Turns out I didn’t have to write a letter to the local office because I ended up receiving a status update today ‘Interview was scheduled’ next to my I-751 case. So relieved it’s been taken care of by them! I was planning to send them a letter tomorrow. Now I am waiting for the notice to come in the mail, I hope it’s the same day as my N-400 interview!

    Update:

I-751/N-400 Combo interview conducted this afternoon at the Dallas Field Office.  Appointment was at 1:00PM.  We were called about 1:30PM.  Officer wanted to see evidence of marriage from filing the I-751 (2019) until now.  Officer wanted to see evidence of marriage since I-751 filing.  I showed him both our driver's licenses, bank accounts, credit card accounts, Credit Cards, apartment leases (with signature page), Car Insurance.    He said, " You meet the requirements for I-751".  After the I-751 interview, he said "Now, we will start the N-400 interview".  He gave me the choice of either staying in the room or going back out to the waiting room. My wife chose to do the interview alone.    He then escorted me back out.  About 30 minutes later, the officer escorted my wife out to meet me.  She says she was asked the 6 easiest questions among the 100 possible ones.  Who is the current US President, for example.

I'm glad that interview is done!!!   Now, we wait for the oath ceremony!!!

Immigration and customs are two different groups.  We (USC’s) can be pulled into customs if they wish where immigration has no jurisdiction (none, zero) once US citizenship is established.  They can dig around into our baggage etc back in customs if something interests them.  Secondary is usually immigration (customs enthusiastically digs around anyway sometimes) but secondary is where your entry is determined or decided.
A USC who for example loses a passport on a flight would have citizenship confirmed back in secondary but would normally never experience anything like that.

In my opinion, the answer to this is pretty obvious: you were travelling as a British citizen named "Mrs. Y", and when they scanned your fingerprints, their system showed that those fingerprints belong to an eastern European citizen, "Ms. X".  Of course they are going to take you to secondary inspection to figure out what is going on.

Whether you will be taken to secondary inspection in future is only speculation until you travel again, but my guess is that you will be scrutinized more thoroughly than before.

We chose to do apply online for the following reasons:
      * No chance of docs getting lost while in transit
      * You upload your docs, so you don't have to worry that you forgot to make a copy of something before you sent it.
      * Able to view all the docs you uploaded, so there's no question as to "what did I sent them"
      * If you get a RFE for anything, you just upload for a faster turnaround/response

To each his own. The whole process was very smooth and user-friendly for us when we went through the N-400 process.
    Good luck!

You just need to wait until after January when the shot requirement is going away. For AOS - include the waiver for shots.

And there's nothing wrong if you and your future spouse do not want to take covid (or any other) shots. That's what waivers are for.

Thanks everyone for your responses. I'm aware that currently entering the US is not even possible without the vax for foreign nationals. This however, will not remain in place forever. There are currently around 130 countries on the planet that don't have any restrictions anymore. A few months, that's it.

To the person who mentioned this could get political, I don't see how. This is about personal choices and beliefs.

Also "you are willing to risk your partner's arrival to the States"... better than risking anyone's personal beliefs or even their life. So yes, definitely. We have a lawyer in place that we would hire if needed. The question is just if we would even need him, if panel physicians are told the covid vax is not mandatory for K-Visa applicants.

We are definitely willing to move to an entirely different country over this, if needed. Really just trying to explore all our options first. Hence the question if anyone who was planning on filing an i-601 didn't end up needing it.

Last time posting here. An update:

    I-751 Priority date: March 2021

    Applied N-400: August 2, 2022
    N400 interview scheduled: October 13, 2022
    Interview: Dec 1, 2022
Oath ceremony notice was mailed: Dec 1, 2022

I-751 still showing fingerprints was taken. Status since 2021.

Brought my husband with me but IO told him to wait outside. IO went straight to the N400 questions and testing. Asked 5 questions (mainly political). He only confirmed my biographical data for I-751. Asked me if I wanted to add anything new...gave him 2021 tax return transcript, car title, auto insurance update. I asked him if he wanted more info, he said he had enough. After that, he said "congratulations...you passed the test and you're approved. Ceremony letter will be mailed in a few days". Received an update in uscis case tracker a hour later that "Oath ceremony notice was mailed". Letter was available in uscis online account.

There is a two year gap between the filing date and final action date for F2B Philippines.  It is strange and unfortunate the state department has such a large gap since it leads to high expectations and raises false hopes in cases like your uncle’s.

    https://travel.state.gov/content/travel/en/legal/visa-law0/visa-bulletin/2021/visa-bulletin-for-december-2020.html

F2B Philippines was August 2011 in December 2020.

