Damn, that is unfortunate but also relieving to hear. Thanks! I'll get right on that  and good luck with the interview!

From reading the forums, a lot of people unfortunately received RFIEs for birth certificates (me included) even after including one in their initial packets. I still don't know why they're requesting another copy.

I think you're fine with sending a photocopy, since that's what they were asking. I sent them another copy after getting an RFIE. We're now scheduled to be interviewed.

There seems to be confusion about what income to put in Part 6 #7. Luckily, the instructions are crystal clear and provide the correct answer. You wouldn't write income reported on tax returns on #7.
Item Number 7. Current Individual Annual Income. Type or print your current, individual, earned or retirement, annual income that you are using to meet the requirements of this affidavit and indicate the total in the space provided. You may include evidence supporting your claim about your expected income for the current year if you believe that submitting this evidence will help you establish ability to maintain sufficient income. You are not required to submit this evidence, however, unless specifically instructed to do so by a U.S. Government official. For example, you may include a recent letter from your employer, showing your employer’s address and telephone number, and indicating your annual salary. You may also provide pay stubs showing your income for the previous six months. If your claimed income includes alimony, child support, dividend or interest income, or income from any other source, you may also include evidence of that income.
Part 6 #7 is your projected income for the current year, based on your salary or hourly wage, as evidenced by the Employment verification letter and pay stubs. You DO NOT enter income reported on tax returns for Part 6 #7. Income reported on tax returns is limited to Part 6 #s 24a-c.

All of that being said, I'm sure some people put reported tax income in part 6 #7, and they probably didn't have any issues. But still, instructions are clear.

Why not include more than necessary just in case? I just saw another person get an RFE for a marriage certificate for an EAD *renewal*.

Obviously I-485 is required in this case. I-485 is based on marriage. Here's the I-485 (or NOA for I-485), and here's the supporting evidence for why I have I-485 in the first place. Don't need it? Toss it.

There's no reason not to cover all of the bases, unless you're trying to save on printing costs. Plenty of people get approved without it, sure, but doing your best to avoid any possible RFE is just never a bad idea.

That tax account transcript should be a tax RETURN transcript.

Okay, thank you. And I assume I'm fine with saying No on item 14. That asks if I want the SSA to issue me one, since I have already done so.
  7. Thanks
aqb reacted to treppenwitz in i-765 item 13.a
Answer "No" since the SSA still hasn't issued the number.

Thanks for the quick response. And that's unfortunate. Any insight on why they don't balance out the interviews more with Spokane? Seems weird. I feel like applicants would be more than willing to take the additional 3.5hr drive distance
for shorter waits to get their GC.

Hopefully. Our bank letter says to refer to customer for deposit information which is kind of annoying. So I will be printing off statements the past year to cover that. Hopefully they don't mind more paper.

You can't hurry it along at all. You have to wait for P3 which takes 2-4 weeks from Ready. Comply with what they ask for in P3 (the actual one they send you) by sending them a copy of the signed P3 checklist, your DS-160 confirmation and your Passport Bio. Then they send you P4. Then they tell you to register to schedule and you'll wait some more for interviews to open up, which only happens once a month during the last week of the month for two months ahead UNLESS you are lucky and you scoop up a cancellation. Get your medical appointment first so you can schedule the interview shortly afterwards.

Also in Canada you must get the vaccines of any you missed/need. You will not get your medical completed until it is done or started if it's multiple doses. This is another Country specific thing that most all other countries do not require.
~~Moved to the Canada forum, from K1 P&P - as the medical varies from country to country.~~

TDap should be free if you haven't had a booster for it in your adult life.  If you haven't had a Pertussis booster in your adult life, you will require one (Td is not sufficient for immigration).

Well if you do not get anything they will give you what they can at the medical exam and give you an exception for anything that they can not because of time constraints. The only benefit to getting them sooner is saving a little money. You actually do not ever have to get them completed. Here is a good thread on what will happen with them for AOS.

Many of our answers are predicated on the information you supply in your profile. When we look at the left column and can't determine your timeline or your Embassy it's hard for us to give you a factual answer. If you look at the profile of others here, they have a flag for their country, so it makes it easy for us to reply as we can quickly determine your Embassy. Our answers will sometimes be tailored to a specific Embassy hence the reason for you to complete your profile.

So, if you could help yourself out and complete your profile that sure would help us out when we want to reply to your question with factual information.

Go to the top right of this page select your name (it's on the upper right-hand corner)>my profile>[below your picture on the right column] edit my profile. Scroll to the bottom and fill in "Immigration Info". There now we can better serve you.

    Thanks

Wow, woke up to so many great responses. You guys are awesome. my partner and me will definitely look into the CR-1 visa and compare it with K1 and see which one aligns with our goals better, we didn't know we could get married first and then get a Visa. Thought we needed a visa to get married. Again, thank you so much, what a great community I'll be around as I do research so see you guys around

If you get married and then apply for a spouse visa, the marriage can take place anywhere in the world. The only requirement is that the marriage is legal. So, Canada, USA, a beach in the Bahamas, a castle in Europe, a cruise ship... wherever you want.

The K1 visa has the requirement to get married within 90 days of entering the US on the visa - not the opposite, i.e. the requirement for marriage in the US (or anywhere for that matter) is not the K1 visa. It's simply an option for people that aren't married yet to be able to have their fiance legally enter the country with the intent to marry and stay and AOS.

I wouldn't say getting married is your only option, but is usually the easiest and the most guaranteed. As a Canadian you may also have the option of a TN visa if marriage is too big a step at the moment (and kudos to you for asking about other options and not rushing into marriage). A TN would allow you to work in the USA for a period of up to 3 years initially. It's a work-based visa so there are certain requirements but it's actually quite a simple process. You might want to look into that.

If you are a student and can afford the fees to attend college in the USA then this could be another option.

There is no visa to "live with my boyfriend to see how it goes", unfortunately. There are marriage visas but as you correctly say, it's a big step.

The visas are immediate family visas (K1) allows you to take that intermediate step.  Without marriage you have no legal connection for visa purposes.

Seeing each other frequently helps, document visits.  Pictures, statements showing spending money in the other person's city, etc.

Just follow the chart, but..the K1 visa carries restrictions, so keep that in mind.  I think getting married and getting a CR1 makes more sense given your ability to travel freely already.  It would save money too.

    Option 1: K-1 Visa
Read the instructions for all forms, and read the guide: http://www.visajourney.com/content/k1guide
    ETA: ~7-9 months

Know that AOS is required after entering the US and marrying within 90 days ($1225 currently), then ROC 2 years after AOS is approved. Learn the entire process so there are no surprises.

Option 2: Get married and do a CR-1 visa
    Guide: http://www.visajourney.com/content/i130guide1
    ETA: ~12-14 months

This is cheaper, gets the actual green card faster, and permits working and traveling abroad right away (unlike the K-1).

The USC petitioner must be able to support the intending immigrant: I-134 for a K-1, then an I-864 for AOS or a CR-1.

You can continue visiting each other during the processing. The time together is a big plus (plus Canada is very low fraud anyway).
