that point, USCIS either approves the request or declines it. If declined, then the petitioner must file their petition with the Chicago Lockbox.

But ALL OF THAT is not needed because OP resides in a country that has a USCIS International Office.

See for yourself here https://travel.state.gov/content/travel/en/us-visas/immigrate/the-immigrant-visa-process/petition/submit-a-petition/filing-petitions-outside-the-us.html I also posted key info from that page below.

    Countries with USCIS Offices
Certain petitions may be filed at U.S. Citizenship and Immigration Services (USCIS) offices abroad, but these locations are limited in number. Review the list of International Offices on the USCIS website to determine if a USCIS office is located in the country where you reside.
If you reside in a country with a USCIS public office, you may either file Form I-130, Petition for Alien Relative, with that office or with the USCIS Chicago Lockbox at one of the addresses below. See USCIS Centralizes Filing of Form I-130.

    Countries without USCIS Offices
    I-130 Petitions
Petitioners residing outside the United States are no longer able to routinely file Forms I-130, Petition for Alien Relative, with U.S. Embassies and Consulates. Petitioners residing overseas in countries where USCIS does not have a public counter presence are required to file their Forms I-130 by mail with the USCIS Chicago Lockbox. U.S. embassies and consulates can only accept and process Forms I-130 in exceptional circumstances, as explained below.

Filing Form I-130 Petitions in Exceptional Situations
U.S. Embassies and Consulates may only accept I-130 petition filings from petitioners who believe they have exceptional situations that would merit an exception from filing by mail to the USCIS Chicago Lockbox.
Petitioners who believe that their situation merits an exception may contact the nearest U.S. Embassy or Consulate to request an exception and explain their circumstances in detail. Each request for an exception will be evaluated individually and must be authorized by the USCIS office that is responsible for that specific U.S. embassy or consulate.
USCIS published guidance on circumstances that may qualify as exceptional.
If your request to file an I-130 petition with a U.S. Embassy or Consulate is not authorized by USCIS, then you must file the petition with the USCIS Chicago Lockbox.

I should clarify -- DCF itself is still possible, but the compressed timeline associated with DCF processing wouldnt be because they would just forward it to Chicago.

From what I've read,  if u own property in the US then you can't file DCF.

U can file your K1 while abroad but u still file it at the lockbox in TX and use your US address.

I’d like to share about our K1-Visa process with you all! I am an American woman with a Pakistani Fiancé. We both lived in China during the entire visa process.  First we assembled our documents for 1-129F and mailed it to America on January 25th 2018. They received our documents on February 10th 2018. Our case was approved on August 20th 2018 and was delivered to NVC. We got our case number from the NVC on September 11th 2018 and they also sent our case file to the Consulate in Guangzhou on that day. The Consulate received our case file on September 26th 2018. We received packet 3 on October 10th 2018. We mailed packet 3 documents back to the consulate in Guangzhou on October 11th 2018.  We received Packet 4 via E-mail on October 16th 2018. After that we made an interview appointment for November 3rd 2018. We also made an appointment at an approved hospital in Beijing at Beijing International Travel Healthcare Center for October 22nd 2018. Due to abnormal chest X-rays, my fiancé had to do the extra sputum tests which tests for tuberculosis. The extra tests were taken three days in a row from October 24-26. The results for these tests could take from 6-8 weeks so we had to cancel the interview online and notified the Consulate about the testing. As soon as the hospital received the results (which were negative  ) they informed the consulate and mailed us the documents on the 26th of December. We received the medical documents in the mail on the 28th of December.  Also, on the 26th of December we received the email from the consulate with a new appointment date and time. The date was set for January 7th. We went to the interview in Guangzhou on the 7th. MY fiancé got a green 221(g) asking for additional documents (petitioner Domicile and Notarized Police Certificate covering entire time in China). We mailed the additional documents as well as his passport via CITIC bank on January 10th 2019. The consulate received it on January 14th.  The visa was issued on January 22nd. We received the passport with the Visa inside and documents on January 27th 2019. We are headed to the States on January 30th 2019!   Thanks everyone for your help and good luck to those still in the process!

I am certainly no expert in these matters but i do read a lot.  If u search here on VJ for others that post their experiences for NVC returned, u will find that CEAC does have the status info within a few days.  Analysis of whether the CO informed them would be only as good as what people decided to share in their posts and is likely skewed.

It really depends on the consulate and personal circumstances as to what is needed for financial documentation.  I asked the visa unit in an email as to what they needed based on our situation and they gave me a great effort-saving response.  U might check the country-specific section here and consulate reviews, and/or just ask them directly.

Although it won’t cause a denial to send it like this, despite the instructions emphatically requesting that you don’t, why do it? I’m pretty sure it irritates the USCIS lock box employees who receive hundreds of petitions every day. Make the job as easy as possible for them, not you. They will appreciate it. It’s a courtesy, like having your money or credit card ready at the register in a store, sorting your garbage into recyclables and non-recyclables and so on. It just makes the job of those providing a service to you so much easier.

Well, this might be a problem, because you stated something false and know they may think this beneficiary is lying from there on. If you where put under AP and never come out of that loop, would be better to cancel the fiance process and get married and apply for spousal visa. Just my 2 cents.