So roughly the date moves 2 months every 24 months of real time.

March 2012 minus October 2011 is 5 months.

    5/2 * 24 = 60 months or 5 more years.

This is a guess based on past performance.

I will say that some categories in the  visa bulletin  make sudden progressions. Some categories  also make sudden retrogressions.

I wish USCIS and DoS told everyone waiting each month how many people are ahead of them in line.

Well the divorce is on it’s way, it’s been filed amicably because I had leverage over her, she even paid for it.
So it’s technically not my attorney.
The divorce is estimated by the lawyer to be finalized in June/July 2023.
Okay, so that being the case, what if I could have her use another sponsor?
It’s a long shot, her stuff is still here, and think I could get her to revert to her initial sponsor, I think that would insure I’m rid of this albatross hanging over me.

midwinterrose reacted to NDL2022 in Withdraw sponsorship of unfaithful 2 year green card holder?
From what I’ve gathered so far from other sources, I simply have to call USCIS and tell them I wish withdraw my i-130 and i-864 on the bases of infidelity, and with the screenshots of her correspondences alone, they’ll grant me the removal without me being responsible for her financially.
Especially since she already has employment since May 2022 officially, it’s apart if her case files. Also, she already has a place to live outside of my residence.

Just got an update on my case: New card is being produced

No interview and I filed under a divorce waiver. Heres the overall timeline:

    3/24/2021 - Filed
    4/21/2021 - NOA1
    6/28/2021 - Biometrics
    9/29/2022 - RFE
    10/18/2022 - RFE response sent
    10/26/2022 - RFE response received
11/22/2022 - New card is being produced

My RFE was fairly simple, USCIS stated that I had sent enough evidence for the first two years of my relationship, but not enough for the third year (when we got separated).

Thank you all for the help and support and hope your petitions work out as well. I’m not interested in applying for citizenship anytime soon so I’m considering my immigration journey over for the time being.

This is what is currently on the USCIS website for I-485:

    Edition Date
07/15/22. You can find the edition date at the bottom of the page on the form and instructions.

Dates are listed in mm/dd/yy format.

If your edition date on the form you submitted is 07/15/22, then it is the current edition, and USCIS made a mistake in returning it to you, and you should be able to simply re-submit the entire package.

I do recommend carefully re-reading the letter they sent you stating the reason for return of your packet (and possibly even posting it here with your personal info redacted), because sometimes the letters list several possible reasons for returning your packet, and it's not immediately clear which one applies to you.

My husband took an entire briefcase packed with marriage evidence; bank statements, bills, taxes, photos, etc.  He never even had to open the case, they didn't ask him for anything.

His I-751 had been approved without interview about a month prior.  We also front loaded the N400 application with marriage evidence when we filed, so those factors may have contributed to the IO not asking for any documents.  Regardless, it was better to have everything prepared and not need it, than to be caught off guard without it.

midwinterrose got a reaction from SuznAaron in Do public assistance programs impact the CR-1 negatively?
Why would you rely on public (tax-payer) assistance if your savings are sufficient to support yourself and your wife, and fund your wife's immigration, even if your current income is zero?  If you are accepting publicly-funded financial assistance, then you are a public charge; aka a burden on the public.

Let alone the morality aspect of receiving unnecessary funding--why would you ever possibly open the "public charge" can of worms when you are trying to go through the immigration process?  How can you expect to argue that you have enough money to support your wife and at the same time accept money/assistance that is intended for those who are unable to support themselves?

Is a sufficient Form I-864 the only consideration for meeting any public charge issues at the time of the visa interview?

No, consular officers also look at other public charge factors affecting the financial situation of both the financial sponsor(s) and the applicant. Age, health, education, skills, financial resources and family status of the applicant and the sponsor are factors. Consular officers will verify to the extent possible that applicants have adequate financial support to prevent them becoming a public charge in the United States. Public charge means that someone is likely to be primarily dependent on the U.S. government for subsistence.

Only the officer who handles your case can say whether this will affect your ability to sponsor, but it seems to me to be a foolish choice all around, especially considering that your reasoning for it seems to be, "eh, why not?"

In my opinion, meeting technical requirements to qualify to receive assistance (currently having $0 income), is different than actually needing the assistance.  In my opinion, if you have enough money in savings to act as the sole sponsor for your wife, you are nowhere near "needing" assistance.  I wouldn't feel comfortable taking tax-payer money simply because I didn't feel like dipping into my savings, but that's just me.  You are free to do as you like.

As far as immigration goes, never having received public assistance looks better for sponsorship than having been on food stamps during the immigration process does, but only the immigration officer handling your case will be able to tell you if it will affect your case or not.
